Terms and Conditions of Real Estate Auction Sale 1. The property to be sold is located at 1223 CAMARGO ROAD, Mount Sterling, KY 40353 and shall be sold as a single entity. 2. The property is to be sold in its “as is” condition without any warranty or guarantee as to the physical condition of the property or any of the improvements thereon. 3. This is a Non-Contingent Auction Sale, including financing and/or property inspection. All due diligence to be completed prior to Auction. 4. A five percent (5%) Buyer’s Premium shall be added to the final bid price to determine the gross purchase price. 5. Immediately following the Auction sale Purchaser must sign auction purchase contract and must execute the sale security bond which in the auction brochure. And purchaser must pay ten percent (10%) of the gross purchase price in cash, certified funds, or personal check with prior approval to the Montgomery County Master Commissioner. 6. The balance of the total purchase price, shall be paid to Master Commissioner at the closing. The Purchaser has executed and delivered to the Master Commissioner the Sale Bond and agrees to the terms thereof, including the provisions as to surety on the Sale Bond. Purchaser has offered surety, as described in the attached Sale Bond which is approved by the Master Commissioner. 7. Closing of this said sale shall be held on or before thirty (30) days after approval and confirmation of this sale by the Court, at such location as may be acceptable to both PURCHASER and Master Commissioner. Time shall be of the essence in closing this sale. 8. The property to be sold shall include all permanent improvements located thereon but shall not include any movable personal property. 9. Sellers agree to deliver to Purchaser complete possession of the property at the time of closing. 10. A Properly registered buyer broker shall be entitled to a 1% commission of final bid price at closing. 11. Announcements made the day of Sale take precedence over printed material or prior verbal statements.
