GUNSLINGER AUCTIONS – TERMS AND CONDITIONS OF SALE
By registering to bid and/or placing a bid, whether in-person, online via Proxibid or other platforms, absentee, or by phone, you (“Bidder” or “Buyer”) acknowledge that you have read, understood, and agreed to be legally bound by the following Terms and Conditions. These Terms govern all auctions conducted by Gunslinger Auctions (“Auction House”). All sales are subject to these Terms in addition to any announcements made by the Auctioneer on the day of sale, which shall supersede any conflicting terms herein.
1. AUCTION CONDUCT
1.1 The Auction will be conducted in numerical order and items sold to the highest qualified bidder. The Auction House reserves the right to withdraw any item prior to its announcement as sold.
1.2 Simultaneous in-person, absentee, phone, and online bidding is permitted. Buyers are fully responsible for any bid placed on their behalf, regardless of method.
1.3 A bid is a binding legal offer to purchase. Once the Auctioneer announces “SOLD,” the high Bidder is deemed the Buyer and assumes full responsibility for the item. All sales are final; no bid retractions will be accepted.
1.4 The Auction House shall not be held responsible for any "missed bids" or bids unseen by the Auctioneer.
2. REGISTRATION & PARTICIPATION
2.1 A valid credit card is required to register on Proxibid.
2.2 All participants must provide their full name, address, phone number, and email address. Bidders must register at least 24 hours prior to the auction.
3. PAYMENT TERMS
3.1 Payment is due in full within three (3) calendar days following the conclusion of the auction.
3.2 Accepted forms of payment include U.S. currency, checks, Visa, MasterCard, Discover, and American Express. Charges will include the hammer price, a 25% Buyer’s premium, shipping costs, taxes, and any applicable fees.
3.3 Credit cards may be pre-authorized to confirm sufficient available credit. Debit cards may reflect a temporary hold.
3.4 Buyers seeking to use an alternative payment method must contact the Auction House prior to the auction.
4. TAXES & FEES
4.1 Sales Tax: Proxibid is responsible for collecting sales tax in accordance with applicable jurisdictional laws. The Auction House has no control over tax calculations or exemptions. Contact Proxibid directly for sales tax exemption.
4.2 California Excise Tax: A mandatory 11% excise tax will apply to any firearm sold and delivered in California, as imposed by state law. This tax applies to the full transaction value, including premiums and shipping.
4.3 DROS Fee: California Buyers are subject to a $47 fee for the Department of Justice firearm background check.
5. FIREARM REGULATIONS & TRANSFERS
5.1 All post-1898 firearms must be transferred through a Federal Firearms Licensee (FFL). Buyers must provide a valid FFL to gunslingerauctions@yahoo.com referencing their name and bidder number. The Auction House will not contact FFLs; this is the Buyer’s sole responsibility.
5.2 No firearm will be released or shipped without full payment and receipt of required documentation.
5.3 California residents must comply with all local and state firearm laws, including registration and waiting periods. Out-of-state Buyers must arrange transfer through a licensed dealer in their jurisdiction.
5.4 Firearm Type Designations:
• C&R: Qualifies as Curio & Relic. Restrictions apply, especially in California.
• PPT: May be processed at our Orange, CA location. Exempt from handgun roster. Not valid if shipped.
• Modern: Subject to California restrictions. Verify eligibility before bidding.
• Out of State Only: Not eligible for sale to California residents (unless exempt).
• Pre-98/Antique: ATF-exempt. May ship directly with no registration required.
6. Firearms Disclaimer
6.1 The Auction House has not fired any firearm in this auction. As such, we cannot and do not warranty functionality. Printed statements or descriptions by staff are provided in good faith and are a matter of opinion only and positively comes with no warranty or guarantee of accuracy. We are not responsible for imperfections not mentioned in the descriptions. If you have any questions on a particular firearm listed in the auction catalog, please contact us before bidding.
7. SHIPPING & HANDLING
7.1 Shipping is handled in-house via FedEx, UPS, & USPS. All shipments include insurance. Estimated shipping times: 4–6 weeks post-auction.
7.2 Approximate Shipping Rates (subject to change based on location):
• Long guns: $75–$95 + $40 per additional
• Handguns: $40–$50 + $10–$20 per additional
7.3 Items will not ship without full payment and FFL documentation. We do not ship high-capacity magazines to California or jurisdictions where prohibited.
7.4 Buyers exporting items internationally are solely responsible for compliance with applicable export laws and costs.
8. ITEM PREVIEW & AUCTION DETAILS
• Preview Hours: Tuesday–Friday 10am–5pm; Saturday 10am–4pm at 1740 W. La Veta Ave, Orange, CA 92869.
• Auction Location: Highway 39 Event Center, 1563 S. State College Blvd, Anaheim, CA 928069
• Auction Start Time: Doors open @ 9:00 AM Pacific (In-Person Registration), Auction starts 10:00 AM Pacific.
9. DISPUTES & LIABILITY
9.1 The Auction House’s records shall be conclusive in the event of a bid dispute. The Auctioneer reserves discretion to determine the winning bid and may refuse any bid deemed injurious to the auction.
9.2 In-person bids take precedence over online or absentee bids.
9.3 All items are sold “as-is, where-is”, with no warranties expressed or implied. The Auction House makes no guarantees regarding item condition, safety, or fitness for use.
9.4 Buyers are advised to inspect all firearms through a licensed gunsmith before attempting use.
10. RETURNS, DAMAGE, & ABANDONMENT
10.1 Returns are allowed only in cases of unintentional material misrepresentation of an item.
10.2 All shipped items are insured. If an item is received damaged it is the Buyer's sole responsibility to pursue a claims case with the shipping company.
10.3 Items not picked up or shipped within 30 days of auction close will incur a storage fee of $5 per item, per day. After accumulated fees exceed the item’s purchase price, the item will be considered abandoned and become the property of the Auction House, without refund.
11. DEFAULT & REMEDIES
11.1 In the event of Buyer default, the Auction House may resell the item and recover any deficiency, plus associated costs, fees, and attorney’s fees. All remedies under California law are reserved.
12. JURISDICTION & GOVERNING LAW
12.1 This Agreement is governed by the laws of the State of California. The Buyer submits to the jurisdiction of the Superior Court of California, County of Orange, or the U.S. District Court for the Central District of California, Southern Division.
13. GENERAL PROVISIONS
13.1 Severability: If any provision is deemed invalid, all remaining provisions shall remain in full force and effect.
13.2 Headings: Section titles are for reference only and have no substantive legal effect.
13.3 No Warranty: ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED.
13.4 Limitation of Liability: Gunslinger Auctions shall not be liable for any direct, incidental, or consequential damages arising from participation in the auction or use of purchased items.
