Your credit card will be charged for your purchases, plus buyer’s premiums, and any taxes at the end of the auction. A pre-auction authorization will be performed to establish available credit. NOTHING will be charged to your card until a purchase is made. Credit card chargeback’s will not be accepted. Nevada residents may be charged state sales tax of 7.75%. Auction house reserves the right to request a different form of payment (wire transfer or check) for amounts over $500. ADDITIONAL TERMS AND CONDITIONS REAL PROPERTY 1. All bidders and others attending this Auction agree that they have read and fully understand these terms and agree to be bound thereby. These terms and conditions are in addition to any other posted information if any. 2. Registration for the Real Estate can be completed now at Proxibid.com/munari . 3. Any announcements made the day of auction will take precedence over prior advertising and any previously printed material or any other oral statements made by anyone employed by, representing, or associated with the Auctioneers. 4. Questions will be entertained only prior to the commencement of the Auction proceedings. Please see a bid assistant for questions during the sale itself. 5. If any dispute arises between or among bidders, the decision of the Auctioneer shall be final and absolute. 6. This is an as-is cash sale. Buyer due diligence and inspections will be completed prior to the auction. There are no expressed or implied warranties. Property to be sold "As Is - Where Is." This is a reserve auction. 7. Seller reserves the right to sell the property prior to Auction. The seller is not obligated to sell the property unless the published minimum reserve price has been met. Seller retains the right to accept or reject a final bid that is less than the minimum reserve price. 8. Auctioneer will accept absentee bids prior to the live auction. Auctioneers reserve the right to reject any or all bids and reserves the right to bid on behalf of an absentee bidder. The existence of absentee bidders if any will be disclosed at the beginning of the auction. 9. Auctioneer will accept live telephone bids from registered bidders 10. Auctioneer believes all information to be accurate but is not a guarantor. 11. A 15% buyer’s premium will be added to the bid price on the property to become part of the total purchase price paid by the Buyer at closing. (i.e.If the final bid on the property is $100, add the 15% buyer’s premium of $15 in this example, for a total purchase price of $115. Internet biiders may have a slightly higher buyer’s premium. There is no refunds or buyer’s premium. 12. Buyer acknowledges that the Auctioneer represents the Seller and that the payment of the buyer’s premium does not constitute relation of dual agency. 13. Broker Participation: A commission will be paid by the Auction Company to the whose prospect successfully wins the lot. Broker/Buyer’s Agent must call for and complete a Memorandum of Understanding prior to the published viewing date(s), which are available through Munari Auctions at (702) 914-8898. 14. On the fall of the auctioneer’s hammer, title to the offered lot or article will pass to the highest acknowledged bidder, who thereupon (a) immediately assumes full risk and responsibility, therefore, (b) will immediately sign a confirmation of the purchase therefore, setting forth his name and address, and (c) will immediately pay the full purchase price therefore. If the foregoing conditions or any other applicable conditions herein are not complied with in addition to other remedies available to Auctioneers and the Consignor by law (including without limitation the right to hold the purchaser liable for the bid price), Auctioneers, at its option, may either (a) cancel the sale, retaining as liquidated damages all payments made by the purchaser, or (b) resell the property, either publicly or privately, for the account and risk of the purchaser, and in such event the purchaser shall be liable for the payment of all deficiencies plus all costs, including warehousing, the expenses of both sales, and Auctioneers commission at its regular rates and all other charges due hereunder. Auctioneers may also impose late charges of 1.5% per month (or the highest rate allowed under applicable law, whichever is lower) on any amounts unpaid. 15. Lots are not returnable. Buyer’s premiums are not refundable under any condition. 16. These terms and conditions can be changed at any time.
SHIPPING INSTRUCTIONS Shipping cost is the sole responsibility of the buyer. Your credit card will be charged twice- once for purchases and once for shipping.
