We hate it when these things happen, if you would like for us to we can pass your contact info to the owner and the two of you can work out a separate deal for it if they so choose, that is the best we can do for you on this issue** This Auction is being held at the Embassy Suites Hotel in Dallas Texas at 13131 North Central Expressway Dallas Texas 75243, that is Hwy 75 (Central) & Hwy 635 (LBJ). This first part is for the onsite buyers: ***YOU CANNOT TAKE ANY GUN WITH YOU SOLD AT THIS AUCTION FROM THE HOTEL*** This is the process, Two Dogs Auctions is NOT licensed to transfer guns at the hotel, this is not a gun show, the guns will be there to preview starting at 9am and then all day to sell them, and then we take them all back to Two Dogs Auctions business address at 3:30pm or before, if the auctions closes early. You can then travel there (under 10 min away) to pick up your gun if you want to get it that day. We can make arrangements to hold them or ship them or take you to the site and back. This is the Federal Law, and our rule also is that; on black powder or antique we will take them back to our business and they can be picked up there, this is our way of being courteous to the hotel. They did not want people walking around with guns in the lobby as there are families coming through, and we agree. ANNOUNCMENTS: may be made on the day of sale to clarify catalog descriptions or other information specific to a lot or individual property/merchandise item. These announcements take precedence over catalog information pertinent to the property/merchandise but do not alter in any way these basic terms and conditions of sale. 2. REGISTRATION: Online Bidders must be registered buyers with Proxibid. Each registered bidder is solely responsible for the use of his/her bidder number and any use by another person is presumed to be with the consent of and contractually binding on the registered bidder. The bidder warrants that he/she is not under the age of 18 to bid on or purchase anything, and at least 18 to purchase or bid on long guns, and at least 21 years old to bid on or purchase hand guns or ammo only to be used in hand guns. All purchasers are required to fully complete registration, including Full Name, Address, Phone, Email, and Drivers License Number. Those not willing to disclose this information cannot partake in the auction. Please be sure that all information is up to date, especially the contact information of phone numbers and emails. Two Dogs Auctions will not be held responsible for any delays or losses due to false information provided at the time of registration. 3. BUYER'S PREMIUM: Every lot sold by electronic medium by Two Dogs Auctions is subject to an 18.5% buyer's premium, which must be paid by the buyer. Onsite buyers pay 13%. We will always have a 3% discount for cash. 4. LOTS: Accurate descriptions are provided for each individually described item in the auction on a best effort basis. If we do put a guarantee on an item and it is deemed "not" to be authentic by means acceptable with us then, a full refund of the purchase price and buyers premium shall be the limit of liability of the auction company and or its representatives. Returns must be pre-authorized and made within 10 days. All guarantees are void if an item has been tampered with, enhanced, altered, or damaged in any way. All items are "as is and where is" it means "no guarantee of condition working or otherwise", we do our best to evaluate the items and fairly describe them, you need to ask if not sure about an item and if there is some doubt then do not bid. You must place a bid by the lot description and not by photo, if a mistake is made in the catalog (ours, the printers, etc) and photo shows a 1957 Chevy but the description is for a Ford Pick-up then you have bought a Ford. Be sure to ask and be clear before making a bid. This also holds true at the live auction when using overhead projectors. The placing of a bid will be taken as full agreement to all terms & conditions. 5. BIDDING: All persons bidding in electronic format are responsible for reading, understanding and complying with the terms of sale as specified herein and agree to be bound thereby. Upon registering or making a bid to the auctioneer, buyers agree and accept the following terms and conditions. If you do not accept these terms and conditions, do not bid. All registered bidders at our auctions are entitled to make a bid, it may be the auctioneer or some of the auction staff, the owner or their representative, or someone on the auction staff making a bid by phone or pre-bid for someone, any registered bidder may bid on any item. Absentee Bidding (called pre-bidding) is used by those who cannot attend our auction due to scheduling differences or their location. Absentee bids may be left via our website, or at our store location. Absentee bidders agree to all terms and conditions. If however I determine any illegal bidding taking place by anyone I will not allow that to continue. Practices that eliminate competition, such as collusive bidding, fictitious bidding, Pooling or conspiring to make a bid by acting as a "capper", "booster", or "shiller" may result in criminal penalties pursuant to the Sherman Anti Trust Act. The auctioneer reserves the right to bid on behalf of clients and vendors, but shall not be liable for errors or omissions in executing instructions to bid. The auctioneer act as agent only, and shall not be liable for any default of the purchaser or vendor. 7. TIE BIDS: If any dispute arises between two or more bidders, the auctioneer may decide the same, or may immediately put the lot up for sale again, and resell to the highest bidder. The decision of the auctioneer shall be final and absolute. 8. WITHDRAWL OF ITEMS: From time to time, it may become necessary to withdraw items from a sale after they are listed. Two Dogs Auctions realizes this is an inconvenience and will not take this course of action lightly. However, we do reserve the right to remove items from the auction in the event the need arises. BY BIDDING, YOU ARE ENTERING A LEGAL AGREEMENT WITH TWO DOGS AUCTIONS AND HAVE ACCEPTED ALL THE TERMS AND CONDITIONS. Any firearm sold by us we fully expect and indeed warn the buyers that it needs to be checked out by a qualified gunsmith before you can expect to safely shoot it. IF YOU BID AND WIN A GUN THEN YOU OWN IT- BUT IF YOU FAIL THE BACKGROUND CHECK THAT MEANS YOU HAVE AUTOMATICALLY CONSIGNED IT TO US TO SELL AGAIN IN A SHORT TIME FRAME THEN WE WILL REFUND TO YOU THE SELLING PRICE LESS EXPENSES. ONLINE BIDDERS NEED TO BE AWARE OF LOCAL AND STATE LAWS, BE SURE YOU CAN OWN IT BEFORE YOU BID, IF I SHIP IT TO AN FFL HOLDER AND YOU CANNOT PASS THE CHECK OR OWN IT, WE WILL TRY TO WORK WITH THE FFL HOLDER AND YOU BUT MAY NOT BE ABLE TO HELP OR REFUND. 9. SALES TAX: Texas Residents (only) are required to pay an 8.25% Sales tax on all items purchased unless a current copy of your Texas Sales Tax ID is provided. 10. PAYMENT: All absentee bidders are required to pay within 10 days of winning bid. If payment has not been received, the auction house has the right to deem the sale "null & void" and keep the item is so inclined the bid you placed is a legal contract that we may also ask to be paid. Payment may be made by post office money order, or check (it has to clear first). We also accept credit cards MC, VISA, AMEX, DISCOVER and Paypal as well with prior approval on checks and Paypal. The full purchase price on all lots sold to the same buyer must be paid before removal of any of the items. Your credit card used upon registration for this auction will be charged as your (non-gun) item(s) are shipped. A valid FFL needs to be received for firearms sales after the conclusion of the auction, your credit card will be charged for the purchase price and a second charge will be made for the shipping costs when the FFL is received. All invoices must be paid before items are removed or shipped from the sale premises. All federal, state and local regulations apply to firearms sales and transfers. Items must be picked up no later than 10 days after the auction or storage charges will apply starting at $10 a day. No refunds will be issued for failure to arrange shipping or misjudgment of shipping costs. 11. SHIPPING AND PICKUP: Postage, packing, freight and insurance costs are paid by the purchaser before shipping the item. Two Dogs Auctions takes no responsibility for lost or damaged items received through post. Oversized items are the responsibility of the buyer. All buyers are strongly encouraged to get quotes from shipping companies and make arrangements prior to bidding. 30 days after the auction Two Dogs Auctions will consider the item abandoned and may take possession of it, we may restock it and charge a 25% fee.
