**PAYMENT DETAILS**

ONSITE BUYER'S PREMIUMS: • 15% buyer’s premium will be added to all purchases. PROXIBID BUYER'S PREMIUMS: • 20% buyer’s premium will be added to all purchases. ADDITIONAL FEES: • 8% Local Sales Tax Does Apply On All Purchases. Purchases Are The Bid/Hammer Price Plus the Premium. To be exempt from paying sales tax, our office must receive proper forms before the auction closes. • 3% Credit Card Fee On All Purchases. Buyers paying with a credit card will be charged an additional 3% fee. Bidder agrees that under no circumstances will he/she initiate a charge-back on his/her credit card. NO credit card purchases over $10,000. • $25 Wire Transfer Fee Per Transfer. Buyers paying via wire transfer will be charged a wire transfer fee of $25 dollars for each transfer. • $60 Title Fee Per Item if paying for any item accompanied by a title. When paying for any item accompanied by a title with a check all title information will be sent to the buyer via certified mail. Van Byars Auction is NOT responsible if title is lost, damaged, or stolen. • $10 Bill Of Sale Fee Per Item, if paying for any item accompanied by a Bill of Sale only. SESSION 1 FIREARMS ADDITIONAL FEES, TERMS, AND CONDITIONS: • Invoices must be settled and paid in full with Van Byars Auctions before Alan's Armory will run the required background check for each buyer. Background checks / transfers cannot be initiated until payment is complete. • $30 Transfer and Handling Fee per firearm will be charged by Alan's Armory. • $10 Ammunition Handling Fee, if shipping is required, paid directly to Alan's Armory. • Firearms have not been test-fired. Buyers are solely responsible for verifying the firearm’s safety and functionality before use with the assistance of an Alan's Armory staff member. • No items in Session 1 will be sold to international buyers. We do not sell firearms, receivers, or ammunition to any international purchaser. • Buyers are responsible for knowing, understanding and complying with Federal firearms laws and their State firearms laws. Buyers are required to complete a Federal Firearms Background Check with Alan's Armory. Buyers with a carry permit must also fill out the background check paperwork. As noted above, a background check fee per buyer, whether approved or denied, is $30 (includes handing fee). Due to the Bipartisan Safer Communities Act (2022), background checks for buyers ages 18–20 may be delayed for up to 10 business days. The background check fee per firearm must be paid directly to Alan's Armory. Item(s) will only be released after the invoice is paid in full with Van Byars Auctions and after a successful background check in the state of Georgia (GA). Item(s) won by any buyer who fails a background check will be re-consigned to the next available auction. No refunds will be issued for the purchase price or background check fees. Upon a successful background check in the state of Georgia (GA), buyers may pick up their item(s) at Alan's Armory. Alan's Armory is located at 4185 US-27, Cataula, GA, 31804 and can be reached at 706-987-4797. Out-of-state buyers must have firearms shipped to an FFL in their home state. Firearms & ammunition will be shipped separately. All shipping charges and any local FFL fees are the buyer’s responsibility. Buyers are solely responsible for complying with all Federal and State firearms laws applicable to their residence. Van Byars Auctions assumes no liability for purchases made in violation of any law, and no refunds will be issued for such violations. No items in Session 1 will be sold to international buyers. We do not sell firearms, receivers, or ammunition to any international purchaser. Ammunition purchased and paid in full by onsite bidders may be picked up at the auction site. Any ammunition needing to be shipped will be handled by Alan's Armory and subject to a $10 handling fee, plus any and all shipping charges which are the buyer’s responsibility. ADDITIONAL TERMS AND CONDITIONS: By registering to bid or placing a bid, you agree to be bound by these Terms & Conditions, as well as any additional terms announced at the auction or posted by Proxibid.com. All internet bids carry the same legal and binding effect as if you were physically present at the auction. Statements made by the auctioneer on sale day take precedence over all printed or online material. While all information is believed to be accurate, there are no guarantees - expressed or implied. 1. AS-IS, WHERE-IS – ALL SALES FINAL • All property is sold “AS IS, WHERE IS.” No returns, refunds, or exchanges. No exceptions. All Sales Final. Bidder acknowledges and understands that no items may be returned after purchase. • Buyers are responsible for determining condition, age, authenticity, value, or any other factor before bidding. Please read all descriptions and view all photos. • Public inspection is available - bidders are encouraged to examine items in person when possible. We try our best to accurately describe the items in the auction, however, it is ultimately the responsibility of you, the buyer, to make yourself aware of the condition of any and all items you may have interest in. • Van Byars Auctions may provide descriptions in advertising, online, or at the auction, but these are for reference only and not a warranty or guarantee. • In no event shall Van Byars Auctions. be liable for implied warranties of merchantability or fitness for a particular purpose. 2. OFF-SITE & ONLINE BIDDING • Bidders participating remotely acknowledge they may not have the same ability to inspect items as on-site bidders. • The auction company will make every effort to provide accurate descriptions, but is not responsible for errors or omissions unless a material and intentional misrepresentation has occurred. Please read all descriptions and view all photos. We try our best to accurately describe the items in the auction, however, it is ultimately the responsibility of you, the buyer, to make yourself aware of the condition of any and all items you may have interest in. • Van Byars Auction provides internet pre-auction and live internet bidding as a service to our customers. Under no circumstances will Van Byars Auctions be held responsible for internet outages, bidding software malfunctions, missed bids, delays in transmission, or any other technical issues. The auctioneer is not liable for any failure of the internet or bidding platform to function properly. We strongly recommend you do not bid using a mobile device. For best results, we recommend using a hard wired computer. • To ensure your bid is recognized, consider using the proxy-bid feature and submit your maximum bid at least 24 hours before the auction. • As a registered bidder you are responsible for each and every bid and your account, all bids placed on your account will be binding. 3. AUCTIONEER’S RIGHTS Van Byars Auctions reserves the right to: • Withdraw or re-catalog any items. • Accept or reject any bid. • Resolve any disputes at their sole discretion.
