Payment Instructions: All winning bidders will be invoiced via email shortly after the auction is complete. The invoice total will be billed to their credit card on file prior to pickup. A $25 service fee will be charged to any account whose credit card on file is declined. Buyers wishing to pay by cash or check must make arrangements with the auction company PRIOR to invoicing.
Checkout Date & Times: All items must be picked up at specified time and place. Special arrangements for pickup can be made at a cost of $25 per hour (minimum 1 hour) while auction staff needs to be present. Lots or partial lots left unclaimed for 10 days become the property of the auction company.
Bidding Terms: YOUR BID IS A CONTRACT TO BUY. Do not bid until you read and understand all terms. All property is sold 'AS IS'; Absolutely NO REFUNDS! All bidders are encouraged to personally inspect items during the auction preview if they cannot attend a live auction and are concerned about conditions that can’t be seen in photographs. Please contact us with any questions prior to bidding.
FOR LIVE INTERNET BIDDING: There is a 15% Buyer's Premium added to the winning bid (hammer price) to determine the total sale price of each lot. 7% Indiana State sales tax will be charged on the total sale price when required by law. All accounts will be settled prior to removing any merchandise from auction site. If you win an item in the auction you will be notified by an email that includes your invoice. This will be the only invoice provided, so make sure that this email does not go to your SPAM or junk folder. All bidders must provide their name, address, daytime phone number, and a current email address at which they can be contacted.
By bidding on any item, the bidder shows acceptance of the terms of the auction. The auction company reserves the right to refuse service to any person. All announcements made day of auction take precedence over any and all written or verbal statements. Auction company staff reserves the right to bid on items in this auction for their own use, or to advance the bid up to but not including the reserve price stipulated by the seller.
All property is sold “AS IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection prior to auction day by contacting Auctioneer at (260) 242-7366 to make an appointment. It is the Bidder’s responsibility to determine condition, age, history, pedigree, genuineness, value or any other determining factor that they deem important. The Auction Company will attempt to describe the merchandise in advertising to the best of their ability, but in no event shall the Auction Company be held responsible for marketability, expressed opinion of value, or fitness for a particular purpose. Bidder shall be the sole judge of value and is solely responsible to determine value for their intended purpose. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person.
Further Terms for all Auctions: The purchaser agrees to pay all reasonable attorney fees and costs incurred by the auction company arising from debt collection. The purchaser also agrees that a fee of 4% per month be added to the balance of any unpaid balance due the auction company and any other costs or losses incurred by the purchaser’s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Noble County, Indiana. The auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it in his estimation prove injurious to the auction. The auctioneer shall be the final judge in all bidding disputes and shall name a bidder as the purchaser. IF THERE IS AN INTERNET OR SOFTWARE FAILURE during online bidding, the auction will continue as normal and the item will be sold to the bidder (live or online) with the highest bid at the point at which the hammer falls. In case of broad reaching internet or software failure, bidding times may be suspended or extended at the Auctioneer’s discretion. The auction company shall not be held responsible for any bids unseen by the auctioneer or any bids deemed late by the online software. The Auction Company, Auction Andy, reserves the right to withdraw or re-catalog items in this auction when allowed by law.
