Minerals
All mineral interests owned by the seller, if any, will be conveyed to the buyer(s).
Real Estate Taxes
Real estate taxes for 2014 payable in 2015 will be paid by
the seller. All future taxes will be the responsibility of the
buyer(s)
Conditions
This sale is subject to all easements, covenants, leases, and
restrictions of record. Each bidder is responsible for conducting, at their own risk, their own inspections, inquiries, and
due diligence concerning the property. All property is sold
on an “As Is – Where Is” basis with no warranties or guarantees, expressed or implied, made by the auctioneer or seller.Possession
Possession will be granted at closing on or before January 5,
2015, subject to current leases.
Earnest Money
A 15% earnest money payment is required on the day of the
auction. The earnest payment may be paid in the form of
cash or check. All funds will be held by Avery L Gurnsey in
their trust account.
Sales Contract and Title
Immediately upon conclusion of the auction, the high
bidder(s) will enter into a real estate sale contract and deposit with Farmers National Company the required earnest
payment. The seller will provide an owner’s policy of title
insurance in the amount of the purchase price. The cost of
such title insurance and any escrow closing services will be
shared equally by the seller and buyer. Sale is not contingent
upon buyer financing.
Closing
The projected closing date is on or before January 5, 2015.
The balance of the purchase price will be payable at closing
in cash, a guaranteed check, or by wire transfer.
Buyer’s Premium
A 3% Buyer’s Premium will be added to the final bid price
and included in the total real estate contract price that is due
and payable from the buyer(s).
Sale Method
The real estate will be offered in five individual tracts for bidding.
All bids are open for advancement until the Auctioneer
announces that the real estate is sold or that the bidding is
closed. Bidding increments are solely at the discretion of the
Auctioneer. No absentee or telephone bids will be accepted
without prior approval of the Seller and Farmers National
Company. All decisions of the Auctioneer are final.
