This auction will be conducted by Statewide Auction Company where both Live Floor Bidding and Live Online Bidding will be available. Auction Lots are to be sold with NO SPECIFIED MINIMUMS and NO RESERVES, however all bids are Subject to Seller Approval. Live Online Bidding will only be made available for the first portion of this particular auction sale which will include all Vintage Automobiles (see catalog). Bidders interested in participating in the latter portion of this auction (consisting of smaller ‘carry out’ auction lots and other items) will need to be ‘on-site’ and registered as a ‘Floor Bidder’. BIDDER TERMS AND CONDITIONS Subject to amendments and modifications announced by the Auctioneer at the time of the auction, any person participating in the auction shall be bound by the following terms and conditions: Bidders are required to register to participate in Statewide Auction Company’s sales. The Bidder’s full name, address, phone number, company, driver’s license number, and email may be collected by Statewide Auction Company in order to register, at which point a bid number will be assigned. Prospective bidders are encouraged to view and inspect the property to be sold prior to the actual auction sale. Taking time to look at the items for sale is strongly encouraged. Each auction will have listed times for preview. Please check our upcoming events for places and for inspections/auction dates and times. All announcements made on the auction day shall take precedence over previously distributed information. All bids constitute a legally binding contract and bidders will be legally obligated to make payment and remove items in accordance with the terms and conditions of the sale. Payments. Statewide Auction Company must receive the balance of the total purchase price no later than the close of business on the day following the auction. All payments must be in cash, cashier's or certified check, wire transfer of immediately available funds, or a corporate check accompanied by a bank letter of guarantee, and all of the foregoing must be in form, scope and substance acceptable to Statewide Auction Company in its sole discretion. Credit/Debit cards will not be accepted for payment of the balance of the total purchase price. No title shall pass to Buyer until the total purchase price has been paid to Statewide Auction Company. Removal. No item may be removed unless paid in full. The buyer shall be responsible for all costs of removal and shall be liable for any damage, including without limitation, any environmental damage, caused during or as a result of the removal. Removal of purchased items is the sole responsibility of the buyer and must be completed within (1) week following the auction. Removal may not begin until full payment has been received by Statewide Auction Company. Recommendation or approval of Transporters shall be done only as an accommodation to the Buyer. Buyer’s selection of a Transporter is solely within the discretion of the buyer, and Buyer acknowledges and agrees that it shall have no rights or remedies against any employee, agent, client, or any affiliate of Statewide Auction Company based upon any act or omission by a Transporter. All purchase transactions shall be governed by and construed in accordance with the local laws of the State of Utah, USA. The venue for trial or resolution of any dispute arising out of or related to this transaction shall take place in Salt Lake City, Utah, USA. If any provision of these terms and conditions shall be held invalid, illegal, unenforceable or inoperative, the balance of the terms & conditions shall remain in full force and effect as if such provisions had not been included. These terms and conditions with any amendments or modifications expressly made by the auctioneer at the time of the auction constitute all the terms and conditions with respect to the sale of property at this auction. There are no representations, warranties, terms, conditions, undertakings or collateral agreements except as herein above provided. A 3% Buyer's Premium will apply to all online purchases.
