Special Terms
Terms & Conditions:
1. Acceptance of Terms: By participating in the auction, bidders agree to these Terms & Conditions, including any announcements or notices made during the auction.
2. Registration: Bidders must be at least 18 years old for long guns and 21 years old for handguns. A valid photo ID, address, phone number, and email are required for registration at least 48 hours before the auction.
3. Title Transfer: Ownership transfers to the highest bidder when the auctioneer’s hammer falls. Buyers assume all responsibility at that point.
4. Bidding: The auctioneer has the final say on bids and may reopen bidding in case of disputes. In-person bids take precedence over internet or absentee bids. LSB is not responsible for technical issues affecting bidding.
Consignors are prohibited from bidding on their own items. Any attempt to manipulate the auction may result in item withdrawal and further action.
The auctioneer determines the highest bidder and may reopen bidding in case of disputes. In-person bids take precedence over Internet or absentee bids. In tie cases between internet bids, the auctioneer has the final decision. LSB may remove disruptive attendees and is not liable for bid errors or technical failures. If utilities or internet services are interrupted, the auction will pause until restored. Consignors may not bid on their own items or use agents to do so. Violations may result in item withdrawal.
Absentee Bidding: LSB accepts absentee bids via mail, phone, email, online, or in-person. Bids must be on the appropriate form with clear lot numbers and maximum bid amounts. In case of identical bids, the earliest received bid takes priority. Bids not in proper increments will be rounded down to the nearest increment.
Online Bidding: Online bidding is available through LSBauctions.com and third-party platforms. Additional platform fees may apply. In-person bids take precedence over online bids. Due to the fast pace, the auctioneer's call is final, even if an online bid is not processed in time. Accidental bids remain the bidder's responsibility.
Telephone Bidding: Phone bid requests must be submitted at least three days before the auction. While LSB will attempt to accommodate requests, phone lines are not guaranteed. Contact LSB at (307) 527-8915 for arrangements.
Bid Results: Only buyers will be contacted. Invoices are sent within 72 hours, including applicable fees. Bid verification is available two business days after the auction. LSB does not share bidder information.
6. Reserve Prices: Some lots may have a confidential reserve price. The auctioneer may bid on behalf of the seller until the reserve is met and may indicate if bidding against the reserve.
7. Buyer's Premium and Taxes: A 15% discounted buyer’s premium applies to phone, in-person, and direct Live.LSBauctions.com bids paid with cash, check or wire transfer. A 19% buyer’s premium applies to phone, in-person, and Live.LSBauctions.com bids paid by card. Third-party bidding platforms may charge additional fees to be paid by buyer. Tax-exempt buyers must provide valid resale permits to LSB at least five days before the auction. Refunds for taxes are possible within four business days if proper documentation is provided.
8. Payment: Accepted payment methods include Visa, MasterCard, Discover, American Express, checks, wire transfers, money orders, and cash. Invoices must be paid within 14 days of their receipt. Late payments incur storage fees of $50 per item per month. After 90 days, unpaid items may be resold, with proceeds applied to outstanding balances. A 25% restocking fee applies if a transaction is canceled.
Credit Cards: Online payments are accepted only from the buyer named on the invoice. Chargebacks are not permitted. Credit card fraud will be reported to law enforcement.
Checks: Returned checks incur a $35 fee. First-time check payments may require a bank letter of credit.
Non-Payment: Failure to pay may result in legal action and a permanent ban from future auctions.
9. Shipping: Shipping costs are the buyer's responsibility and billed on the invoice. Modern firearms must be shipped to an ATF-licensed FFL dealer. C&R firearms may be shipped to the address on a C&R license if allowed by state law. Handguns ship via UPS 2-Day Air, and long guns via UPS Ground.
FFL Responsibility: Buyers must arrange transfers with their receiving FFL, who must submit a current FFL copy for each invoice to sales@LSBauctions.com.
International Shipping: LSB does not ship firearms outside the U.S. International buyers must arrange export and assume all risk and duties. Oversized items may incur additional fees.
Shipping Damages: Report damages immediately with photos of the packaging before and after opening. Claims require evidence for processing.
Returns: Non-damage or non-misrepresentation returns are the buyer’s responsibility. Approval is required before returning items.
Address and Timing: Verify your shipping address on the invoice. Items generally ship within 1 to 14 business days after payment and FFL receipt.
Insurance and Oversize Fees: Insurance will be billed at 1% of the hammer price. Oversized items may incur additional fees.
Ammunition: Ammunition ships separately and may incur extra charges.
Delivery: All firearm shipments require an adult signature. Buyers are responsible for redelivery fees if needed.
10. Protected Species: LSB is not responsible for items containing protected species materials (e.g., ivory, tortoise shell, crocodile skin, coral). Buyers must comply with all applicable laws, including CITES, ESA, and MMPA.
Some states, including California, New York, and New Jersey, restrict the sale of such items. International buyers should check their country's import laws before bidding. Obtaining permits or licenses is solely the buyer’s responsibility, and LSB cannot assist with this process.
Delays or inability to obtain necessary permits will not justify canceling a purchase or delaying payment. Buyers agree to adhere to all restrictions as a condition of the sale.
11. Warranties & Representations: Bidders are responsible for requesting information and inspecting items before bidding. In-person bidders must note discrepancies before leaving. Online or absentee bidders should inspect items upon receipt and report major issues within 28 days of the auction. Late payments or actions that delay delivery void the guarantee.
LSB guarantees against errors in descriptive facts (e.g., manufacturer, model, caliber) and major condition discrepancies (+/- 20% finish or bore condition). This limited guarantee does not cover minor imperfections, natural wear, or operational issues. Items sold "as-is" or for parts have no guarantee.
Buyers may submit written refund requests within 28 days for valid discrepancies. Approved returns must be received within 7 days, and refunds cover only the purchase price, minus a restocking fee of up to 25%.
Buyers are solely responsible for firearm safety. LSB recommends a qualified gunsmith inspect firearms before use and assumes no liability for damages, injury, or death resulting from misuse or defective merchandise.
12. Firearms Transfer and Eligibility: All firearm transfers comply with applicable laws. Buyers must ensure they can legally own firearms before bidding. Ineligibility does not void the purchase, and a 25% restocking fee applies for failed transfers.
Buyer of Record: Firearms transfer only to the registered buyer; no re-invoicing is allowed.
13: Denial of Transfer: If an FBI/NICS check results in a denial, buyers remain responsible for payment. The firearm will be resold at a future auction. Appeals are allowed with a 30-day grace period, after which storage fees apply.
In-Person Pickup: Only registered buyers can pick up firearms. Modern firearms require valid Wyoming paperwork. C&R firearms need a valid C&R license, and antiques require photo ID for those 18+.
NFA Transfers: NFA items require an FFL and SOT for processing. Payment is required even if ATF denies possession.
13. Liability: LSB is not responsible for errors in descriptions or any resulting losses. The auction may be canceled or postponed at LSB’s discretion.
Safety: All firearms are sold as collectibles without safety guarantees. Buyers should have them inspected by a certified gunsmith before use.
Denial of Sale & Withdrawal: LSB reserves the right to deny sales or withdraw items without liability.
14. Governing Law: All claims related to LSB or its Terms & Conditions are governed by Wyoming law. Disputes must be resolved in Park County, Wyoming, and buyers waive objections to the jurisdiction. LSB’s failure to enforce any rights does not constitute a waiver. Waivers must be in writing and signed. If any part of the Terms is deemed invalid, remaining provisions remain enforceable. These Terms benefit LSB and its affiliates, with no third-party beneficiaries.
