TERMS & CONDITIONS of SALE
1. BIDDER REGISTRATION:
The auction is open to the public and all bidders must register for this auction on the Proxibid website.
2. PREVIEWS:
• The assets included in this Timed Bid Auction consists of five Classic Automobiles.
• Because of the current conditions brought about by the Corona Virus, pre-auction previews are not available.
• Specific questions can be addressed to George Richards at National Auction Company by e-mail or cell phone.
• All of the automobiles are being offered in As-Is condition and without warranty of any kind.
3. AUCTION DATE:
• This auction will be conducted as a Timed On-Line Auction and bids will be received at Proxibid.com. The auction will open at 10:00 A.M., October 26, 2020 and will end on November 6, 2020 beginning at 3:00 P.M. The auction web site will make use of staggered closing times but all bids will end on November 6, 2020. All bids will be reported to representatives of The Estate of Richard Winer. Representatives of The Estate of Richard Winer will be notified of the top bid price and next highest bid. Bids received after published closing times will not be accepted except those that fall under the conditions of Extensions of Bid described in the following bullet.
• Extensions of Bid: In the event a bid or bids are made during the last two minutes of an auction, the end time for the auction will be extended for an additional two minutes. Extensions will continue until no further bids are received within the last two minutes of the auction.
• The five Classic Automobiles included in this Time-Bid Auction will be offered and sold Subject to the Confirmation of the Seller, The Estate of Richard Winer. In the event top bid prices are not confirmed by representatives of The Estate of Richard Winer, the classic automobiles may be withdrawn. It is expected Top Bidders will be notified their bid has her been accepted or rejected within 48 hours from the time the auction closes.
• The Auctioneer reserves the right to establish minimum amounts for bid increases. In the event bidders do not comply with minimum amounts stated, bids received that are less than those set forth will not be accepted.
4. DEPOSITS & FINAL PAYMENT:
• A deposit equal to 10% of the full purchase price must be made at the conclusion of the auction. The deposit can be in the form of Cash, Cashier's Checks or Money Orders. Corporate checks will be accepted when accompanied by a current Bank Letter (made specifically for this auction and addressed to National Auction Company) guaranteeing payment and subject to verification at the time of Bidder's registration.
• The balance due less any deposit will be due 48 hours after notification the top bid price has been confirmed by the United States District Court, Southern District of Florida. Final payment must be in the form of Cash, Cashier's Check or Money Order only. Bank to bank wire transfers will also be accepted.
5. FLORIDA SALES TAX:
• All sales are subject to rules of the Florida Department of Revenue.
• Automobile dealers who are registering as bidders are asked to supply a copy of their Motor Vehicle License and Resale Certificate to the auction which must be presented at the time of Bidder registration.
• Florida Sales Tax for motor vehicles is payable at the time of vehicle registration and the Motor Vehicle Title is transferred.
6. FORM of AUCTION:
• This auction is conducted on behalf of The Estate of Richard Winer.
• All top bid prices/bids are subject to the confirmation of the authorized Representatives of The Estate of Richard Winer.
7. BUYER'S PREMIUM:
A 10% Buyer’s Premium will be added to all top bid prices and included in the final purchase price. auction.
8. METHOD of SALE:
• This auction will be conducted as a Timed Event with opening and closing times and dates as set forth in the Terms & Conditions of Sale.
• The terms and conditions of sale may be changed by announcement and published on the Auctioneer’s website. Any such announcement will take priority over previously printed materials or oral statements
• Bids will only be accepted from bidders who have registered with the Auctioneer.
• In the event of disputes between bidders or tie bids, the Auctioneer's decision will be final.
• All information provided through this website is believed to be correct but is not guaranteed. Bidders must rely upon their own information and judgment.
• In the event a Top Bidder fails to make final payment, any deposit given will be subject to forfeiture.
9. CERTIFICATES OF TITLE:
• Certificates of Title are available for all but one of the vehicles included in this auction. It is expected Certificates of Title will be provided to Purchasers at the time final payments are made. Every effort will be made to obtain a title for the 1940 Cadillac but in the event none can be provided, a Bill of Sale will be delivered to the successful Purchaser.
10. REMOVAL:
• All purchases must be removed from the premises as soon as possible following approval of sales by Representatives of the Estate of Richard Winer. Arrangements for removal of vehicles are to be scheduled through George Richards of National Auction Company.
• All five Classic Automobiles are located in Fort Lauderdale, Florida.
• The Purchaser is responsible for advising National Auction Company, in writing who is authorized to remove the vehicle(s) from storage. If the vehicle is to be removed by contracted transporters or tow trucks, written authorization for removal must be provided to the Auctioneer.
• Purchasers should be aware these vehicles have been in storage for five years. It is the responsibility of the Purchaser (s) to move and transport the automobiles from storage.
