CONDITIONS OF SALE
The property described in the exhibition catalog will be offered and sold by MONA as the agent for the"Consignor" according to the following terms and conditions:
1. All sales are final, and there will be no exchange or refunds. All property is sold "as is" and neither the Museum of Nebraska Art nor the Consignor makes any warranties or representations of any kind nature with respect to the property.
2. MONA reserves the right to withdraw any property at any time before the actual sale.
3. MONA reserves the right to reject a bid from any bidder. The highest bidder acknowledged by the auctioneeer shall be the purchaser. In the event of any dispute betwen bidders, the auctioneer shall have sole and final descretion either to determine the successful bidder or to re-offer and resell the article of dispute. If any dispute arises after the sale, the Museum of Nebraska Art's sale record shall be conclusive in all respects.
4. All property shall be removed from the posession of the Museum of Nebraska Art no later than Sunday, March 28, 2004, 12:00 noon with proof of payment. Should the purchaser wish to ship the property, it is at his/her own risk. Buyer will be responsible for paying actual shipping and handling costs.
5. Unless the sale is advertised and announced as a sale without reserve, each item is offered subject to reserve. The Consignor may bid upon his/her property, as well as upon any other property listed in this catalog or designated for sale in the exhibition checklist.
