Manners of Sale: This property is being offered in seven (7) tracts totaling
approximately 2,000 acres and sold in “As-Is” condition. Auction procedure
and increments of bidding are at the discretion of the auction company.
Terms: Auctioneer-Broker shall require 15% irrevocable earnest money from
the successful bidder on auction day with the balance in full due upon closing.
Personal and Corporate checks are acceptable for the down payment with the
final payment to be made in certified funds. All funds will be held at Lyon
County Title. Bidding is NOT contingent upon financing. If financing is
necessary, it needs to be arrange prior to the auction. Announcements made
at the sale on the day of the sale take precedence over printed material and
previously made oral statements.
Legal Descriptions: Ask for legals from broker.
Mineral Rights: 100% of the seller’s mineral rights will pass to the buyer.
Crops and Crop Insurance: No 2014 crops to buyer. Possession of crop land
on November 1st, 2014.
Title Insurance: Seller shall provide Warranty Deed, properly executed, and
will furnish a title insurance policy showing marketable title. Property sold
subject to any easements, restrictions, rights of way, covenants or reservations
of record.
Real Estate Taxes: Taxes will be prorated by closing date.
Acceptance of Bids: A successful bidder will be required to enter into a Kansas
Real Estate purchase contract immediately following the auction. Copies of the
contracts will be available from the auction company prior to the sale.
Acreages: Acreage figures are from the FSA Offices. FSA figures, crop yields
and information are subject to change. FSA Acres may not be the same as
deeded acres.
Inspections: All potential bidders are responsible for conducting their own
independent inspections and due diligence concerning pertinent facts about
the property. Neither Seller, or Hayden Outdoors, LLC, their agents or
representatives, are making any warranties about the property, either expressed
or implied.
Closing: Date of closing will be on or before October 1, 2014.
Possession: Possession will occur on November 1, 2014.
