FALL VIRTUAL AUCTION TERMS & CONDITIONS

NOTICE
By registering and bidding, all bidders acknowledge that they have read, understood, and agree to be bound by these Terms & Conditions. Bidding constitutes acceptance of these terms.
AUCTION FORMAT & BIDDING
This is a Live Virtual Auction conducted online through Heartland Machinery Auctions’ approved bidding platforms.
The Auctioneer acts solely as an agent for the seller(s) and is not responsible for default by either seller or buyer.
In the event of internet disruptions, bidding errors, or platform malfunctions, the Auctioneer reserves the right to pause, reopen, or cancel bidding on any lot at its sole discretion.
The record of sale kept by the Auctioneer shall be final in all disputes.
Sarpy County Fairgrounds Equipment Removal & Storage Policy
All items located on the Sarpy County Fairgrounds in Springfield, NE — including most skid steer attachments and all Carry-On Trailers — must be removed by 12:00 PM CST on November 1st. A telehandler will be available onsite for loading assistance until that date.
Any items remaining on the lot after 12:00 PM CST on November 1st will incur a $25 per day storage fee, and buyers will be responsible for arranging their own loading and transportation thereafter.
All Carry-On Trailers will be sold with Manufacturer’s Statements of Origin (MSOs). MSOs will be shipped within 30 days of the auction’s conclusion, and tracking numbers will be provided once shipped.
All other items are located throughout Eastern Nebraska and Western Iowa and have been photographed and videoed by Heartland Machinery Auctions. Please be sure to verify each item’s location prior to bidding, as each listing clearly displays its location.
You will need to call 531-215-2900 to schedule an appointment for loading. All items must be paid in full prior to loading. No payments will be accepted onsite.
BUYER’S PREMIUM
A Buyer’s Premium will be added to all successful bids as follows:
10% on the first $50,000 of the final bid price.
An additional 3% on any amount exceeding $50,000.
Examples:
$25,000 = $2,500 BP (10%)
$50,000 = $5,000 BP (10%)
$75,000 = $5,000 (10% of first $50,000) + $750 (3% of remaining $25,000) = $5,750 BP (7.67%)
$100,000 = $5,000 (10% of first $50,000) + $1,500 (3% of remaining $50,000) = $6,500 BP (6.5%)
$200,000 = $5,000 (10% of first $50,000) + $4,500 (3% of remaining $150,000) = $9,500 BP (4.75%)
PAYMENT
No onsite payments will be accepted. Credit Card Fee: All credit card payments are subject to a 4% processing fee, which will be added to the total invoice amount.
Accepted payment methods: Wire Transfer, Certified Check, or Credit Card (invoices up to $5,000 only).
Payments made by check will require funds to fully clear before any equipment is released. Clearing can take up to seven (7) business days.
All invoices must be paid in full within 3 business days of the auction.
Once payment has been received and cleared, buyers will be issued a “Paid in Full” invoice. This document will include the complete address of the equipment and the seller’s contact information to schedule pickup directly.
No items will be released until payment is received and cleared in full.
TITLED ITEMS
Titles will be mailed via UPS with tracking provided.
Auctioneer reserves up to 30 business days for delivery of titles.
If an item is sold as “No Title”, no title will be provided.
LOCATION OF ITEMS
Equipment is located at seller premises across Nebraska & Iowa.
Each lot listing includes the city and ZIP code for freight/shipping calculations.
Buyers are solely responsible for arranging pickup, transport, and freight.
INSPECTION
Equipment is available for inspection by appointment only.

REMOVAL
All items must be removed no later than Friday, November 7th, 2025 @ 4:00 PM CST.
Removal and loading are the sole responsibility, risk, and expense of the buyer.
After full payment has been confirmed, buyers will receive the seller’s contact information and location details in order to schedule pickup.
Items not removed by the deadline are subject to storage fees of $25 per item, per day.
Auctioneer and Seller assume no responsibility for accidents, delays, theft, or damages during removal or transport.
CONDITION OF ITEMS
All items are sold “AS IS, WHERE IS, WITH ALL FAULTS.”
No warranties, guarantees, or representations of any kind are made by Auctioneer or Seller.
Buyers are strongly encouraged to inspect equipment prior to bidding.
Once declared sold, the purchaser assumes full responsibility for the item.
The auctioneer is not responsible for any incorrect description, genuineness, authenticity of, or defects, in any lot, and makes no warranty in connection there with. No sale will be set aside for allowance made on account of any incorrectness error in cataloging, or any imperfection not noted. No deduction allowed on damaged articles, all goods being exposed for public exhibition, and sold “as is” and without recourse.
THE LISTING IS ONLY A GUIDE AND MAY NOT BE ACCURATE IN ANY WAY. EVERY ITEM WILL SELL “AS IS” “WHERE IS.” PLEASE INSPECT THE EQUIPMENT PRIOR TO BIDDING, ALL SALES ARE FINAL.
SALES TAX
Nebraska and Iowa sales tax will be applied where applicable.
Tax rates will be determined by the jurisdiction in which each item is located, based on the applicable city and ZIP code at the point of sale.
Buyers claiming exemption must provide all required state resale or exempt sale certificates (including, but not limited to, Nebraska Form 13 or Iowa 31-014) prior to payment.
DISPUTES
If a dispute arises between bidders, the Auctioneer may reopen bidding or resolve the matter at their sole discretion.
The Auctioneer’s decision shall be final and binding.
ADDITIONAL TERMS
Announcements made by the Auctioneer on sale day supersede all prior terms, listings, and advertisements.
