All persons bidding or otherwise attending auction (“Bidders”) acknowledge the following Terms and Conditions and agree to be bound by them.Throughout these Terms and Conditions, the terms “Auctioneer,” “we,” “us,” and “our” will refer to the Auctioneer and its Associates, and the terms “you” and “your” will refer to the Bidder.

SALE DAY BIDDING BEGINS: Saturday, Sept. 7, 2024 at 9:00am ET
Onsite bidder registration begins auction day at 8:00am ET.
Please note that bidders must present government-issued photo identification when registering to bid in person.
Online bidders may leave pre-bids and/or participate in real-time.

All bidders must register prior to placing bids.
Bids may be placed online and will be represented at the Live Auction.
You are encouraged to use the Max Bid feature which represents your high bid.
Absentee and Live Telephone bids are available.

BID SUBMITTAL:
Lucky L is not responsible for a bidder’s inability to place any bid, by internet, phone, absentee or otherwise for any auction/sale for any reason.
In the event of technology issues with Internet sales, the Auctioneer reserves the right to reopen or extend Internet bidding as it deems necessary and appropriate.
In the event a bidder loses internet connection, immediately call the Berger Truck Sales Office (434-429-7263) for assistance.
BUYER’S PREMIUM: A 10% Buyer’s Premium for on-site bidders and 13% for all online bidders will be charged for each lot purchased in addition to any applicable sales tax.
APPLYING FOR TAX-EXEMPT STATUS: All taxable items are subject to a 6.3% Sales Tax Some bidders may be exempt from payment of applicable taxes. If you wish to apply for tax-exempt status, you must submit a completed copy of your tax-exempt certificate prior to this auction’s closing. Please note that you must declare that you are tax exempt when registering for the auction. If you do not follow the procedures discussed in this paragraph, the Auctioneer will be unable to consider identifying you as exempt from taxation, and you will have to apply directly to the applicable state for a refund. Please also note that, depending on the state whose sales tax applies, submission of the Auctioneer’s tax exempt form may not be sufficient to entitle you to tax-exempt status. Please review the form and its contents carefully, and contact the Auctioneer with any questions you may have.
PAYMENT TERMS: PAYMENT IN FULL IS DUE BY 4:00PM ET ON TUESDAY, SEPTEMBER 10th, 2024.

A 3% (Visa, Mastercard, Discover) or 4% (AMEX) processing fee will be added to credit card purchases.
Lucky L reserves the right to disqualify any bidder whose credit card is denied for any fee charged during the auction.
In the event a bidder is disqualified due to an inability to collect the appropriate fee, immediately call the office (434-429-7263) to take the steps necessary to reinstate their ability to participate.
A $50.00 per day Late Payment Fee will be charged on any outstanding balance unless acceptable arrangements are made with Lucky L.
NO EXCEPTIONS WILL BE MADE TO THESE PAYMENT TERMS.

For all Domestic and International Wire Transfers, please confirm with your banking institution any transaction fees that may need to be allowed for and confirm that the correct amount is being wired. All wire fees are the sole responsibility of the Buyer.
No Direct Deposits in person at the Bank to our account will be accepted.
No items will be released until receipt of wire transfer has been verified.
FINANCING: Financing is the Sole responsibility of the Buyer!

REMOVAL:
NO REMOVAL UNTIL THE CONCLUSION OF THE AUCTION!
Removal BEGINS SUNDAY Sept. 8th, 8am -4pm
Monday through Friday 8:00am to 5:00pm ET.
Removal Deadline is Thursday, Sept. 19th by 4:00pm ET.
ALL ITEMS MUST BE PAID IN FULL BEFORE REMOVAL OF ANY ITEM WILL BE ALLOWED.
Loadout:
Is the responsibility of the purchaser.
Lucky L's and Berger's personnel will direct you to the location of your item(s), and, at their discretion load items. (Loadout fees may apply)
Lucky L's and Berger's personnel will not push, pull, or drive equipment or trucks onto trailers, stack trailers, or load large items.
Storage Fee: Any item remaining after the Removal Deadline, a $10 per day, per item fee will be charged to the buyer until the item is removed. Anything remaining 60 (sixty) days after the Removal Deadline will be considered abandoned and Lucky L may take possession of the asset(s). UNLESS PRIOR ARRANGMENTS ARE MADE!
TITLES:
Titles will not be released until all payments have been received.
We do not guarantee mileage accuracy, we list the odometer reading!
We are not responsible for any mileage discrepancies!
PHOTOGRAPHS AND DESCRIPTIONS:
The Auction Managers regularly post item descriptions and photographs to aid bidders in the bidding process, and will make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. However it is the Buyers responsibility to fully inspect and determine the condition, age, and any details pertaining to items prior to bidding! Lucky L and its associates will make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. In some photographs, multiple items may appear to be joined as a single unit, however you should not assume that a lot consists of more than one item simply because various items appear connected or are featured in the same photograph. Also understand that, on occasion, the wrong photograph may be displayed for a given item. At all times, you are bidding on items as they are described, not as they appear in any photograph. THE AUCTIONEER FURTHER DISCLAIMS ANY RESPONSIBILITY FOR LIENS OR ENCUMBRANCES THAT MAY ATTACH TO OR BE ASSOCIATED WITH ANY LOTS OR ITEMS. ANY SUCH LIENS AND ENCUMBRANCES ARE THE RESPONSIBILITY OF THE BIDDER TO INVESTIGATE.
