Due to the recent Internet Sales Tax Regulation now requiring Internet Sales to be sales taxed, sales tax WILL APPLY to ALL Georgia onsite & ONLINE invoices except for those with legitimate Georgia Sales Tax Exemption Status. Be prepared to provide current copy of your Georgia Sales Tax Exemption information and number.
ONLINE Out-of-State (invoices with out-of-state addresses) purchases will not be sales taxed; the Buyer will be solely responsible to remit sale/use taxes to their jurisdiction according to their State's laws.
CREDIT CARD CHARGEBACK WAIVER: By accepting the terms of the Auction Company, the Purchaser paying by credit card has hereby waived their right to any and all credit card recourse, chargebacks, or refund terms and accepts the terms of the Auction Company.

All property is sold "AS IS - WHERE IS". ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinate factor. Williamson Bros. Realty & Auction Co., Inc. may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Williamson Bros. Realty & Auction Co., Inc. and/or Seller be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.
Bidders who bid from off site and are not present at the live Auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinate factor. Williamson Bros. Realty & Auction Co., Inc. shall endeavor to describe in detail each item and any pertinent information about it. Williamson Bros. Realty & Auction Co., Inc. will not be responsible for any errors or omissions in the description of the merchandise. Bidder acknowledges and understands that this service may or may not function correctly the day of the Auction. Under no circumstances shall Bidder have any kind of claim against Williamson Bros. Realty & Auction Co., Inc. or anyone else if the internet service fails to work correctly before or during the live auction. Williamson Bros. Realty & Auction Co., Inc. will not be responsible for any missed bids from any source. Internet/online Bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the Auction begins. Williamson Bros. Realty & Auction Co., Inc. reserves the right to withdraw or re-catalog items in this Auction.
Firearms Additional Terms & Conditions: All guns sold at the August 11, 2018 Auction with paid invoices will be available for pickup at Sporting Arms, Inc., 159 Parkview Road, Winterville Ga 30683, 706-742-7971, beginning at 2pm Saturday, August 11, 2018. Business hours are 10am till 7pm, Monday-Saturday. Any gun not picked up within 14 days of Auction date will be considered abandoned and will revert back to the Seller, with no refund to the Buyer. You must pay for your gun purchases in full at the end of the Auction. Internet/Online Bidders will be contacted shortly after the Auction is concluded. Upon payment, you will receive a PAID INVOICE to claim your gun(s) at Sporting Arms, Inc. At time of pickup, the Buyer will be required to complete the necessary transfer paperwork and pay a fee of $10 per gun to Sporting Arms, Inc. for their services. Only the person whose name is on the PAID INVOICE will be allowed to pick up a gun(s). NO EXCEPTIONS. Internet/Online Bidders who wish to have their guns shipped, will be responsible for contacting Sporting Arms to provide shipping address of a FFL License Holder. Sporting Arms will quote and collect all shipping and transfer fees from Buyer. Sporting Arms reserves the right to deny shipping to anyone who does not meet the letter of the law regarding all local, state and federal laws pertaining to gun transfers, background checks, etc.
Additional Terms and Conditions in regarding wildlife artifacts: All wildlife artifacts are presumed to be harvested and imported into the US legally. It is the duty of the Buyer to contact the appropriate authorities to determine if there are any legal issues concerning the legality of the Buyer's rights to purchase, possess, or sale of wildlife items. Seller, Auction Company and its employees assume no liability for Buyer's purchases and/or possession that may be prohibited. Buyer agrees to pay any and all legal fees and fines incurred by Seller, Auction Company and its employees arising from transfer of ownership.
RISK OF LOSS: The Auctioneer and Seller(s) are not responsible for any lost, damaged or stolen property, of any kind, regardless of circumstance. The Buyer assumes delivery, full responsibility and accepts all risk of loss for any property purchased from the time the Auctioneer accepts the Buyer's bid regardless of the check out or closing process.
THEFT: The theft of any property should be reported to the local police. It is the right of all auction Buyers to prosecute anyone caught stealing to the fullest extent of the law.
CHECKOUT & REMOVAL: The Buyer has no right of abandonment whatsoever. The Buyer agrees to remove all purchased property within the guidelines & times announced or posted. Property not removed within the time specified will be resold or disposed of by the Auctioneer or Seller without additional notice and in addition to all other remedies allowed by law, the Auctioneer will retain all monies received and add any deficiency or expense associated with resale or disposal of the property to the defaulting buyer. Riggers, movers, electricians or anyone working as such must provide the Auctioneer with proof of insurance. The coverage must be at a level acceptable to the Auctioneer and Seller. All removal expenses and the repair of damages caused by removal are at the risk and expense of the Buyer and/or their agent unless otherwise stated on the Auction invoice.
AUCTION SITE/BUYER RESPONSIBILITY: Buyer acknowledges that the auction site is a potentially dangerous place. Every person attending the auction sale at all times shall be there at their own risk, with notice of the conditions at the premises, the activities on the premises, and the conduct of third parties now given. Buyers shall so advise their agents and employees. The Buyer agrees to indemnify and hold the Auctioneer and Seller harmless from any claims or damages. No person shall have any claim against the Auctioneer, his agents, employees or principles regardless of personal injury, loss of life or damages to or loss of property. Buyer also acknowledges responsibility for his actions and conduct and the action and conduct of their agents and employees throughout the sale and checkout process.
DISPUTES: Any disputes that arise during the course of the sale or pay period shall be decided by the Auctioneer. The decision of the Auctioneer shall be final and absolute.
COMPETITIVE BIDS: All offerings whether real or personal property are subject to competitive bids. In the event an offering does not have the benefit of competitive Bidders, the item may at the Auctioneer’s discretion, be withdrawn from auction.
VEHICLE TITLES: All titles will be mailed certified mail within 15 business days but in any event the title will not be issued prior to your check clearing the bank.
CONSIGNMENTS: Auctioneer hereby gives notice to Bidders that some items being sold may be consigned by third parties.
ADDITIONAL: A) Announcements made by the Auctioneer prior to and throughout the sale shall become a part of this agreement. Although all information has been obtained from sources deemed reliable, the Auctioneer and Seller make no guarantee whatsoever to the accuracy of any printed materials. B) The Auctioneer reserves the right to withdraw items, alter the sale order, bid on Seller’s behalf, and group lots as he deems appropriate. All auctions are subject to cancellation without notice. Absentee bids will be bid proxy from the Auctioneer and staff. C) The Bidders and/or Buyers will not hold the Auctioneer liable for the Seller's misconduct or negligence in regards to matters of title or failing to close on a sale or failing to disclose defects of any kind including that of hazardous waste. Buyers and Bidders will look to the Seller in these matters. D) All Property sold with Reserve unless otherwise advertised. E) Pay attention to quantities as we customarily sell times the money.
RESERVATION OF SERVICE: The Auctioneer reserves the right on behalf of the Seller to refuse service or admittance to anyone whether notice is given verbally or written.
REGISTRANT INFORMATION & EMAIL: Registrants grant Auctioneer permission to share registration information with affiliates.
SALES TAX: Applicable sales tax will be collected from Buyer at checkout. Proper forms & sales tax certificates must be provided for exemption on qualified purchases.
