Payment

All payments and deposit must be in the form of CASH, Certified Cashier Checks (allow time for bank verification of authenticity), and wire transfers. Wire transfers are charged a $25 bank fee. All payments of purchases must be made in full by 4PM the 2nd business weekday following the conclusion of the auction event. BUYER DEFAULT -- Any buyer with a balance not paid, including any wire transfer fee, after 4PM the 2nd business day following the Auction event will be in Default. Any Default buyer will forfeit any payments already made, and all claims to any items listed on their account, regardless of payments applied. Ultimate Auctioneers will NOT allow any Default Buyer to register or participate in future Ultimate Auctioneers Public Auction Event.

Terms Of Sale

Henceforth the term Auctioneer shall mean ULTIMATE AUCTIONEERS and any owners/employees, and the term Participant shall mean any BIDDER, CONSIGNOR OR SPECTATOR. 1) By their presence and/or participation, all sellers, buyers, and spectators agree to the following. No one under 16 years of age allowed. 2) ONLINE Bidders and PHONE Bidders are held to the same terms and conditions as on site bidders. There may be additional requirements and terms applied to OFFSITE bidders. SEE OFFSITE BIDDING BELOW 3) All items are sold AS-IS. There are no warranties or guarantees offered nor implied. 3A) Ultimate Auctioneers DOES NOT AUTHENTICATE NOR EVALUATE items. It is the SOLE RESPONSIBILITY of any buyer of any item to perform any due diligence prior to offering any bids. Special attention is suggested regarding fine artwork, jewelry, gems, autographed items, antiques, mechanical items including vehicle, or any other item subject to authenticity being used as a basis of value. No refunds or returns will be allowed due to lack of authenticity or mechanical condition. 4) All sales are final. No bid may be rescinded for any reason. A bid is a legally binding offer to purchase the item. 5) All bidders must provide a CASH deposit to obtain a bidders number. This deposit will be applied to the purchases assigned to that bidder number. Any deposit amount in excess of all purchases will be immediately returned to the bidder upon the return of the bidder number to the cashier. Bidders should verify the required deposit amount for each 5A) BIDDER FEE: All On-site bidders will pay a buyers/bidders fee equal to 10% of accepted bid amount. All Internet bidders will pay a buyers/bidder fee equal to 15% of the accepted bid amount. 6) All purchases must be paid in full on the date of the auction. No items will be removed until paid in full. Forms of acceptable payment are CASH, CASHIERS CHECK FROM LOCAL BANK, AND WIRE TRANSFERS. (a $25 wire transfer acceptance fee will be added to the buyers invoice) No personal or business checks, credit cards or debit cards are accepted. 6A) AUCTIONS ON SUNDAYS: Due to banks closed on Sundays, buyers may increase the deposit to a at least 25% of the total purchase amount before leaving the facility. Any balance MUST BE PAID IN FULL BY 5PM the 1st business day following the auction date. ALL PURCHASES MUST REMAIN AT AUCTION FACILITY UNTIL ALL ITEMS ARE PAID IN FULL. Any buyer with a balance due at 5PM of the 1st business day following the auction date will be in default, and will forfeit all deposits as a default penalty. Additionally, all purchases may be resold at a later auction with NO RETURN of any funds to original buyer. Any bidder who defaults on a purchase will Not Be Allowed To Participate In Any Future Ultimate Auctioneers Event. 7) Sales Tax is collected on all items purchased. Nevada law requires sale tax collection on all buyers fees. Exemptions are offered to resale customers who provide a copy of their current resale certificate, and complete a Nevada resale purchase affidavit. NO EXEMPTIONS ALLOWED WITHOUT PROPER DOCUMENTATION. 8) A $150 TITLE FEE will be paid by all buyers of each PRIVATELY CONSIGNED titled item (cars, trucks, boats, etc). A licensed Nevada Auto Dealer will provide proper transfer of all titled items. Nevada Temporary Plates are provided to Nevada residents. NO OPEN TITLES ARE ALLOWED. 9) BANKRUPTCY COURT VEHICLES are exempt of the $150 Title Prep fee. NO DRS or temporary drive license is provided is provided. Buyer assumes all responsibility of all smog/inspection/transfer/title and all other fees associated with the purchase and transfer of the vehicle. Sales tax is collected from the buyer in addition to any buyers fees. 10) TITLED SALES ... All vehicles may be subject to sale prior to auction date and/or a reserved selling price. All buyers will pay a $150 title fee except for City Owned, or Court Ordered asset sales. All SALES ARE FINAL ....... All Sales Are AS-IS 10A) AUTO DEALER EXEMPTIONS: Any licensed auto dealer will be exempt of Nevada DRS fees and sales tax. The $150 Title Fee will remain in force. Any auto dealer must provide at the time of registration for the auction, a copy of their CURRENT auto dealers license, a copy of their CURRENT sales tax certificate, and complete a sales tax exemption affidavit. NO EXEMPTIONS ALLOWED WITHOUT PROPER DOCUMENTATION. DEALERS PAY A $150 Title fee. 11) OUT OF STATE TITLED ITEM BUYERS: Out of state buyers must provide out of state ID, and register at the auction with an out of state address. Out of state titled item buyers are exempt from Nevada DRS fees and sales tax. The $150 Title Fee will remains in force. A Affidavit of Purchase By An Out Of State Buyer must be completed. NO EXEMPTIONS WILL BE ALLOWED WITHOUT PROPER DOCUMENTATION. Only titled items are exempt of sales tax. 12) Required Motor Vehicle Insurance: It is the sole responsibility of all buyers to adhere to Nevada State laws regarding minimum insurance requirements. There is NO INSURANCE COVERAGE on any item provided by the Auctioneer, nor the consignor. 13) All items purchased, after payment in full, should be removed from the Auctioneers facility on auction day. No security is provided regarding any item left in the facility. Buyer assumes all responsibility of lost or stolen items. All items MUST BE REMOVED BY 5PM the 1st business day following the auction date. Any item left after the 5PM deadline will be considered abandoned and the auctioneer will resell the items with NO RETURN of any funds to the original buyer. 14) All participants agree to hold the auctioneer, the landlord, all consignors, other participants and other tenants in the complex harmless of any and all loss, damage or injury of any kind. This includes theft. It is the participants responsibility to pay for and secure any item(s) they bid on. 15) The auctioneer reserves the right to: Declare the highest acceptable bidder Bid on behalf of absentee bidders or the auctioneer himself Settle all disputes of bids Reopen any item for bid to any person(s) the auctioneer feels was neglected by the auctioneer or staff Change the order of items being sold Set the bid increments Remove any person(s) the auctioneer feels is disruptive to the auction process 16) All statements or descriptions of any item are provided by the consignor. The auctioneer is not responsible for errors or omissions in any descriptions. Information is believed to be accurate, however the bidder is responsible to verify all material facts prior to offering any bid on any item. No Bids May Be Rescinded. 17) AUCTIONEER DOES NOT PACK OR SHIP. It is the buyers responsibility to arrange for any packing/crating and shipment arrangement at Buyers cost. 18) Any statement, correction, Term or Condition made by the acting auctioneer supersedes any and all information in any format. FIREARMS SALES: 1) Bidders must be at least 21 years of age, and a permanent resident of Nevada 2) All transfers will be facilitated by a licensed gun dealer, at the sole discretion of the Auctioneer. 3) A $25 background check fee will be collected from the buyers. This fee will be provided to the transferring dealer by the Auctioneer on the buyers behalf. In the event the buyer DOES NOT receive a positive report, the sale will be cancelled, and the buyer will forfeit the background check, transfer and a 25% default fee. The balance of the amount paid will be returned to the buyer. 4) The buyer will pay a transfer fee in the amount of $25 per firearm. The Auctioneer will provide this fee to the transferring dealer on behalf of the buyer. 5) ALL FIREARMS will be required to be transferred as described, regardless of exemptions of Federal and or State laws. 6) ONLY PERMANENT NEVADA RESIDENTS are allowed to purchase firearms from Auctioneer. NO EXCEPTIONS. 7) Auctioneer makes no statements regarding condition or safety of any firearm. It is the SOLE RESPONSIBILITY OF BUYER to have all firearms checked by a professional gunsmith BEFORE firing the weapon. 8) Oral conditions or statements made by the prevailing Auctioneer at the auction event, supersedes all written, printed, published, advertised, or any other type of statements. * * * OFFSITE BIDDING * * * 1) OFFSITE bidding is not offered on all auction events. Always check the auction listing page for information. 2) Prospective OFFSITE bidders must register for approval. Ultimate Auctioneers reserves sole right to set any qualifications of bidders. All bidders will be teated as equals in the qualification process. Ultimate Auctioneers reserves the right to decline any request for a bidders number based on those qualifications. 3) FIREARM SALES: Same terms apply to Nevada residents as stated above. OUT OF STATE BUYERS must adhere to resident state laws regarding ownership. ALL firearms are sent to a Licensed FFL Dealer Only. Buyer must provide dealer contact information for proper license verification. Buyer to arrange all transfer & costs with the receiving dealer. Buyer to pay ALL packing and shipping fees prior to shipping. Buyer responsible for shipping back to Auctioneer in the event dealer can not transfer. Upon receipt of returned firearm due to buyer inability to receive from dealer, Auctioneer will sell the firearm(s) at the next public auction and be compensated a sales fee equal to 40% of the gross selling price. 4) All OFFSITE purchases MUST BE PAID IN FULL by 4PM the 1st business week day following the conclusion of the auction. No item will be removed until paid in full, inclusive of all fees and taxes. Acceptable forms of payment are...CASH, Certified Cashiers Check (will require verification of authenticity from our bank), Wire Transfer. NO Personal/Business checks are accepted. NO credit or debit cards are accepted. * * * Online bidders will pay an On-Line Bidders fee in addition to the standard on-site buyers fee * * * Check Each Auction For Proper On-Line Bidders Fee 5) All OFFSITE purchases MUST BE REMOVED from the auction site within 3 business week days of the auction event. OFFSITE bidders are responsible to arrange any and all crating, packing and/or shipping of any item purchased. Ultimate Auctioneers will make every effort to assist the shipper. A fork lift is available to assist load out. Ultimate Auctioneers will assist in locating a local packer and or shipper, at the bidders cost. Any agreement is solely between any packer/shipper and the bidder. The bidder will pay any packer/shipper directly. 6) DEFAULT: Any default of any term by any OFFSITE bidder will result in the forfeiture of the items purchased by the bidder, the forfeiture of the bidders deposit, and removal of the bidder from any future Ultimate Auctioneers event. The deposit will be retained by Ultimate Auctioneers a forfeiture penalty cost of the bidder. The items will return to the consignor as lien free property. The bidder agrees by their participation and or presence, to hold Ultimate Auctioneers harmless of any claims of damage. 7) AUCTIONEER DOES NOT PACK OR SHIP. It is the buyers responsibility to arrange for any packing/crating and shipment arrangement at Buyers cost. 8) Ultimate Auctioneers reserves the right to cancel, modify, amend, or change any term and/or auction prior to the start of any auction. Any statements announced by the presiding auctioneer will supersede any advertised, printed, verbal or marketed statements, terms or conditions.
