Special Terms
All persons bidding or otherwise attending auction (“Bidders”) acknowledge the following Terms and Conditions and agree to be bound by these terms. Throughout these Terms and Conditions, the terms “Auctioneer,” “we,” “us,” and “our” will refer to the Auctioneer and its Associates, and the terms “you” and “your” will refer to the Bidder (Individual or Business)

SALE DAY BIDDING BEGINS:
Onsite bidder registration begins auction day at 8:00am ET.
Bidding is open to the public without regard to race, color, sex, religion, or national origin.
All bidders must register prior to placing bid Bidders are required to be 18 years of age or older to place bids and must present a government-issued photo identification when registering to bid
Bids may be placed online and will be represented at the Live Auction. Absentee and Live Telephone bids are available.
You are encouraged to use the Max Bid feature which represents your high bid.
Method, order of sale, and bidding increments shall be at the discretion of the auctioneer, auctioneer reserves the right to delete or add items at it’s discretion, and will act to protect the interest of the buyers and sellers as an agent, by bidding through the auctioneer, may open bidding on any item by placing a bid as an agent for any buyer or seller.
Announcements (both verbal and written) made during the auction take precedence over all printed material or oral statements made, auctioneer has the authority and discretion to deviate from, change, alter, or modify, the bidding procedures and conduct of the auction even after the start of the auction by announcing those modifications at the time of the sale.
Auctioneer has the right to withdraw any item, cancel the sale of any item(s) or cancel the entire auction without notice or liability to the auctioneer or its associates.

PREVIEW & INSPECTION: M-F 8:00am - 5:00pm ET and Tues Sept. 9th , 8:00am until Auction Ends
BID SUBMITTAL:
The Auctioneers are not responsible for a bidder’s inability to place any bid, by internet, phone, absentee or otherwise for any auction/sale for any reason.
In the event of technology issues with Internet sales, the Auctioneer reserves the right to reopen, extend Internet bidding or pause the auction, as it deems necessary and appropriate.
In the event a bidder loses internet connection, immediately call the Berger Truck Sales Office (434-429-7263) for assistance.
The highest bid as accepted by the Auctioneer is considered the Buyer and the final bid shall be the buyers bid and final sale price plus all applicable fee’s.
If a dispute arises between two or more bidders, the auctioneer reserves the right to re-open bidding, the auctioneer will determine the buyer and shall be final.
The owner of any item(s) being sold may not bid on that item.
BUYER’S PREMIUM: A 10% Buyer’s Premium for on-site bidders and 13% for all online bidders will be charged for each lot purchased up to a $3500 Maximum Fee, in addition to any applicable sales tax.
APPLYING FOR TAX-EXEMPT STATUS: All taxable items are subject to a 6.3% Sales Tax Some bidders may be exempt from payment of applicable taxes. If you wish to apply for tax-exempt status, you must submit a completed copy of your tax-exempt certificate prior to this auction’s closing. Please note that you must declare that you are tax exempt when registering for the auction. If you do not follow the procedures discussed in this paragraph, the Auctioneer will be unable to consider identifying you as exempt from taxation, and you will have to apply directly to the applicable state for a refund. Please also note that, depending on the state whose sales tax applies, submission of the Auctioneer’s tax exempt form may not be sufficient to entitle you to tax-exempt status. Please review the form and its contents carefully, and contact the Auctioneer with any questions you may have.
PAYMENT TERMS: PAYMENT IN FULL IS DUE BY 4:00PM ET ON Friday, Sept. 19, 2025.
Payment Options: Wire Transfer, Certified Check ,Cash(sale day ONLY),Credit Card($5,000.00 limit)
A 3%(Visa, Mastercard, Discover)or 4%(AMEX) processing fee added to credit card purchases.
Maximum of $5,000 on Personal checks ( Must provide a bank letter with proof of funds)
Lucky L reserves the right to disqualify any bidder whose credit card is denied for any fee charged during the auction.
In the event a bidder is disqualified due to an inability to collect the appropriate fee, immediately call the office (434-429-7263) to take the steps necessary to reinstate their ability to participate.
A $50.00 per day Late Payment Fee will be charged on any outstanding balance unless acceptable arrangements are made with the Auctioneer.
Buyer (Winning bid) agrees to pay the amount of the final winning bid. Failure to pay will result in prosecution in a court of law. The Buyer will be liable for any attorney/court fees associated.
Buyer agrees to not issue a stop payment on any checks issued or initiate a credit card chargeback with respect to any purchases made at this auction.
Buyer is responsible for all purchases made at this auction, and is responsible for any and all costs and expenses.
NO EXCEPTIONS WILL BE MADE TO THESE PAYMENT TERMS.

For all Domestic and International Wire Transfers, please confirm with your banking institution any transaction fees that may need to be allowed for and confirm that the correct amount is being wired. All wire fees are the sole responsibility of the Buyer.
No Direct Deposits in person at the Bank to our account will be accepted.
No items will be released until receipt of wire transfer has been verified.
FINANCING: Financing is the Sole responsibility of the Buyer!
REMOVAL:
NO REMOVAL UNTIL THE CONCLUSION OF THE AUCTION!
Removal BEGINS Wed. Sept. 10th, 8am –4pm
Monday through Friday 8:00am to 5:00pm ET.
Removal Deadline is Friday, April 4th by 4:00pm ET.
ALL ITEMS MUST BE PAID IN FULL BEFORE REMOVAL OF ANY ITEM WILL BE ALLOWED. Buyer’s must present a valid photo ID and PAID INVOICE BEFORE REMOVAL
Auctioneer is not responsible for any loss or damage to any purchased item once the bid is closed and the item becomes the full responsibility of the buyer.
Loadout: Is the responsibility of the purchaser and NOT the responsibility of the Auctioneer or Associates.
Lucky L's and Berger's personnel will direct you to the location of your item(s), and, at their discretion load items.
(Loadout fees may apply)
Lucky L's and Berger's personnel will not push, pull, or drive equipment or trucks onto trailers, stack trailers, or load large items.
Buyer is responsible for arranging his own freight/transport of the item(s) and the Auctioneer is not responsible for any damages associated with transport.
Storage Fee: UNLESS PRIOR ARRANGMENTS ARE MADE! Any item remaining after the Removal Deadline, a $10 per day, per item fee will be charged to the buyer until the item is removed. Anything remaining 60 (sixty) days after the Removal Deadline will be considered abandoned and the Auctioneer may take possession of the asset(s), and has the right to resell the item(s)
The auctioneer reserves the right to prosecute the Buyer in a court of law for failure to abide by the terms and conditions set forth in this document.
TITLES:
Titles will not be released until all payments have been received. Lucky L and Berger make every effort to release the title to the Buyer in a timely manner.
The auctioneer or associates does not guarantee mileage accuracy, we list the odometer reading! The auctioneer or associates are not responsible for any mileage discrepancies!
A $49 Doc Fee Applies to all titled vehicles
PHOTOGRAPHS AND DESCRIPTIONS:
The Auction Managers regularly post item descriptions and photographs to aid bidders in the bidding process, and will make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. However it is the Buyers responsibility to fully inspect and determine the condition, age, and any details pertaining to items prior to bidding! Lucky L and its associates will make every effort to ensure that the descriptions and photographs that we post accurately represent the items being offered for sale. In some photographs, multiple items may appear to be joined as a single unit, however you should not assume that a lot consists of more than one item simply because various items appear connected or are featured in the same photograph. Also understand that, on occasion, the wrong photograph may be displayed for a given item. At all times, you are bidding on items as they are described, not as they appear in any photograph. THE AUCTIONEER FURTHER DISCLAIMS ANY RESPONSIBILITY FOR LIENS OR ENCUMBRANCES THAT MAY ATTACH TO OR BE ASSOCIATED WITH ANY LOTS OR ITEMS. ANY SUCH LIENS AND ENCUMBRANCES ARE THE RESPONSIBILITY OF THE BIDDER TO INVESTIGATE.

The auctioneer reserves the right to refuse any bidder registration or remove any persons from the auction site for any reason.
Bidders agree to enter the auction site at their own risk and agree to hold the Auctioneer harmless for any personal injury or property damage which may occur during the auction
