1. REGISTRATION: Bids will be accepted only from registered bidders. On-site registration begins at 10:00 AM. Please bring a driver's license for identification. Online bidders may register at Proxibid.com prior to closing of the auction. 2. AUCTION SALE: All personal property will be sold absolute to the high bidder. All bidders should determine the year, model, description and condition of all items and should inspect before bidding. All property is sold "AS IS, WHERE IS." Potential bidders should perform such independent inspection, investigation, inquiries and due diligence with respect to the property as they deem necessary or appropriate. ALL SALES ARE FINAL. 3. ANNOUNCEMENTS: Announcements day of sale take precedence over all prior communications, verbal and written, concerning this sale. 4. BIDDING: The auctioneer will determine all bid increments. All decisions by the auctioneer regarding bid acceptance are final. 5. FINANCING: Your bidding and purchase of personal property is not conditional upon financing. Be sure you have arranged financing, if needed, and are capable of paying cash or cash-equivalent on sale day. 6. BUYER'S PREMIUM: The Buyer's Premium for personal property is ten percent (10%) of the high bid for on-site, bidding. The Buyer’s Premium for online bidders through Proxibid.com is 13% of the high bid. The Buyer's Premium is added to the high bid to determine the gross sale price. 7. PAYMENT FOR PERSONAL PROPERTY: For on-site bidding, all personal property must be paid for in full on the day of the auction by cash, pre-approved personal check or business check made payable to Woltz & Associates, Inc. For online bidders through Proxibid.com, all personal property must be paid for in full on the day of the auction by credit or bank card through Proxibid.com 8. KEYS AND TITLES: Some vehicles do not have titles and that will be disclosed prior to sale. Vehicles with no title will be noted “parts only”. Titles and keys to vehicles and rolling stock will be provided upon receipt of payment by cash, cashier's check or wire transfer into Auction Company's Escrow Account, or for online purchases, confirmation from Proxibid that payment has been made in full by credit or bank card. If a personal or business check is used for payment, titles and keys will not be provided to the bidder until the check has cleared 9. REMOVAL OF PERSONAL PROPERTY: Before removing any items you must show your paid receipt. The Auction Company does not provide equipment or labor for removal of items purchased. No items may be removed from the premises until payment in full is received. Personal property may be removed between 8:00 AM and 5:00 PM on Wednesday and Thursday, December 10 and 11, 2014. Buyers are responsible for removing all personal property in a professional and workman-like manner without causing any damage to the real estate or any other personal property. 10. SALES TAX: Untitled vehicles and personal property shall be subject to Virginia Sales Tax of 5.3% of gross sale price. Wilson “Seller”, any “Registered Bidder”, whether individually or as a principal for any other person or entity, acknowledges and agrees to be bound by the terms and conditions below, in addition to all other terms and conditions of this auction: Registered Bidder acknowledges and agrees that any lot or item sold at the auction bearing anywhere within the description “no title, parts only”, is being sold as parts only and is not a titled motor vehicle and as parts only may not be titled or licensed as a motor vehicle in the state of Virginia. Registered Bidder further acknowledges and agrees that Registered Bidder has been given notice that it is illegal to purchase a motor vehicle in the state of Virginia without a valid title. Registered Bidder fully understands that as a bidder on, or buyer of, any item bearing within the description “no title, parts only”, any such item has been represented by the Seller and Auction Company as parts only and as unable to be titled or licensed and, as such, is not a motor vehicle. Registered Bidder assumes all risks, legal or otherwise, for any and all transactions made at the auction and agrees to hold the Seller and Auction Company harmless for any and all purchases made at the auction.
