Terms Of Sale
1. All prospective bidders must register with Proxibid to obtain a bidder number. Bidding is by number only. NOTE: Whoever is registered to the bidder number is the legally responsible party for all purchases made with that bidder number. The auction will begin on Saturday, June 9, 2018, at 9:00 am and will go until completion. You may still register for a bidder number on Saturday.
2. All sales are final. All items are sold AS IS WHERE IS. All items become the sole responsibility of the buyer (bidder) when the gavel falls and the auctioneer announces "Sold." Bator International, Inc, Dave Fischer and any and all staff are not responsible for damage to or theft of sold items once the successful bidder has been announced.
3. Buyer’s Premiums: 10% per lot on motorcycles and other vehicles; 25% per lot on parts, engines, collectibles & memorabilia. Buyer payments must be made with good funds which are defined as cash, bank wire transfers, cashier’s checks, traveler’s checks, credit cards or personal or company checks (pre-approved by the auction office and backed by a current dated bank letter of guarantee). There will be a 3% surcharge added to all credit card payments. Cash payments exceeding $10,000 will require the auction office to submit an 8300 form to the IRS.
4. Bidders are responsible to know what they are bidding on. Bator International, Inc., Dave Fisher and any and all staff members make no representation and extend no warranties, express or implied, regarding any lots condition, genuineness, value and /or quality and are not responsible for any defect in any lot. Bator International, Inc. has not independently inspected or tested the lots and has no knowledge of the lots history or condition. Bidder has the duty, right and opportunity to inspect any lot prior to bidding, and bidder’s participation in the auction of any lot is exclusively premised upon the bidder’s own determinations. Winning bidders shall accept their lot(s) with all faults including, but not limited to, qualitative conditions, defects or imperfections, whether structural, mechanical or cosmetic and whether mentioned or unmentioned in the lot description. There is no buyer's remorse or cooling down period and absolutely no returning of any item for any reason whatsoever. Winning a bid at auction constitutes a legal and binding contract in which you are legally bound to pay for all items for which you are the recorded buyer of and for which the auctioneer announces as having been sold to you. Should a bidder default upon his/her purchase (s) in any manner whatsoever (NSF, stop payment order, non payment, etc.), all bidder deposits left with Bator International Inc will be forfeited and the buyer agrees to pay Bator International, Inc the full sum equal to the purchase price, buyer's fee and any additional costs involved in any legal action, transportation, storage and resale of items not paid for. The sum due and payable without relief.
5. In matters where the winning bid cannot be determined with certainty, the auction process may be repeated for that lot. The auctioneer will use reasonable judgment in evaluating bidder’s claims of auction confusion. The auctioneer’s determination(s) in these circumstances is both final and non-appealable.
6. All purchases must be paid for by the end of the auction day and must be removed from the auction facility no later than noon on Sunday, June 10, 2018. If a buyer is paying by wire transfer, any and all items will be transported to a storage facility and held at the buyer’s expense until funds are received. Any items left in the auction facility after Sunday at noon will be removed to a storage facility and the owner will be charged for all fees incurred by Bator International, Inc and/or Dave Fischer including but not limited to transportation and storage of said items.
7. If the vehicle is sold on a "Bill of Sale Only," buyer accepts all responsibility and cost in obtaining a title and/or registration in their particular state or country. Nebraska sales tax will be charged on parts, engines, collectibles and memorabilia only. Buyers of vehicles are responsible to register them and pay the applicable sales tax in their home state.
8. Licensed motor vehicle dealers must supply copies of state dealer’s license and sales tax certificate upon check out. Dealers will pay any legal city or state sales or other tax assessed due to their failure to qualify from paying said tax at time of sale.
