ATTN ONLINE BIDDERS: A 6% BUYERS PREMIUM FOR ALL PERSONAL PROPERTY PURCHASED ONLINE! All personal property must be settled for immediately following auction. No property may be removed from site until settled for. Unless auctioneer gives prior approval, all purchases must be paid in full by the successful bidder on the day of auction with NO EXCEPTION. Payment shall be in the form certified or cashiers check. The auctioneer may accept a personal or company check with acceptable identification (ie. bank letter of credit, drivers license), but is under no obligation to accept that form of payment.
All firearms requiring shipment will be shipped from a federal firearms licensed (FFL)dealer to a FFL dealer, with shipping costs and a $25 handling fee paid by buyer. All firearm purchases shall be subject to a background check, and the paperwork shall be completed by the new buyer through the FFL dealer recieving shipment.
Please bring your gun permit, Nebraska firearm permit or FFL if you plan on personally attending the auction.
The buyer is solely responsible for any and all shipping costs, shipping arrangements, and insurance if so desired. All items that need to be boxed up or crated for shipment will be charged an additional $25 handling fee.
Arrangements to pickup all other personal property including vehicles, tractors, or misc. pieces shall be made by contacting the auctioneer, Col. Duane Wellensiek at 402.864.7651.

Registration:
To participate in the auction you will need bank letter of guarantee from the registrant's bank. The bank letter of guarantee must be made out to Wellensiek Auction Co. and will become the property of Wellensiek Auction Co. Letters may be faxed to 1.402.505.7981 and must be received 12 hours in advance of auction start time. After review of the letter, you will be accepted or declined.
Condition of Property:
All property is sold “AS IS”, WHERE IS" and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Wellensiek Auction Co. may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Wellensiek Auction Co. be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Absolutely NO refunds.
All sales are final when awarded to the successful bidder. Buyer accepts full responsibility for all purchases made and holds the auction company, clerks and owners free of any liabilities in the event of theft or disappearance of any items purchased. No items are to be removed from premises without full settlement. In the event of a dispute in bidding, the auctioneer’s decision to settle the dispute is final. (N.R.F.A.) Not responsible for accidents, all verbal statements made the day of auction supersede any printed material or any previous announcements. List is subject to change Possession of titles to buyers will take approximately 2 weeks.
Bidding Process:
Only registered bidders with assigned numbers will be allowed to participate in the auction. The auctioneer has the complete discretion to set the minimum bid and to regulate the advance of those bids. Accordingly, he may reject any bid that, in the auctioneer’s sole discretion, is not reasonably larger than the previous bid. Auctioneer may also reject the bid of any person, for any reason. The auctioneer has the right to refuse all bids made on an item, regardless of whether they are in excess of the minimum. In some events, the owner of an item consigned for sale to the auctioneer may have established a minimum acceptable sale amount. The auctioneer has no duty to inform any bidder as to that minimum price and auctioneer may bid for such owner without any disclosure whatsoever being required. In the event any confusion in the bidding process arises, the auctioneer in his sole discretion may establish a procedure to resolve that confusion. Each bid carries with it an obligation to pay any applicable sales, use, excise or transfer tax in addition to the bid amount. An item is deemed sold to a bidder only when announced as sold by the auctioneer. The auctioneer may by oral announcement alter any bid lot prior to the start of bidding. No adjustments to a winning bid will be made because of later discovered defects, latent or otherwise, in the item purchased. Auctioneer may cancel the auction at any time, for any reason, with no liability to the bidder.
Winning Bidders:
By bidding on any item, the bidder shows acceptance of the terms of the auction. No property may be removed from site until settled for. It is the bidder’s sole obligation to protect the property after that time. In the event the property is left at the auction site after the conclusion of the auction, auctioneer has absolutely no obligation to secure the property and only has the obligation to grant access to the auction site for bidder’s removal of the item.

Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Wellensiek Auction Co. LLC or anyone else if the Internet service fails to work correctly before or during the live auction. Wellensiek Auction Co. LLC will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Wellensiek Auction Co.
