BID EQUIP LLC TERMS AND CONDITIONS All equipment is sold as is, where is, on location unless otherwise stated. Equipment descriptions are intended as a guide. Sales will not be invalidated due to catalog inaccuracies. We recommend buyer to inspect the equipment to verify specifications and condition. All invoices will be emailed to the registered email address the following business day. We are not here to intentionally misrepresent equipment or mislead buyers with descriptions or pictures. However, there could be errors made in this catalog. Any errors made in describing items or picturing does NOT negate the buyer’s responsibility to pay for their purchases. We make every effort to correct any errors before the lot hits the Auction Block. It is the buyer’s responsibility to make sure each item meets their needs before placing a bid. YOU ARE ENTERING INTO A BINDING CONTRACT. THERE ARE NO REFUNDS OR BID CANCELLATIONS. THE REGISTERED BIDDER IS PERSONALLY RESPONSIBLE, LEGALLY AND FINANCIALLY FOR ALL AUCTION ITEMS BID UPON WHETHER REPRESENTING ONE'S SELF OR ACTING AS AN AGENT. AN ONLINE BID ACCEPTED AT PUBLIC AUCTION IS A LEGAL AND BINDING CONTRACT TO PURCHASE. ANY BIDDER WHO FAILS TO FOLLOW THROUGH WITH A PURCHASE WILL BE BANNED FROM BIDDING AT ALL FUTURE SELLER AUCTION EVENTS AND MAY BE PURSUED FOR CIVIL AND/OR CRIMINAL VIOLATIONS. CONDITIONS: There are no warranties which extend beyond the description in quotation. Quotation is subject to change without notice. All specs and information are subject to buyers inspection. Some or all lots are subject to reserve. Propane bottles are not included with the sale of any propane machines.Pallets are not included with the sale of any lot.Boxing and Palletizing is an additional fee if needed. Inspection: Buyer is responsible for inspecting items before bidding. Machines located in Lester, PA are open for inspection prior to the auction by appointment only. We are located next to the Philadelphia Airport. Please call us to set up an appointment for inspection 484-494-6846. Loading: Most machinery will be loaded for FREE on open trailer with no sides. We can load into overseas containers, flat rack, shrink wrap, or build custom skids for overseas shipping for an additional fee. Please call for a quote. Setup of shipping is required by the buyer. All items must be Paid in full by December 9th, 2025 and removed for by December 16th, 2025. We can store machinery for longer but storages fees will apply. Bidding Registration: Credit Card Required for Registration Credit / Debit Card Deposits: This auction requires a refundable credit or debit card deposit at the discretion of the auctioneer. Your credit/debit card added through the fully secure and PCI compliant registration process may be assessed a $250.00 deposit in order to be approved to bid within the auction. You may not be approved without your credit card entered at the stage of registration being assessed a refundable deposit of $250.00. The buyer's premium is an additional small percentage charge added to the hammer (winning bid) price of each lot. It and any applicable sales tax are added to the hammer price to determine the total due price of the lot. The buyer's premium is taxable in PA.SALES TAX:Pennsylvania is 6%The PA sales tax of 6% is added to each winning bid + buyer's premium unless you are exempted by the state. The buyer's premium is taxable in PA. If you have a tax exemption license, please make sure we have it on file before the end of the auction. Buyers Premium will be charged to all buyers after bidding closes. There is NO CAP on the Buyer's Premiums. All accounts must be paid in full by wire/ACH transfer, certified funds, or cash payments of no more than $1,500. An invoice will follow the next business day after the end of auction date. All titled items will be assessed an additional $100 title fee on the invoice. Please be aware that any item with a title may have a title delay. We will not release titled items unless transporter has a tag. PAYMENT & REMOVAL: WINNING BIDDERS HAVE UP TO December 9th, 2025 TO PAY INVOICE AND REMOVE WON ITEMS BY December 16th, 2025. IF WINNING BIDDERS NEED MORE TIME TO REMOVE ITEMS, PLEASE CONTACT BID EQUIP LLC AND MAKE ARRANGEMENTS. Buyer is responsible to bring all machinery to O.S.H.A. standards EQUIPMENT SAFETY for all items purchased from Bid Equip. It is buyers responsibility to provide proper safety devices and equipment to safeguard persons from harm resulting from any particular use, operation or set-up and to adequately safeguard the equipment to conform to all Federal, State and Local Government safety standards and all industrial standards. INDEMNIFICATION: Buyer agrees to indemnify and hold harmless Auctioneer, Bid Equip LLC and seller from any and all claims or liabilities caused by or arising from the equipment on this quotation. Payment Terms and Conditions: Sales Tax: 6% sales tax will be charged to each auction winners bill unless a tax exempt form is provided upon payment. Method of payment for domestic buyers: Cash (up to $1,500), wire/ACH transfer, or certified check. No purchases will be released without payment as described above. In the event the purchaser fails to pay the whole of the purchase within the time set forth by the auctioneers and/or fails to comply with any of the conditions or terms of sale, the seller may retain and/or recover the deposit specified as liquidated damages and, in addition thereto, items that are not paid for can be resold at public or private sale without further notice. Any deficiency resulting from such resale shall be paid to the auctioneers by the defaulting purchaser together with all charges, fees, and expenses incurred by such resale and enforcement of the obligation hereunder. Chargebacks: As a condition to registration and bidding, Buyer agrees that Buyer will not, under any circumstance, initiate a chargeback to Buyer's credit card. Buyer further agrees that Buyer is waiving any chargeback rights that may exist under the agreement between Buyer and Buyer's credit card company. Should a chargeback be initiated by Buyer, these terms and conditions will be conclusive evidence of Buyer's waiver of any chargeback rights. The Bidder becomes solely responsible for all items purchased by him immediately following his winning bid at the auction. Therefore, he is advised to further guard and insure his items at his own discretion. Bid Equip LLC reserves the right to refuse sale of any lot at our own discretion. If equipment is not removed within specified removal time, purchaser shall be liable for any moving and storage costs incurred and, if not so removed, the items shall be deemed abandoned. All items must be removed by December 16th, 2025. Storage fees will accrue after December 16th, 2025. Bid Equip LLC will make no more than 3 attempts to contact buyer regarding storage. If fees are not paid in full by the 3rd attempt, items will then be considered abandoned. All bids subject to seller's confirmation. Bidders are held personally liable for any bids made with their Bidding Number. Lots are subject to cancellation and withdrawal from the auction without prior notice. Bid Equip LLC reserves the right to add and remove any items at any time prior to the actual auction. PLEASE READ: Though we provide loading assistance, all customers and/or their drivers are responsible for assuring all items are loaded properly and secured. Bid Equip LLC is not responsible if any items are not loaded or left behind. Customers and/or drivers are responsible for signing a bill of lading upon pick up. Bid Equip LLC does not sign third party bill of ladings. PLEASE READ: This auction company has requested and been granted access to see all bids placed including any maximum pre-bids. This auction is permitted to engage in this activity by providing this clear disclosure to you, the bidder. PLEASE READ: At the request of the auction company, this auction permits bids to be placed by the auctioneer, an employee of the auctioneer, or the seller or an agent on the seller's behalf. While the Unified User Agreement prohibits this behavior, in accordance with UCC 2-328, this auction is permitted to engage in this activity by providing this clear disclosure to you, the bidder.
