PAYMENT INSTRUCTIONS	All accounts must be settled at the conclusion of the auction. We accept Visa & MasterCard ONLY. Your credit card will be charged for your purchases, plus buyer’s premiums, and any taxes. A pre-auction authorization will be performed to establish available credit. NOTHING will be charged to your card until a purchase is made. Credit card chargeback’s will not be accepted. Missouri residents will be charged 6.075% sales tax. There will be a second charge for any shipping, handling and/or FFL transfer fees.
SHIPPING INSTRUCTIONS	Shipping cost is the sole responsibility of the buyer. Your credit card will be charged twice- once for purchases and once for shipping. Shipping and handling will be charged at a separate time. Please call The Packaging Store in St. Louis 888-217-0717 for a shipping quote on your item before you bid. This is the only shipper we will use, we have a long term relationship with them, they are the best shipper in our area and we will not ship with anyone but them.

TERMS AND CONDITIONS	Condition: Guns will be sold according to all Missouri State and Federal laws. MO. residents over 18 who are not Felons may purchase guns. Buyers from other states will have to have their purhcases dellivered via a FFL licensed dealer, there will be a charge for this transfer of $30. All damages seen at time of listing has been identified. Common nicks, scratches and wear has not been called. If an item is found to be different than listed, it will be announced and no absentee or live bids will be entered on item. It is the bidder’s responsibility to determine overall condition before bidding on an item. The following is an email from the Assistant Attorney General. We will comply with these requirements at all of our auctions. Out of state buyers will need to have their guns sent via Federal Firearms Licensed (FFL) dealers. A great list of these FFL holders can be found at http://www.gunbroker.com/User/DealerNetwork.asp. Please check with a local FFL holder before bidding on any gun at our auctions as we will not allow out of state buyers to take possession of any gun or bid on an gun at our auctions. Your FFL dealer will handle the shipping of your gun. Buyers of any firearm are required to follow all federal, state, county and city regulations and laws. I have the ATF ruling about this and it leaves some issues in question. If I am selling a handgun to a MO. resident, do I need to run a background check? I understand that a new law was passed and I no longer have to do this. Here is the problem an auctioneer can sell guns without an FFL if he is selling an estate, and does not take possession of the guns. If I am selling an estate that contains (along with the tv, couch ect.) some guns and some of them are handguns I can't do an instant background check because I do not have an FFL, I don't need one as a auctioneer that is not in the gun business. The short answer is that you do not have to run a background check. Now for the long answer, which restates much of what you know and walks through the analysis. Missouri law now says that you commit the crime of unlawful transfer of a concealable firearm if you violate federal law, specifically 18 U.S.C. Section 922(b) or 18 U.S.C. Section 922(x). Here is a link to that Missouri law: http://www.moga.mo.gov/statutes/C500-599/5710000080.HTM , which took effect August 28, 2007. Here is a link to those federal law provisions referenced in the Missouri law: http://caselaw.lp.findlaw.com/casecode/uscodes/18/parts/i/chapters/44/sections/section_922.html As you'll see, 18 U.S.C. Section 922(b) applies to those licensed by the federal government as importers, manufacturers, dealers, and collectors. It says basically that you can't sell to certain people, felons, for instance. To comply with this provision, those licensees run background checks through the FBI to make sure that the prospective purchaser is not disqualified. 18 U.S.C. Section 922(x) applies to everyone, and says you can't sell a handgun to a juvenile (under 21 years of age). The key question, then, is whether an auctioneer is considered a dealer or collector (and whether you would therefore be liable if you sell to a prohibited person). As you indicated, the answer is "no." Couple more things: in Missouri, it is a crime to transfer a firearm to someone who is disqualified. It is also a crime to recklessly transfer a firearm to a person who is intoxicated. I know these are common sense things, but wanted you to be aware that there are specific state law provisions on them. http://www.moga.mo.gov/statutes/C500-599/5710000060.HTM So...if you have reasonable cause to believe the buyer is a juvenile, don't transfer a handgun to him/her. Also, do not transfer any gun to someone you know is a felon. And do not transfer any gun to someone who is intoxicated. I hope this helps. Please let me know if you have any questions. Mound City Auctions reserves the right to withdraw or re-catalog items in this auction. 6. The auctioneer shall advance the bidding at his own discretion. Mound City Auctions may withdraw any item before or during the auction. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. The record of the auction made by Mound City Auctions shall be conclusive. Typical Bidding Increments: 0 - 100 = 10 100 - 500 = 25 500 - 1000 = 50 1000 - 2500 = 100 2500 - 5000 = 250 5000 - 10000 = 500 10000 - 25000 = 1000 25000 - 50000 = 2500 50000 - 100000 = 5000 The auctioneer has the sole and exclusive power, discretion, and authority to regulate the bidding and its increments, these bid increments are a guideline, but can be changed by the auctioneer at any time without notice. 7. When the auctioneer says “sold” Bidder assumes full responsibility for the merchandise. Everything MUST be paid for in full at the conclusion of the auction. Payment shall be made in cash or certified funds or by VISA or MasterCard. Checks of any kind must be accompanied by an irrevocable bank letter of credit guaranteeing payment to Mound City Auctions and approved at least 24 hours in advance of the auction. If a check accepted by Mound City Auctions is returned for any reason bidder agrees that Mound City Auctions may re-present it in person or electronically and collect the amount of the check as well as the highest service charges and fees allowed under Missouri law. If paying by certified check with a bank letter of credit Buyer shall immediately send payment by overnight priority mail to Mound City Auctions, 1081 Teson Rd, Hazelwood, MO. 63042. If Mound City Auctions does not receive payment by the Tuesday following the auction, the bidder agrees that Mound City Auctions shall add an administrative collection fee of $100.00 to their balance due. Any amount left unpaid shall accrue interest at the highest rate allowed under Missouri state law. Unless exempted by law, the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Mound City Auctions against any claim if sales tax is not collected on Bidder’s purchases. Bidder agrees to not stop payment on any check paid to Mound City Auctions. Bidder further agrees that under no circumstances will he/she initiate a charge back on his/her credit card. Title to the merchandise transfers to Bidder only when Bidder’s payment has been honored. 8. The auction company will arrange for packing and shipping. Packing and shipping costs are the responsibility of the Bidder and may be quoted before shipping. All items and purchases will be shipped by a professional packer and may result in higher shipping costs. All items will be insured for the purchase price. Our first priority is to deliver your new purchase in excellent condition. Any merchandise not removed by bidder may be moved and stored at bidder’s expense, resold at the next auction or disposed of in any other way Mound City Auctions deems to be suitable. There shall be no refund of bidder's payment in this case. Bidder shall have no claim to merchandise not removed by the date of the auction or if shipping is not paid for within 30 days. 9. Bidder agrees that this agreement shall be governed by the laws of the state of Missouri and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Missouri. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Mound City Auctions and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Missouri. Bidder agrees to pay all legal fees in any dispute with Mound City Auctions. 10.Mound City Auctions may refuse a buyer’s number to anyone for any reason. Bidder agrees to provide any identification Mound City Auctions may request including but not limited to: drivers license, photocopies of credit cards, Social Security card or US Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 11.Bidder agrees that delivery will be FOB Kirkwood, MO. And that as such delivery will be considered complete when Auctioneer's shipper receives item for shipment. 12.We want you to be happy with your purchases. If you have questions about the merchandise the time to ask questions is well in advance of the live auction. No returns are allowed. Thank you for your patronage.
