TERMS & CONDITIONS: This is a "No Reserve" Chapter 7 Bankruptcy Trustee Ordered Auction CASE NO. 17-01459-JMM. All registered bidders name, address, phone numbers may be given to the Chapter 7 Trustee/Court at their request. By submitting a bid, whether in person or over the internet, you agree that: You have read the terms and conditions of the auction, you agree to pay the disclosed buyer’s premium, and applicable sales taxes, and shipping if required. Placing a bid is a legal binding contract to purchase. A buyer’s premium of 13% will be added to the final bid/hammer price for all credit/debit card purchases, or 10% for purchases made by cash/check/wire transfer. The total purchase price will be the bid price plus the applicable buyer’s premium, for all sales and sales tax purposes. A 6% Idaho State Sales tax will be applied to all purchases unless the item is being shipped out of the state or a valid resale exemption certificate is provided to Corbett Auctions. The registered bidder will be the buyer and must have the legal ability to own and possess the item they purchase. Due to the registration requirements of this item, if the seller cannot complete the transfer, the firearm will be resold, and all commissions, marketing costs, and handling costs will be deducted before any refunds are considered solely at the discretion of the auction company. Corbett Auctions & Appraisals, Inc., nor their associates, sellers/consignors, warranty the safe operation/shoot ability of any firearms sold. None of the firearms sold by Corbett Auctions have been tested or warranted for firing/use. All Firearms sold are considered being sold for collectability/collector’s items. If the buyer chooses to use the firearm, the weapon must be examined by a competent gunsmith, and verified as safe, and the correct caliber, prior to shooting. Please verify that you understand the safe operation of the firearm before shooting, and follow all safety recommendations as outlined by the manufacturer. TRANSFER OF GUNS/MACHINE GUNS: All purchases of any and all lots in this auction are required to be paid in full at the conclusion of the auction. If it is found that the buyer is not legally capable of taking possession of the weapon/item, then the weapon/item will be resold. All advertising and commission cost associated with the resale of the item will be deducted from the original purchasers proceeds before a refund will be made at the leisure of Corbett Auctions. In the USA, most law abiding citizens have the ability/right to own machine guns in most states. It is the buyer’s responsibility to verify their state’s laws and understand whether they (or their entity) may legally possess the class III weapon, or weapon purchased, in the state which they reside, before bidding. A $200 Federal Tax Stamp fee for the transfer from the seller to the buyer will be paid by the buyer. Gem State Arms, Nampa, Idaho, 208-467-0010, will assist in the preparation of paperwork to transfer the machine guns from the current owner to the new owner. All shipping and packaging costs will be at the expense of the Buyer (See Shipping Terms). Gem State will not be in possession of the weapon but will facilitate the required forms in order to make the transfer. Machine gun transferred out of state will necessitate the use of a licensed Class III dealer to receive the weapon. Delivery of the machine gun is dependent upon B.A.T.F.E transfer processing time and is at the leisure of the B.A.T.F.E. The Buyer must provide Gem State with all required identification and transfer information to facilitate the transfer. All Proceeds from the auction will be held by Corbett Auctions & Appraisals, Inc. in their Trust account, until the transfers have been accomplished for the security of both the buyer and the seller. To complete the purchase of a Class III Firearm to a nonlicensed individual, you will need 2 passport photos, 2 sets of fingerprints, 1 ATF Form 5330.20 Certificate of Compliance and the appropriate BATFE Form completed in duplicate, including the signature of your local Chief Law Enforcement Officer. Gem State Arms will assist with the supply all the proper forms upon acceptance of your winning bid. If there are any State or local forms required you will be responsible for obtaining these. If you are a non-licensed individual the BATFE transfer fee for all NFA firearms (Machine Gun, Destructive Device, Silencer, Short Barreled Rifle, and Short Barreled Shotgun) is $200.00 with the exception of those narrowly classified as Any Other Weapon (AOW ) which has a transfer fee of $5.00. AOWs may include pen-guns, cane guns, and certain pistols with vertical front pistol grips. These fees must be paid before any transfer paperwork can be submitted to BATFE as well as any other outstanding balances related to your Class III firearm purchase. PLEASE VERIFY that you reside in a state where it is legal to possess and own the weapon you will be bidding on, before bidding. Transfer time of machine guns is dependent upon your current licensing status, if any, and the BATFE, which can take up to one year. 1. By registering to bid or placing a bid you agree to be bound by ALL of the terms & conditions and any other announced terms and conditions of sale. All Internet bidders agree that bids placed on the Internet shall have the same legal effect as if they were in attendance at the auction in person. 2. All property is sold 'AS-IS' 'WHERE-IS', and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Corbett Auctions & Appraisals may, attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations or warranties. In no event shall Corbett Auctions & Appraisals be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. All Internet Bidders agree to pay a buyer's premium equal to Ten Percent (10%) of the hammer price of each item they purchase. Under state law sales tax will be collected on this amount unless the items are exempt and the buyer has filed a sales tax exemption form with Corbett Auctions & Appraisals. 4. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Corbett Auctions & Appraisals shall endeavor to describe in detail each item and any pertinent information about it. Corbett Auctions & Appraisals will not be responsible for any errors or omissions in the description of the merchandise. Bidder agrees that everything is sold as is and that they may not return any item they purchase. 5. Corbett Auctions & Appraisals is providing proxy bidding and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Corbett Auctions & Appraisals or anyone else if the Internet service fails to work correctly before or during the live auction. Corbett Auctions & Appraisals will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Corbett Auctions & Appraisals reserves the right to withdraw or re-catalog items in this auction. 6. The auctioneer shall advance the bidding at his own discretion and may reject a nominal advance. Corbett Auctions & Appraisals may withdraw any item before or during the auction. Should a tie or a dispute arise between two bidders, the auctioneer may, at his discretion, reopen the bidding until the property is sold. From time to time Corbett Auctions & Appraisals may accept items with reserve prices and reserves the right to bid on behalf of the owner on items on which there may be a reserve. The record of the auction made by Corbett Auctions & Appraisals shall be conclusive. 7. When the auctioneer says 'SOLD', Bidder assumes full responsibility for the merchandise. 8. All property shall be removed from the premises by the Buyer at her/his own risk and expense ON AUCTION DAY, UNLESS SPECIAL ARRANGEMENTS HAVE BEEN MADE WITH CORBETT AUCTIONS & APPRAISALS, the seller, and the landlord. 9. Bidder agrees that, this agreement shall be governed by the laws of the state of Idaho, and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Ada County, Idaho. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Corbett Auctions & Appraisals and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in Ada County, Idaho. 10. Corbett Auctions & Appraisals may refuse a bidder number to anyone for any reason. Bidder agrees to provide any identification Corbett Auctions & Appraisals may request including but not limited to: drivers license, photocopies of credit cards, Social Security card or US Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 11. We want you to be happy with your purchases.
