PAYMENT INSTRUCTIONS	We accept Visa and MasterCard only. All accounts must be settled at the conclusion of the auction. The credit card that you registered with will be charged for your purchases plus a 15% buyer's premium and any applicable taxes immediately following the conclusion of the auction. A pre-auction authorization will be performed to establish available credit. NOTHING will be charged to your card until a purchase is made. You will be notified via e-mail of your purchases and the amount due. A second charge for shipping and insurance costs will be processed against your credit card when items are shipped. Credit card chargebacks WILL NOT BE ACCEPTED for any reason on any purchase - no exceptions! Florida residents will be charged 7% sales tax on applicable purchases unless a valid 2009 Florida Resale Certificate is provided at registration. NO SALES TAX ON U.S. COINS AND CURRENCY. A $30.00 processing fee will be charged to any account/bidder whose credit card on file is declined requiring additional time and telephone contact to establish payment for merchandise, or to run another credit card! Payments unpaid or late will result in the account being sent to a collections agency, which can affect your overall credit score. REAL ESTATE: A 15% Buyer's Premium shall be added to the highest bid to arrive at the total purchase price. If you are the successful bidder, a non-refundable $500.00 (escrow money) deposit is required auction day and will be automatically charged to your credit card on file. You will be notified immediately by the auction house or within 24 hours by email, and at this time you will be required to execute a written purchase contract provided by the auction house conforming to the terms and conditions of the sale as well as deposit an additional $1,000.00 (Cashier's check or Money Order) escrow deposit within 3 banking days to: Advanced Title & Escrow Services, LLC, which will be held in escrow and credited at closing. All deposits are non-refundable except for default by the Seller. Balance of total purchase price shall be due and payable at time of closing - usually within 30 days from the conclusion of auction. If successful Bidder fails to execute the real estate contract and deposit the additional required funds, the $500.00 initial deposit (via the credit card) shall be retained by Florida Auctioneers & Realty, LLC as agreed liquidated damages. SHIPPING INSTRUCTIONS	Florida Auctioneers & Realty will attempt to process all shipping within 10 days after the auction. Shipping and insurance charges are the responsibility of the buyer. All items will be insured for the purchase price. Items will be packed and shipped via the USPS, UPS or Fedex Ground. Fragile or high value items may require special handling and result in handling fees that will be charged to the buyer. If feasible, multiple purchases will be consolidated to reduce actual shipping costs. A second charge for shipping and insurance costs will be processed against your credit card. If there is any damage from shipping, you must file a claim with that carrier. Do not return the item(s) to auction house.

TERMS AND CONDITIONS	Thank you for participating in Florida Auctioneers & Realty's Online Auction. It is important that you familiarize yourself with the terms and conditions as all sales are final and irrevocable. The terms of sale are non-negotiable. Good luck and good bidding! Registration for the online auction finalizes each bidder's agreement to the terms and conditions of sale as stated in the Contract and its Addenda which are incorporated by reference into your bidding. Do not bid until you have read these terms and conditions. In order to bid on the auction items, all Bidders must be registered to bid through Proxibid . There is no fee to register although a valid credit card will be required to verify identity and funds. By bidding you are representing to Florida Auctioneers & Realty, LLC ("Broker" and/or "Auctioneer") and the seller that you have read and agree to be bound by the terms and conditions for this sale as stated herein. If you do not agree with any of the terms and conditions stated DO NOT BID or you will be bound by those terms and conditions. By bidding you agree to all disclosures. All auction items are sold "AS IS", and ALL SALES ARE FINAL. It is the Bidder's responsibility to determine condition, age, genuineness, value, provenance, or any other determinative factor. Florida Auctioneers & Realty, LLC is not responsible for malfunctions or system errors which cause a bid or bidder to fail to be recognized or registered. If there is a dispute, the Auctioneer may re-open the bidding at the Auctioneer's sole discretion and shall serve as the sole arbiter as to who is or is not allowed to bid. The Auctioneer reserves the right to group, add to, delete, withdraw, consolidate or break down properties or quantities offered, to sell out of scheduled sequence, to reject any bid which is only a fraction advance over the preceding bid, to regulate bidding and to accept or reject any or all bids. Absentee bids may be accepted at the sole discretion of the Auctioneer. Any and all decisions of the Auctioneer regarding the order and conduct of the auction shall be final and absolute without liability to any party. Seller reserves the right to cancel, re-catalog, or withdraw any property at any time. Auctioneer shall not be held responsible for any "missed" bids or bids unseen by the Auctioneer. Bidding starts at the nominal Opening Bid(s) indicated and is open to all who registered and are approved. The Auctioneer will control any increments of bidding. The bidding will continue for a period of seven (7) to eight (8) days, as this is a Timed Online Auction. The auction ends at a predetermined time with an Overtime Period if necessary, which is defined in Proxibid's terms and condition. The last bid shall be made final. Auctioneer is providing internet online bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances, shall Bidder have any kind of claim against Florida Auctioneers & Realty, LLC or anyone else if the internet service fails to work correctly before or during the auction. A 15% Buyer's Premium will be added to the high bid and included in the total purchase price for each item or property. Please see the Catalog, the Contract for Sale, and/or the Auctioneer for specifics about any item or property you wish to bid on. Bidder agrees that this auction as well as the terms and conditions shall be governed by the laws of the State of Florida, and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Sarasota County, Florida. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Florida Auctioneers & Realty, LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Sarasota County, Florida. REAL ESTATE: If you are the high bidder on a property(s), a non-refundable $500.00 deposit per property is required auction day and will be automatically charged to your credit card on file. If you are the successful bidder, you will be notified immediately by the auction house or within 24 hours by e-mail, and you will be required to execute a written Contract of Sale provided by the auction house conforming to the terms and conditions of the sale, as well as deposit an additional $1,000.00 (electronic wire funds, credit card, and cashier's checks are the only forms of payment accepted) deposit within three (3) banking days to Florida Auctioneers & Realty, LLC. Such funds will be held in escrow and credited at closing. All deposits are non-refundable except for default by the Seller. If you are a resident/citizen of a country outside of the US, certified funds (bank check, wire transfer, certified checks) are required for the down payment and closing. Once the Seller approves the Sale, the deposit will be credited to the Contract. The balance of the purchase price and all closing costs are due at time of closing. Deposits will not be forwarded to any title company, or other party, for closing until Florida Auctioneers & Realty's bank has received "cleared funds" for the deposit. Within 24 hours immediately following the close of the auction, Auctioneer or Title Company shall contact Buyer by electronic mail, telephone or facsimile to provide documents for execution. All purchase documents will be provided to the Buyer and Buyer will be required to sign and return all purchase documents to Auctioneer via overnight delivery. Buyer shall have three (3) banking days following the auction to return all completed documents or shall be subject to paying $500.00 in liquidated damages, such amount to be debited from their credit card. If you wish to preview the purchase documents, please contact Auctioneer PRIOR to the Auction and we will provide them to you for review so as to not delay the post auction process. The contract of sale is not subject to negotiation or modification. If Buyer is a winning bidder, and after executing the sales contract or other documents, refuses or fails to complete the transaction for ANY reason (including, but not limited to, remitting the total purchase amount), Buyer shall relinquish ANY right to complete the transaction and shall have no rights or interest in the property, as well as forfeit all deposit monies as liquidated damages. PLEASE BE ADVISED: Various state statutes give Seller the right to pursue legal action against bidders who refuse to complete transactions. This may include (but is not limited to) suit to compel completion of the sale, and/or criminal charges of fraud or other intentional act. All properties are sold "AS IS, WHERE IS" with no financing, inspection or other contingencies to sale, and with no guarantees, expressed or implied. Florida Auctioneers & Realty, LLC represents the Sellers only and does not inspect properties on bidder's behalf. Buyers must conduct their own due diligence and investigation of each property and must also investigate the suitability of each parcel prior to making a bid and purchase at the auction. Buyers must rely solely upon their own investigation and not any information provided by the Seller or Auctioneer. Failure of a Buyer to be fully informed on the condition of a property will not constitute grounds for any claim adjustment or right to cancel sale. Buyers receive a deed and Title Insurance Policy as provided by the Closer indicated in the Contract (any mobile/manufactured housing on the property will only be conveyed by a Hold Harmless Agreement or Quit Claim Bill of Sale unless otherwise noted in Disclosures). Current year's taxes are pro-rated through day of closing as is customary, if applicable. All auctions are subject to Seller, lender, or court approval. Most short sales and bank owned foreclosure properties are usually approved within 30 days or less. Therefore, the final bid is subject to seller confirmation within 48 hours (except short sales and foreclosures) following the conclusion of the auction. Buyers are not allowed possession until recording of the deed, at which time the property should be re-keyed. For Timeshare properties, your "deeded week" in the calendar year is your possession time period. "Showing" requests from Buyers after the auction may not be able to be accommodated. All the information contained on this or other properties in the auction was obtained from official county maps, county property appraisers, or other sources deemed reliable, but is not guaranteed and may be in error. Seller DOES NOT WARRANT the accuracy thereof. Seller has made no independent investigation of any information provided, and assumes no responsibility for the providing of or absence of any information, whatsoever, or for the accuracy thereof. NOTICE: Institutional and Fiduciary Sellers (courts, government agencies, banks and trustees) have not occupied the properties and have NO information to provide for disclosure. Properties are sold 'As Is ? Where Is' and should be fully inspected prior to bidding on. AUCTION COMPANY HAS NO PERSONAL KNOWLEDGE OF THE SUBJECT PROPERTY OR ITS FIXTURES OR CONDITION AND IS NOT RESPONSIBLE FOR SUCH. YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. ANY BIDDER WHO FAILS TO CONSUMATE A PURCHASE WILL BE BANNED FROM BIDDING AT ALL FUTURE AUCTION EVENTS AND MAY BE PURSUED FOR CIVIL AND/OR CRIMINAL VIOLATIONS.
