Special Terms
GENERAL:
A valid credit card is required to bid at this auction. We accept MasterCard, Visa and wire transfer. Your credit card may be charged for your purchases immediately following the auction. Ronald Roman Auction Company reserves the right to request a different form of payment (wire transfer or cashiers check) for amounts over $2,000.00. You will be notified at the end of the Auction via email with your invoice noting all purchases and amount charged to your credit card.
NOTE: A $30 PROCESSING FEE WILL APPLY TO ANY CREDIT CARD TRANSACTION THAT DECLINES!
VEHICLES SOLD IN AS IS CONDITION. A $400.00 DEPOSIT MAY BE CHARGED TO CREDIT CARD AT END OF AUCTION. HIGH BID SUBJECT TO SELLER/COURT/ESTATE/ SECURED PARTY CONFIRMATION. IT MAY TAKE SEVERAL WEEKS AFTER ACCEPTANCE OF BID TO OBTAIN THE TITLE FROM THE SELLING AUTHORITY & VEHICLES WILL NOT BE RELEASED UNTIL TITLE IS READY.
ANY ANNOUNCEMENTS MADE DURING THE DAY OF THE SALE WILL TAKE PRECEDENCE OVER ANY PRINTED MATERIAL OR ADVERTISING.
ALL INTERNET BIDDERS AGREE TO PAY THE BUYERS PREMIUM, AS LISTED PER ITEM, OF THE HAMMER PRICE FOR EACH ITEM THEY PURCHASE. IF THE HAMMER PRICE OF AN ITEM IS $1,000.00 AND THE BUYERS PREMIUM IS 13%, THERE WILL BE AN ADDITIONAL $130.00 ADDED TO THE HAMMER PRICE TO DETERMINE THE TOTAL PURCHASE PRICE.
IN PERSON/ LIVE BIDDERS WILL BE CHARGED A 10% BUYERS PREMIUM FOR VEHICLES AND EQUIPMENT WHERE A BUYERS PREMIUM IS ANY AMOUNT OVER 10%. IE IF A LISTED BUYERS PREMIUM IS 13% AN ONSITE BUYER WILL BE CHARGED 10%.
IF A LISTED BUYERS PREMIUM IS 3% THEN A BUYERS PREMIUM IS NOT APPLICABLE FOR ONSITE BUYERS.
WINNING BIDDERS WHO PLACE THEIR BIDS ONLINE AND ARE PRESENT AT THE AUCTION WILL BE CHARGED THE ONLINE LISTED BUYERS PREMIUM.
By registering to bid or placing a bid you agree to be bound by all of these terms & conditions. Any announcements at sale time shall take precedence over any written statements in this auction. All Internet bidders agree that bids placed on the Internet shall have the same legal effect as if they were in attendance at the auction in person.
All persons attending the auction, as well as successful bidders removing merchandise assume all risks of damage to person or property and specifically release and indemnify Ronald Roman Auction Company from any liability.
No children under the age of 16 are permitted in the sale area. Participation in an auction by any person under the age of 18 is strictly prohibited and in violation of these Purchase Terms.
You will be contacted by phone and email (it is your responsibility for checking your email). Please ensure a good working phone number is provided for a representative from Ronald Roman Auction Company may get a hold of you. A receipt will be e-mailed to the buyer by the end of the 1st business day following confirmation of the sale. This receipt must be presented to authorized personnel before any item can be removed from the auction site.
Per the Auction Agreement with the seller, Ronald Roman Auction Company permits their employees, assignees, or an agent on the seller?s behalf, the right to bid at this auction. We also acknowledge that it is the policy of Ronald Roman Auction Company to treat all bids as if the bidder was simply another potential bidder. While Proxibid? s Unified User Agreement prohibits this behavior, in accordance with UCC 2-328, this auctioneer is permitted to engage in this activity by providing this clear disclosure to you, the bidder.
AS IS WHERE IS; NO WARRANTY.
All items are sold ?AS IS, WHERE IS? with NO WARRANTY expressed or implied by the lot number affixed to the item. ALL SALES ARE FINAL.
Property is open to thorough public inspection. It is the Bidder?s responsibility to determine condition, age, genuineness, value or any other determinative factors. Ronald Roman Auction Company may attempt to describe the merchandise in advertising, on the Internet, and at the auction, but makes no representations as to any of these determining factors. In no event shall Ronald Roman Auction Company be held responsible for having made or implied any warranty of any type or use. Bidder shall be the sole judge of value. Neither the auctioneer nor the seller makes any warranty that the auction vehicle will properly function or operate nor that it will continue to operate or function for any period of time after removal.
INSPECTIONS:
Vehicles can be seen on the day of the auction from 4:00PM until sale time. Or during other listed inspection times.
Ronald Roman Auction Company or representative will not be responsible for any errors or omissions in the description of the vehicle. Descriptions provided by Ronald Roman Auction Company are solely for the purpose of reporting on the visible condition and any pertinent information about the auction item. Vehicles are not driven on the road.
Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidders responsibility to determine condition, age, genuineness, value or any other determinative factors. Bidder agrees that everything is sold AS-IS WHERE-IS and that they may not return any item they purchase for any reason.
Descriptions are believed to be accurate but not guaranteed. When you are not certain of the condition or use of an item please bid accordingly.
FEES AND TAXES:
All Internet Bidders agree to pay the buyers premium, as listed per item, of the hammer price of each item they purchase. If the hammer price of an item is $1,000.00 and the buyers premium is 10%, there will be $100.00 added for a total purchase price of $1,100.00.
State sales tax law, if applicable, will be applied. Online bidders who are tax exempt are encouraged to send their credentials to Proxibid to get registered. The auction company cannot assist with this for online bidders.
LIVE AND ONLINE BIDDING:
Ronald Roman Auction Company is providing Internet pre-auction and live bidding as a service to Bidder.
All online Bidders are required to register online with Proxibid prior to participating. Bidders will be required to comply with these Purchaser Terms and all other specific terms, conditions of the Auction, payment and removal procedures. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Ronald Roman Auction Company or anyone else if the Internet service fails to work correctly before or during the live auction. Ronald Roman Auction Company will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Ronald Roman Auction Company reserves the right to withdraw or re-catalog items in this auction.
The auctioneer shall advance the bidding at own discretion. Ronald Roman Auction Company may withdraw any item before or during the auction. The record of the auction by Ronald Roman Auction Company shall be conclusive.
Ronald Roman Auction Company may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification Ronald Roman Auction Company may request including but not limited to: drivers license, photocopies of credit cards, Social Security card or US Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items.
Ronald Roman Auction Company reserves the right to reject or void any Auction bid at its sole discretion.
Auctioneer reserves the right to withdraw any Auction Item listed for sale at an Auction or to postpone or cancel any Auction for any reason, in its sole discretion, with or without notice, and without liability to any Bidder.
When the auctioneer says "sold" Bidder assumes full responsibility for the merchandise. Everything MUST be paid for in full in accordance with the terms of the auction. Payment shall be made by VISA, MasterCard or Wire Transfer. Bidder further agrees that under no circumstances will he/she initiate a charge back on his/her credit card. Title to the merchandise transfers to Bidder only when Bidder's payment has been honored.
Bidder agrees that this agreement shall be governed by the laws of the state of Ohio and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Ohio. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Ronald Roman Auction Company and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Ohio.
TITLE TO VEHICLES:
Auctioneer guarantees free and clear title to the vehicle and Auctioneer shall use its best efforts in accordance with applicable law to obtain and convey to Purchaser title to such vehicle Auction Item; provided, however, that should a delay in the obtaining the title occur, Auctioneer shall in no way be responsible for any losses, damages, attorney's fees, costs of any kind, interest, punitive damages or any other type of damages resulting from such delay and Auctioneer shall have no liability to Purchaser or any subsequent purchaser for any title delays for any reason whatsoever.
All Titles and Registration Certificates (if stated that they are included with the item) will be mailed to the buyer within a reasonable time period following the auction, allowing for satisfactory collection of negotiable funds.
REMOVAL OF VEHICLES:
All Auction Items must be removed by Purchaser within seven (7) calendar days following their confirmation of sale, without exception. Purchaser will be charged a storage fee of $25.00/day per vehicle for any vehicle remaining on site thereafter. All storage fees must be paid prior to removal. A paid in full receipt must be presented by Purchaser for removal.
Bidders are responsible for their own removal. We do not provide any help with removal of any vehicles at this time.
Removal shall be at the expense, liability, and risk of the purchaser. Purchases will be released upon presentation of a paid email receipt. Please ensure that anyone picking up items on your behalf have a paid receipt at the pickup location no items will be released without a paid email receipt. Bidder further agrees to be held personally responsible for all purchases made on their bidder number, and agrees that bidder will not charge back items which are not picked up during the scheduled removal times. Buyer authorizes Ronald Roman Auction Company to release buyer's assets to any individual in possession of the buyer's sales receipt.
LIVE AUCTION ATTENDANCE:
No person or entity shall have any claim against Auctioneer, its agents, employees or principals for any injuries sustained, or for any damages to or loss of property which may occur from any cause whatsoever at an Auction site.

ADDITIONAL TERMS
This is a LIVE AND ONLINE AUCTION PLEASE DO NOT BID IF YOU ARE NOT ABLE TO MAKE ARRANGEMENTS TO PICK UP YOUR ITEMS during the removal period outlined in the above terms. NO refunds or charge back's will be granted due to a lack of removal at the designated times. After the scheduled removal, additional storage fee of $25/per day per vehicle may apply.

In the event of a bidder default and /or charge back bidder agrees that Ronald Roman Auction Company may collect payment for items, including cost associated with items to be relocated, discarded or stored, either by arbitration small claims court or state court at Ronald Roman Auction Company discretion, and that any judgments awarded may be applied to the bidder personally or corporately.
The auctioneer reserves the right to add or remove items from the auction. Split or combine lots. Add minimum bids or reserve prices. Cancel, suspend, extend or reschedule an individual item and or auction event. Make changes to the auction closing times or inspection or removal times. Rescind the sale of any or all items regardless of high bid upon auction conclusion.
