Special Terms
TERMS:A non-refundable cashiers check or wire transfer shall be made payable to First American Title in the amount of 10% of the final sale price, due immediately after being declared the winning bidder. This auction is a Cash, As-Is Sale. The balance is due in cash at COE within 30 days from auction day. No contingency on financing, inspections, or appraisal. This Property is selling "As-Is, Where-Is" and with "All Faults" with no warranties from the Auctioneer, Auction company or Seller. Any and all inspections must be done prior to Auction date. Bidders are encouraged to carefully inspect the property and all available information relating thereto. All bidders acknowledge that Auctioneer does not have an ownership interest in the property in this auction and therefore, all bidders further acknowledge that Auctioneer is not responsible for any actions or inactions by Seller (s) regarding Seller (s) obligations under the Sales Contract.
AUCTION TYPE:
The above property will be offered for sale at public auction and is subject to “Seller Confirmation” the seller has the opportunity to either accept or reject the final bid obtained by the auctioneer.
PREVIEWS:
Contact Auction Company to scheduled a preview of the property prior to Auction day. Property will be open 2 hours prior to start of Auction on October 29th.
LIVE INTERNET BIDDING:
Bidders that cannot make it to the live auction event will have the opportunity to bid on the internet during the live auction. Internet bidders are required to pre-register no later than 2 hours prior to the auction event. For pre-registration information go to our website at www.AuctionOneLasVegas.com The Auction company will contact the high bidder with the seller’s response of acceptance or rejection no later than 24 hours after the conclusion of the auction.
DEPOSIT:
Winning bidders will sign a auction contract and deposit a 10% (non-refundable) deposit of the total purchase price. All funds are payable by certified funds or wire transfer. All funds must be received by the auction company on auction day or no later than the following Monday after the auction date. Auction company will contact all out of state winning bidder with routing and escrow instructions. Currency Type: USD
CLOSE OF ESCROW:
The Close of Escrow shall be on or before 30 days from the auction date. The total purchase price is due in full at the close of escrow. Financing (if any) must be completed within the 30 day period. Buyers will receive a deed and insurable title to each property sold at auction, as evidenced by the title insurance policy offered by the closing title company. Current year’s property taxes are pro-rated through day of closing as is customary in the State of Nevada.
BUYER’S PREMIUM:
The sale of each property at Auction will provide that the purchaser pay to the seller as part of the total purchase price a Buyers Premium equal to 10% of the high bid onsite and 11% for online bidders. The buyer’s premium will be added to the high bid to determine the Total Purchase Price.

INSPECTIONS:
It shall be the responsibility of the bidder to completed all their due diligence prior to bidding at the auction event. Bidder’s are encouraged to carefully inspect the property and all available information relating thereto prior to submitting a bid at the auction.
WARRANTY:
All properties at auction are sold in an "AS IS WHERE IS" and with "All Faults" condition. Auction One Las Vegas nor the Seller make any guarantee, warranty, or representation, expressed or implied as to the condition, location, quality, kind, character, size, description, or fitness for any use or purpose of the property, now or hereafter.
AGENCY DISCLOSURE:
Buyer and Buyers Agent hereby acknowledge and agree that Auction One Las Vegas exclusively represent the Seller when conducting all of our Real Estate Auctions. Payment of stated Buyer’s Premium or the purchase of real estate at the auction does not implement any agency relationship with the buyer and Auction One Las Vegas.
DISCLAIMER:
Neither Seller, nor Auctioneer is permitted to bid at the auction. The auction is open to registered bidders and invited guest. In the event of a dispute between bidders, the auctioneer shall make the final decision to accept the final bid, to re-offer and re-sale the property, or to remove the property from the auction. If any disputes should arise during or following the auction event, the auctioneer’s records shall be conclusive. Any property may be withdrawn by Auction One Las Vegas at any time before the actual sale without any liability therefore. If the auctioneer determines that any opening bid is not commensurate with the value of the auction property offered, he may reject the bid. Having acknowledged an opening bid, the auctioneer may decide that any advance thereafter is insufficient, the auctioneer may reject such advance. By bidding at this auction, whether in person or by agent, online, telephone or other means, the buyer shall be deemed to have consented to the exclusive jurisdiction of the State of Nevada and the federal courts sitting in the State of Nevada. All persons entering the property and attending the auction is doing so at their own risk and shall defend, indemnify and hold harmless Seller, Broker, Auction One Las Vegas, Auctioneer, their agents and employees, from any and all liability. Information contained herein is subject to inspection and verification by all parties relying on it. This sale is being conducted subject to the terms of sale and the auction. No liability for its inaccuracy, errors or omissions is assumed by the seller, Auction One Las Vegas or auctioneer. All acreage, square footage and dimensions are approximate. This is not a solicitation or offering to residents of any state or jurisdiction where prohibited by law.
All announcements made Auction Day supersede any prior oral or printed statements. The Seller reserves the right to announce additional Terms and Conditions of the sale prior to or during the course of the Auction.
