PAYMENT INSTRUCTIONS	We accept Visa, Mastercard and Discover Credit cards ONLY. All accounts must be settled at the conclusion of the auction. Your credit card will be charged for your purchases plus a 15% buyers premium and any applicable taxes immediately following the conclusion of the auction. A pre-auction authorization will be performed to establish available credit. NOTHING will be charged to your card until a purchase is made. Credit card chargebacks WILL NOT BE ACCEPTED. There will be no sales tax charged for online sales unless you live withing the state boundaries of Texas. Texas residents will be charged 8.25% sales tax unless a valid Texas Resale Certificate is provided at registration. Please fax or email copy of certificate to Davis Auctioneers at fax # 877-482-5745 or email: info @davisauctiontx.com. We must have this certificate on file in order to exclude saled tax from your purchases on your final invoice. A $40.00 service fee will be charged to any account who's credit card on file is declined requiring additional time and telephone contact to establish payment for merchandise. NO EXCEPTIONS. All purchases must be paid for, in full, prior to removal of any items from the auction site and / or prior to items being delivered to shipping company.
SHIPPING INSTRUCTIONS	Purchases will be ready for shipping after your payment has been confirmed. Please allow up to 10 business days for your items to be shipped. Shipping & handling charges will be the sole responsibility of the bidders. Shipping will be handled by Burleson Eagle Postal Center (BEPC), Burleson, TX, 817-426-6245 & will be charged separately. Arrangements for shipping will be made between the BEPC & the buyer on payment for delivery. You must provide a copy of the signed authorization form provided by BEPC before shippping will be initiated. BEPC will charge your card when shipping & handling costs have been calculated. Tracking numbers will be available after carrier pickup. Davis Auctioneers is not responsible for items once delivered to BEPC.

TERMS AND CONDITIONS	These terms and conditions apply to all items offered for sale by Davis Auctioneers, LP and they reserve the right to modify these Terms and Conditions at any time and any such modification shall become part of these Terms and Conditions. By registering to bid or placing a bid you acknowledge that you have read and understand and that you agree to be bound by all these terms and conditions and any other announced terms and conditions of sale or rules of the site. 1. All property is sold �AS IS�, and ALL SALES ARE FINAL. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. All merchandise is used and is being sold as used and neither Seller nor Auctioneer authenticates workmanship, quality or authenticity. Bidders who bid from offsite understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. Davis Auctioneers shall endeavor to describe in detail each item and any pertinent information about it in advertising, on the Internet and at the auction but makes no representations. In no event shall Davis Auctioneers be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidder agrees that everything is sold as is and that they may not return any item they purchase. 2. This auction will feature online Internet bidding only. Bidders must be pre-registered with a credit card on file to bid. Bids will be accepted until the close of the auction. Bidder acknowledges and understands that this bidding service may or may not function correctly the day of the auction. Davis Auctioneers, LP, does not guarantee that its system for placing, receiving, collecting and tabulating bids on Internet auction sales will be available without interruption, error-free or free from other defects. Davis Auctioneers, LP assumes no obligation to ensure that a prospective Buyers bid is received, properly and effectively processed, or accepted. Davis Auctioneers, LP shall not be liable for any technical errors or problems with the internet auction system of this website. If there is an internet failure during bidding, the auction will continue as normal and the item will be sold to the bidder with the highest bid at the conclusion of the auction. Under no circumstances shall Bidder have any kind of claim against Davis Auctioneers or anyone else if the Internet service fails to work correctly before or during the auction. Davis Auctioneers will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid prior to the auction beginning. Davis Auctioneers reserves the right to withdraw or re-catalog items in this auction. 3. Bidder agrees that everything is sold as is and that they may not return any item they purchase for any reason except for an intentional and material misrepresentation of the item itself made by Davis Auctioneers, LP. Bidder's sole remedy in the suspected event of an intentional and material misrepresentation of an item shall be to return the item, at their expense and in the same condition it was received. If Davis Auctioneers, LP agree that the item was materially and intentionally misrepresented, Davis Auctioneers, LP will refund the Bidders purchase price to him / her. Bidder agrees that under no circumstances whatsoever will Davis Auctioneers, LP ever be liable to any bidder for an amount greater than the purchase price of the item. 4. Internet bids are a contract and bidders are responsible for honoring them. Bidder accepts responsibility for and agrees to indemnify, defend and hold harmless seller and auctioneer and their employee, governing body, officers, owners, affiliates, subsidiaries, directors, agents and representatives from and against any and all claims, losses, damages, liabilities, judgments, fees, costs and expenses including reasonable attorneys fees and expenses related to, arising from or associated with buyer, his agents or representatives, use of the site, including but not limited to personal injuries or property damage incurred on the sale premises or during removal and transport of any auction item, and arising out of, based upon, or resulting from any breach or violation by bidder of this site user agreement or any use by bidder of the site or as a result of a dispute with another bidder. 5. Auctions will be extended by 3 minutes at closing if a bid was placed within the last 60 seconds of the auction. Bid extensions will continue to take place until no further bids are placed during the last 60 seconds of an auction. Placing a bid after the close of an auction will not allow an extension to the auction end time. 6. Davis Auctioneers, LP may withdraw or add an item before or during the auction. Any deletions or additions to the sale will be announced by the Auctioneer, either before or during the sale. The Auctioneer also reserves the right to group one or more lots into one or more selling lots or to subdivide into two or more selling lots. Whenever the best interest of the seller will be served, the Auctioneer reserves the right to sell all the property listed in bulk. Any dispute among bidders will be settled by the Auctioneer at his sole discretion, and his decision and remedy will be deemed final. The record of the auction made by Davis Auctioneers, LP shall be conclusive. 7. Successful bidders will be notified by e-mail within 24 hours of the conclusion of the auction. The bidders will be contacted by the shipping company, Burleson Eagle Postal Center, Burleson, Tx to make arrangements for the shipping and handling. 8. Failure by Davis Auctioneers, LP to enforce any provision of these Terms and Conditions shall not be construed or interpreted as a waiver of the Terms and Conditions. Any waiver of any term or condition shall be in writing, signed by an authorized representative of Davis Auctioneers, LP, and shall be effective only for the instance specified in the writing. If any provision of these Terms and Conditions is deemed illegal, invalid or unenforceable, the legality, validity and enforceability of the remaining parts shall not be affected. We want you to be happy with your purchases. If you have questions about the merchandise, the time to ask questions is well in advance of the auction. No returns are allowed.
