PAYMENT INSTRUCTIONS	We accept Visa & MasterCard ONLY. Your credit card will be charged for your purchases, plus buyer’s premiums, and any taxes at the end of the auction. A pre-auction authorization will be performed to establish available credit. NOTHING will be charged to your card until a purchase is made. Credit card chargeback’s will not be accepted. Nevada residents may be charged state sales tax. Auction house reserves the right to request a different form of payment (wire transfer or check) for a larger amount.

TERMS AND CONDITIONS	All property is sold “AS IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Munari Auctions may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Munari Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Munari Auctions shall endeavor to describe in detail each item and any pertinent information about it. Munari Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Munari Auctions is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Munari Auctions or anyone else if the Internet service fails to work correctly before or during the live auction. Munari Auctions will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Munari Auctions reserves the right to withdraw or re-catalog items in this auction. Additional Terms and Conditions 1. All bidders and others attending this Auction agree that they have read and fully understand these terms and agree to be bound thereby. These terms and conditions are in addition to any other posted information if any. 2. Anyone over 18 years of age can register for the Auction. All persons wishing to bid must register. A valid credit card must be on file to register. A $100 refundable deposit is required to register. The deposit will be returned in its original form if Buyer is not the successful bidder at the auction. If Buyer is the successful bidder, all deposits and payments must be in cash, cashiers, check, certified funds, and credit card or wire transfer. Company checks will only be accepted with a bank letter of accommodation guaranteeing Auctioneers unqualified payment. NO EXCEPTIONS. Personal checks in excess of $500 will be held until cleared on the following Monday and then the winning items will be released. Registration for the Auction can be completed now and in person at the Auction. 3. Any announcements made the day of auction will take precedence over prior advertising and any previously printed material or any other oral statements made by anyone employed by, representing, or associated with the Auctioneers. 4. Questions will be entertained only prior to the commencement of the Auction proceedings. Please see a bid assistant for questions during the sale itself. 5. If any dispute arises between or among bidders, the decision of the Auctioneer shall be final and absolute. 6. This is an as-is cash sale. Buyer due diligence and inspections will be completed prior to the auction. There are no expressed or implied warranties. Property to be sold "As Is - Where Is." 7. Seller reserves the right to sell the property prior to Auction. Auctioneer will accept absentee bids prior to the live auction. Auctioneers reserve the right to reject any or all bids and reserves the right to bid on behalf of an absentee bidder. The existence of absentee bidders if any will be disclosed at the beginning of the auction. 8. Auctioneer will accept live telephone bids and faxed bids from registered bidders. 9. Auctioneer believes all information to be accurate but is not a guarantor. 10. A 15% buyer's premium will be added to the bid price on the lot to become part of the total purchase price paid by the Buyer at settlement. (i.e.If the final bid on the item is $100., add the 15% buyer's premium of $15. in this example, for a total purchase price of $115. 11. Buyer acknowledges that the Auctioneer represents the Seller and that the payment of the buyer's premium does not constitute relation of dual agency. 12. All items are subject to payment of Nevada Sales Tax of 7.75% on the total purchase price (final bid plus the Buyer’s Premium) unless the purchaser presents proof of exemption form. An exempt purchaser must provide a properly completed Nevada Resale Certificate (Form ST-120) evidencing possession of a valid Nevada Resale authorization, or for non-Nevada businesses, the equivalent resale authorization from another locale. Purchases will not be released unless all sales tax requirements are satisfied. Purchases shipped outside of Nevada are not subject to sales tax. 13. Lots are not returnable. 14. The rights and obligations of the parties shall be governed by the laws of the State of Nevada. All bidders and the purchaser submit to the personal jurisdiction of the Nevada courts and their rules and procedures in the event of any dispute. 15. On the fall of the auctioneer’s hammer, title to the offered lot or article will pass to the highest acknowledged bidder, who thereupon (a) immediately assumes full risk and responsibility, therefore, (b) will immediately sign a confirmation of the purchase therefore, setting forth his name and address, and (c) will immediately pay the full purchase price therefore. If the foregoing conditions or any other applicable conditions herein are not complied within addition to other remedies available to Auctioneers and the Consignor by law (including without limitation the right to hold the purchaser liable for the bid price), Auctioneers, at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser, or (b) resell the property, either publicly or privately, for the account and risk of the purchaser, and in such event the purchaser shall be liable for the payment of all deficiencies plus all costs, including warehousing, the expenses of both sales, and Auctioneers commission at its regular rates and all other charges due hereunder. Auctioneers may also impose late charges of 1.5% per month (or the highest rate allowed under applicable law, whichever is lower) on any amounts unpaid. 17. These terms and conditions can be changed at any time.
