PAYMENT INSTRUCTIONS	Payment must be made to United Country - Theurer Auction/Realty upon notification that you are the winning bidder. Wire transfer or cashier's check will be accepted for this auction. Wire transfer instructions for payment will be provided to the successful bidder within 24 hours of close of auction. The vehicle will not be released nor title processed until full payment is received in the United Country - Theurer Auction/Realty, LLC, operating bank account. Title will be delivered with the vehicle. A 10% Buyer's Premium will be added to the final bid price. Specific requirements can be waived for individuals that are already established customers with United Country-Theurer Auction/Realty, LLC, by contacting the auction company.
SHIPPING INSTRUCTIONS	There is no shipping of this item. Pickup will be at the office of United Country - Theurer Auction/Realty, LLC, 802 East 16th Street, Wellington, Kansas. Instructions and directions will be provided to the successful bidder when full payment is received in our account by wire transfer. Shipping and removal shall be at Buyer's own expense, risk, and liability.

TERMS AND CONDITIONS	NOTICE: All Bidders of this auction agree that they have read and fully understand these terms and agree to be bound thereby. 1. REGISTRATION: Buyers must register prior to bidding at this auction. All bidders must provide company name (if applicable), mailing address, telephone number and email address. By registering you represent and warrant that any and all Buyer information is correct. Auction Company reserves the right to deny any registered bidder at any time at its sole discretion without notification. A Visa or MasterCard is required to register. Auction Company reserves the right to authorize your credit card for $100.00 to assure you have a valid credit card. The authorization expires after the conclusion of the event. 2. INSPECTION: Bidders may inspect the vehicle and are urged to do so during normal business hours, Monday through Friday, 8am-5pm, CST, at 802 East 16th Street, Wellington, Kansas, or you may contact auction office 620.326.7315 to schedule an appointment. Photos are provided for reference but may not accurately depict the lot represented. 3. AUCTION END TIMES: Any bid placed within 5 minutes of the auction ending will automatically extend the auction for 5 minutes from the time the bid is placed. Example: If an auction scheduled to end at 10:00 a.m. receives a bid at 9:59 a.m., the close time of the auction automatically extends to 10:04 a.m. The auto-extend feature remains active until no further bids are received within the 5 minute time frame. 4. INVOICES: Bidders will be sent an electronic invoice to the email address provided during registration. Invoices can be faxed upon request. 5. PAYMENT: CREDIT CARD REQUIRED FOR REGISTRATION ONLY. NO CREDIT CARD PAYMENT ACCEPTED FOR PURCHASES. Auction Company must receive all payments within 24 hours of conclusion of the Auction. Payments must be made by Cash, Wire Transfer or Cashiers Check drawn to the order of: United Country Theurer Auction/Realty, LLC, 802 East 16th Street, Wellington, Kansas, 67152. Call the auction office for instructions for wire transfer to the account of United Country - Theurer Auction/Realty LLC. A 10% Buyer's Premium as well as all applicable state and local sales taxes apply unless you provide proof of non taxable status. 6. TIME OF REMOVAL: No goods will be released to the purchaser until the entire bill is paid for in full. Contact Auction Company for removal arrangements. 7. MANNER OF REMOVAL: Buyers must remove the merchandise from the premises at their own risk, expense and liability. Purchases can be removed only upon presentation of original paid bill. Any personnel arriving to remove property must have government issued photo identification (such as driver�s license) and prove they are the buyer, or have written, verifiable authorization from the buyer. Auction Company is not responsible for items that are not removed within the time specified and has the option of dumping, storing or re-selling any item purchased at the expense and risk of the Buyer. 8. NON-PAYMENT: Failure to pay invoices in full within the time herein specified, the Auction Company, in addition to all other remedies allowed by law, will subject the Buyer to pay as liquidated damages the full amount of the difference between the original invoice price and the re-sold price plus any expenses incurred to re-market or re-sell the assets. The winning bidder will also be charged an administrative fee of $500 on the credit card provided at auction registration. 9. NON-DELIVERY RESPONSIBILITY: All purchases made are at the Buyer�s risk. The Auction Company shall not be responsible if all or any part of such purchases be lost, stolen, damaged or destroyed from any cause whatsoever. The Auction Company shall not, in any event, be liable for non-delivery, or for any other matter or thing, to any Buyer of any lot, other than the return of the deposit or sum paid on said lot, should the Buyer be entitled to it. 10. CONDITION OF ITEMS SOLD: Auction Company is not responsible for the correct description, authenticity, genuineness of, or defects in any lot and makes no warranty in connection therewith. No allowance will be made or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods are exposed for public exhibition and are sold "AS IS" and without recourse. It is for this reason that all Buyers should avail themselves of the opportunity to make inspection prior to sale. 11. CLAIMS: Auction Company will not be responsible for any missed bids from any source. Under no circumstances shall Bidder have any kind of claim against Auction Company or anyone else if the Internet service fails to work correctly during the online auction. 12. INDEMNIFICATION: Buyer agrees to indemnify and hold harmless Auction Company and Seller from and against all claims and liabilities relating to the condition or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state and local laws applicable to such articles or for proximate or consequential damages, costs or legal expenses arising there from. 13. AGENCY: The Auction Company is acting as agent of the Seller only and is not responsible for acts of its principals. 14. BUYER�S PREMIUM: 10% Buyer�s Premium will be added to all purchases. 15. RIGHTS OF SECURED PARTIES AND SELLER: Secured Parties and Seller reserve the right to accept or reject any or all bids, or withdraw any or all items from the auction, during or after the close of bidding by Thursday, October 1, 2009, 11:59 PM. UNITED COUNTRY - THEURER AUCTION/REALTY, LLC THANKS YOU FOR YOUR PARTICIPATION All property is offered �AS IS�, and ALL SALES ARE FINAL once confirmed by the Secured Parties and Seller. Property is open to thorough public inspection. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. United Country - Theurer Auction/Realty, LLC, may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no guarantees or representations. In no event shall United Country - Theurer Auction/Realty, LLC, be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall judge value according to their own inspection. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. United Country - Theurer Auction/Realty, LLC, shall endeavor to describe in detail each item and any pertinent information about it. United Country - Theurer Auction/ Realty, LLC, will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Bidder acknowledges and understands that the internet bidding service may or may not function correctly at all times. Under no circumstances shall Bidder have any kind of claim against United Country - Theurer Auction/Realty, LLC, or anyone else if the Internet service fails to work correctly during the online auction. United Country - Theurer Auction/Realty, LLC, will not be responsible for any missed bids from any source. United Country - Theurer Auction/Realty, LLC, reserves the right to withdraw or re-catalog items in this auction.
