Terms & Conditions of Sale
1. SCOPE:
The School Board of Broward County will conduct a public auction of District-Owned School Buses, Vehicles, and Equipment that have been declared as surplus to the needs of the District.
2. AUCTION DATE:
• This auction will be a Timed Bid Online Auction. Bids will be received at www.natlauction.com and conducted on Proxibid.com.
• Registration for the auction will be through Proxibid.com, and bidders may be required to provide credit card information as a means of verification only.
• The auction will open on June 4, 2025, at 3:00 P.M. and will end on June 17, 2025, with lots beginning to close at 3:00 P.M.
• The auction website will make use of staggered closing times, but all bids will close on June 17, 2025.
3. REPORTING OF BIDS:
• All High Bid Prices will be reported to the School Board of Broward County. Any bids received after the published closing times will not be accepted except those that fall under the conditions of Extensions of Bid described in the paragraph that follows.
• In the event a bid or bids are made during the last two minutes of an auction, the ending time for the auction will be extended for an additional two minutes. Extensions will continue until no further bids are received within the last two minutes of the auction. National Auction Company and the School Board of Broward County have no control over this process.
4. FORM OF AUCTION:
• All School Buses, Vehicles, and Equipment included in this Timed-Bid Auction are being offered Subject to the Confirmation of top bid prices by the School Board of Broward County, Florida.
• In the event top bid prices are not confirmed by the School Board of Broward County, items may be withdrawn from the auction and offered at another time at the discretion of the School Board of Broward County. It is expected that all top bid prices will be confirmed and Top Bidders notified that their bid has been accepted within 24 hours from the time the auction closes.
• The Auctioneer reserves the right to establish minimum amounts for opening bids. In the event bidders do not comply with the minimum amounts stated, bids received that are less than those set forth will not be accepted.
5. PLACE:
National Auction Company will conduct the Auction, and information can be found at www.natlauction.com. The auction platform of Proxibid will be used for this event.
6. INSPECTION OF VEHICLES:
• School Buses and other items included in this auction will not be available for Preview because they are located at restricted School Bus Terminals. As noted in the auction materials, Buses and Vehicles are not located at one Terminal, making pre-event previews difficult to schedule. Specific questions should be directed to George Richards at 954-658-5033.
• As much as possible, all of the Buses and Vehicles that could be started and driven were taken to the Northwest Bus Terminal, 2600 NW 18 Terrace, Pompano Beach, Florida 33071. Buses located at any of the other Terminal locations could not be started and are considered to be Non-Run vehicles.
• Auction descriptions include information regarding which buses started on their own or were jump-started. It is possible that between the time the auction was being set up and when vehicles are picked up, they may not start on their own but will need to be jump-started.
• If the description of any bus indicates it does not start or run, bidders should not assume these units can be started.
• Auction descriptions of each unit include information regarding the operation of air-conditioning. It is possible that between the time the auction was being set up and when vehicles are picked up, the air-conditioning may no longer be functioning.
• Potential bidders/purchasers will not be permitted to drive any vehicle before the auction. ALL SCHOOL BUSES, VEHICLES, and EQUIPMENT ARE OFFERED IN AS-IS CONDITION.
• The information included on the Website may include videos of School Buses that could be started. It is possible that inventory described as “Non-Run” can be started and driven; however, when auction materials were being gathered, those marked as Non-Run could not be started.
• Some of the vehicles included in this auction have not been driven for an extended period. It is possible some will not start on their own and may require new batteries or mechanical repairs. Additionally, the condition of the tires is unknown, and it is possible that some of the vehicles cannot be safely driven over long distances. Many of the School Buses were driven from other Broward County School District Terminals for the convenience of the auction.
• Every effort has been made to accurately illustrate and describe the condition of School Buses and other items included in this auction. However, it is possible that not all defects were observed. It is also possible that between the time auction materials were gathered and when items are picked up by Top Bidders, charging levels in batteries could have changed. The fact that auction materials indicate a vehicle could be started but will not start at the time it is being picked up will not be cause for any sale to be voided. Every effort will be made to assist as much as possible.
• Many of the Schools Buses included in this auction are exempt from odometer/mileage statements. Odometer readings/hour meter readings included as part of the vehicle information are as reported by the Broward County School Board and might not be accurate. To the extent possible, odometer readings stated in the auction materials were verified. If actual odometer readings/hour meters are different from those reported in the auction information, it will not be a cause for invalidation of the sale.
• Each item included in this auction is specifically offered and sold in As-Is condition without guaranty or warranty, either expressed or implied.
7. CONDITIONS OF SALE AND DELIVERY:
• The School Board of Broward County is selling surplus School Buses, Vehicles, and Equipment at Public Auction, for cash, to the highest bidders.
• Any announcements and/or changes necessary to the conduct of the Timed Bid Auction and made by the Auctioneer will be sent as emails through the website and distributed to all registered bidders.
• Despite efforts to avoid withdrawal of items from the Timed Bid Auction list after being published and/or advertised, there could be circumstances when such action is necessary. The School Board of Broward County reserves the right to remove any item from the auction and reserves the right to accept or reject any/all bids.
• All School Buses, Vehicles, and Equipment are being offered and sold “as is” and “where is.” The School Board of Broward County and National Auction Company make no warranties or guarantees, expressed or implied, regarding the operation or condition of any item included in the auction. Even though great effort has been made to ensure the accuracy of information, it is possible that the information provided might not be correct.
• Once top bid prices have been received and communicated to Broward County Personnel, all sales are final and will not be subject to refunds or exchanges.
• All Participants in this Timed Bid Auction agree to abide by all Terms & Conditions of Sale provided in this document.
8. BUYER’S PREMIUM:
A 7% Buyer’s Premium will be added to all top bid prices and included in the final purchase price.
9. NOTIFICATION TO TOP BIDDERS:
• All Top Bidders will be notified that National Auction Company has accepted their bid through the email address supplied at the time of Bidder Registration.
• Payments can be made by Cash, Money Order, or Cashier’s Check. All checks should be made payable to National Auction Company, Auctioneer’s Escrow Account. Personal and Corporate Checks will only be accepted when accompanied by a current bank letter that specifically guarantees payment for purchases made at this auction.
• Payments can also be made via Bank-to-Bank Wire Transfer. Please contact National Auction Company for bank information.
• PLEASE NOTE: Credit Cards, Debit Cards, or payment formats such as Zelle WILL NOT BE ACCEPTED.
10. PAYMENTS:
• Payments will be accepted starting on June 18, 2025, and June 19, 2025, between the hours of 10:00 A.M. and 3:00 P.M.
• All payments must be made at Broward County Schools, Northwest Bus Terminal located at 2600 NW 18 Terrace, Pompano Beach, Florida 33071. Payments can also be sent by Bank Wire Transfer. Please contact the Auctioneer for bank wire instructions.
• Payments made after June 19, 2025, may subject the Purchaser to a surcharge of 10% of the purchase price. Please pay for purchased vehicles and other items by the date specified.
• National Auction Company reserves the right to resell any item included in this Timed Bid Auction that has not been paid for by 3:00 P.M., June 19, 2025.
11. MOTOR VEHICLE TITLES & KEYS:
• Motor Vehicle Certificates of Title and keys are ONLY available at the Northwest Bus Terminal (2600 NW 18 Terrace, Pompano Beach, Florida 33071).
• In the event a Top Bidder has purchased more than one item, payment in full must be received before anything can be removed from County property.
• Invoices and Bills of Sale will be printed in the name of Purchasers only and cannot be combined under other Bidder’s numbers assigned by Proxibid.
12. SALES TAX
• Florida Sales Tax will be calculated on the full purchase price, which includes the Top Bid Price and 7% Buyer’s Premium.
• National Auction Company does not collect sales tax on titled motor vehicles, which the Purchaser must pay at the time the title is transferred.
• Dealers who purchase for resale must provide a copy of their 2025 resale certificate to National Auction Company by e-mail to: lori@natlauction.com. If this certificate is not provided, sales tax will be charged.
• Sales Tax will be collected on non-titled items unless purchased by those who have provided National Auction Company with a copy of their Sales Tax Certificate.
13. MOTOR VEHICLE TITLE TRANSFERS:
• Purchasers are responsible for transferring Certificates of Title into their name or company name as listed on the Invoice provided by National Auction Company. Transfer of title must be completed as soon as possible, but no later than 10 days from the date stated on the Invoice provided by National Auction Company.
• After payment in full has been made, a Certificate of Title will be given to the purchaser, which must be taken to a Tag Agency and transferred into the name of the purchaser. The receipt given by the Auto Tag Agency must be brought to the Auction Office (2600 NW 17 Terrace, Pompano Beach) before the vehicle can be removed.
• All required Registration Fees and Sales Tax must be paid at the time Certificates of Title are transferred.
• All Certificates of Title will be closed to include the name of the Purchaser, their address, the date the vehicle was sold, and the purchase price.
• Florida Licensed Motor Vehicle dealers must provide a copy of their license and Sales Tax Resale Number at the time of bidder registration. In the event Licensed Dealers do not provide the required information, Certificates of Title will be completely closed.
• Open titles will not be given to purchasers.
14. DEFAULT:
• If a Top Bidder fails to complete the sale under the conditions set forth or agreed to by the School Board of Broward County, any deposits and/or payments made to the account of the School Board will be forfeited, and vehicles will remain the property of the School Board.
• If a Top Bidder fails to make payment in full after being notified their bid has been accepted, at the discretion of the School Board of Broward County and/or the Auctioneer, the bidder’s name may be subject to removal from the mailing list and not be permitted to participate in future auctions. Failure to make the final payment may result in removal from future bidder registration(s) for other auctions conducted on the Proxibid platform.
15. REMOVAL:
• School Buses and other items must be removed from Broward County School Board Terminals as soon as possible, but not later than June 20, 2025. The School Board of Broward County and National Auction Company are not responsible for any items included in the auction remaining at any of the Broward County School Board Terminals after completion of the auction.
• In the event any School Bus or other item is not picked up by 3:00 P.M., June 20, 2025, it will be retained by the School Board of Broward County and the full purchase price forfeited.
• It is recommended that purchasers make contact with the Auctioneer’s staff to schedule times for removal from the School Board property. Entry to any Terminal requires admittance with an Auction Staff member and photographic identification.
• Non-titled assets that require assistance with loading require an appointment with the Auctioneer.
• Operation schedules at Broward County School Board Terminals restrict entry times.
• It will be the responsibility of Top Bidders (Purchasers) to arrange for their own transportation and removal of Non-Running Vehicles from School Board Terminals.
• Bidders/Purchasers should be prepared to have Vehicles designated in auction materials as non-runners towed. Tow trucks can only enter School Board Terminals when accompanied by Auction Staff members.
• Top Bidders/Purchasers using Towing or Transport Services must provide specific information to National Auction Company, which authorizes the release of a vehicle to a transporter. Please make sure contact information is provided to the auction company personnel.
• Top Bidders (Purchasers) will be required to sign a receipt that shows delivery of the purchased Vehicles.
• Repair work that goes beyond the replacement of batteries is strictly prohibited at any Broward County School Board Property/Terminals.
16. OUT OF STATE MOTOR VEHICLE DEALERS
• Out-of-state motor Vehicle Dealers must provide the Auctioneer with a copy of their current Motor Vehicle Dealer’s License in the state in which they are licensed before moving any vehicle. Motor Vehicle Dealers must provide a copy of a Certificate of Insurance to National Auction Company.
• Motor Vehicle Dealers who are using Dispatched Delivery Services must supply the Auctioneer with a current Insurance Certificate of the Dispatch Service, Transporter, or Towing Service.
• Dispatch Service drivers will be required to supply a copy of their current Commercial Driver’s License and sign a receipt for each vehicle to be transported.
17. REGISTRATION:
All bidders are required to register with National Auction Company on their website, www.natlauction.com. To participate in the auction, all bidders must also register with Proxibid.com. Each Bidder will be assigned a Bidder’s Number, and that number will be recorded for each sale.
18. COLLUSION
• Collusion is defined as an agreement among competitive bidders to raise, fix, or otherwise maintain the price at which goods or services are sold.
• Auctions are governed under the Sherman Act, enacted in 1890. The Sherman Act prohibits any agreement among competitors to fix prices, rig bids, or engage in other anticompetitive activity.
• Violations of the Sherman Act may be considered to be a felony and punishable by fines established in the Act.
• Bidders planning to participate in this auction should be aware that violations that come to the attention of National Auction Company will be reported to the Broward County School Board for action they determine to be appropriate.
19. DIRECTIONS TO AUCTION CASHIERING LOCATION
FROM I-95 (Broward County)
Exit at Copans Road and continue West to NW 18 Terrace and turn right. Continue on NW 18 Terrace to the sign that identifies Broward County Schools, Northwest Terminal. Watch for directional signs to the Auction Office.
FROM the Turnpike (Broward County)
Exit at Sample Road. After paying the toll, continue to the traffic signal and turn right (east), and continue to Powerline Road. At Powerline Road, turn right and continue to Copans Road. Make a U-Turn and continue to NW 25 Place and turn right.
