TERMS AND CONDITIONS	1.No prior deposits are required to bid in this auction unless registered by phone or internet. Bidder is required at registration to show proof of potential same day payment of deposit in the form of a personal check, money order or cashier�s check. 2.The winning bidder shall immediately sign the sales contract at the conclusion of the bidding and a $10,000 deposit shall be posted at that time. Acceptable means of payment are cashier's check, money orders or personal checks but funds MUST BE AVAILABLE IMMEDIATELY. If bidder intends to purchase multiple properties and continue bidding after a successful bid, he/she must notify auctioneer or designated agent in advance of the auction. 3.The balance of 10% is due 5 business days upon acceptance with the remaining balance due at closing in the form of Cashier�s check, money order or wire transfer. 4.CLOSING SHALL BE ON OR BEFORE 30 DAYS OF THE EFFECTIVE DATE OF THE CONTRACT. The property shall be closed and title insurance issued through: Riddell Law Group 3400 South Tamiami Trail Sarasota, FL 34239 or with an alternate real estate attorney as determined by the auctioneer. Checks made payable to: Jefferson Riddell Trust Account. 5.SHORT SALES: Subject to post auction lender acceptance within 60 days of auction date. Closing date on or before 30 days after lender acceptance and determined by lender. 6. The complete and final terms & conditions are on the bidder registration and agent/broker registration forms. 7.The auctioneer/broker shall be the final authority in all matters. The auctioneer/broker reserves the right to accept or reject any and all bids. Auctioneer does not bid on behalf of the seller or use shills or rigged bidding of any kind. 8.There are no contingencies of any kind. The buyer accepts the property "as is where is" with no warranties or guarantees of any kind except free and clear title transfer from the seller to the buyer with no liens or encumbrances of any kind at closing. 9.Once the contract is agreed upon and executed by all parties, the deposit is not refundable for any reason unless the seller is unable to perform. 10.Agents must register by noon the day before the auction in order to be eligible for compensation. Agents must have their clients sign their registration and must accompany their clients in person to the auction. Forms are available on line. 11.Telephone or internet bidding is acceptable with advanced registration. 12.Any exceptions to these terms & conditions must be approved in writing by the auctioneer in advance of the bid calling, no exceptions. 13.A 10% buyer�s premium (BP) shall be added to the high bid. All property is sold �AS IS�, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. Marsha Wolak Auctions may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Marsha Wolak Auctions be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder�s responsibility to determine condition, age, genuineness, value or any other determinative factor. Marsha Wolak Auctions shall endeavor to describe in detail each item and any pertinent information about it. Marsha Wolak Auctions will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Marsha Wolak Auctions is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Marsha Wolak Auctions or anyone else if the Internet service fails to work correctly before or during the live auction. Marsha Wolak Auctions will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Marsha Wolak Auctions reserves the right to withdraw or re-catalog items in this auction.
