Terms of Sale Harris Estate Services, LLC - Terms & Conditions - Timed Online Auctions 1. GENERAL --- It is the bidder's responsibility to evaluate all aspects of authenticity, originality, condition and imperfections before bidding. Although we make every effort to describe all items accurately, Harris Estate Services, LLC is not responsible for errors or omissions in description, genuineness or authenticity, and fault or defect in any property. All property is sold as shown and “as-is” and bidder agrees that they shall not return any property won. --- No warranties or representations whatsoever are given by Harris Estate Services, LLC to any buyer in respect to any property. --- Harris Estate Services reserves the right to add or delete lots throughout the auction. --- Harris Estate Services reserves the right to decline bidding registration to any person or entity. --- Disputes are heard in Greenville County, South Carolina. 2. PREVIEW --- A preview for the auction event is generally held. The preview time(s) and place(s) are indicated in the “Preview Date & Times”section under the “Terms of Sale” tab. BUYER'S PREMIUM --- Unless otherwise noted in a particular lot's description, a buyer's premium of 15% shall be added to each sold lot's winning bid hammer price. 4. AUCTION RESERVES --- Whether on not a reserve price is indicated for the lot, all lots are offered with reserve and auctioneer may withdraw any lot at any time until the lot is sold. --- The auctioneer may advance bidding. 5. INTERNET BIDDING --- Harris Estate Services LLC is not responsible for internet connection problems or auction platform (Proxibid or LiveAuctioneers) issues that cause missed bids. Internet bidders who desire to make certain their bid is accepted should use the maximum bid feature and leave their maximum bid at least 24 hours before the auction ends. --- Bids placed within the last 2 minutes of bidding will reset the remaining bidding time to 2 minutes for the lot being bid on. 6. WINNING BIDDER NOTIFICATION ---The bidder submitting the highest bid shall be the winning bidder and will be notified by email. ---The record of sale, as kept by the auctioneer, will be taken as absolute and final. 7. FORMS of PAYMENT --- Visa, MasterCard, Discover, American Express , and cash money are accepted. Unless prior authorization for another payment method has already been approved by Harris Estate Services, a bank wire transfer is required and accepted for payments over $2,000. We will contact you by phone and by email to arrange for wire transfer. --- Checks, money orders, Paypal, Venmo or other forms of payment will not be accepted without prior approval by Harris Estate Services, LLC in writing at least two (2) days before the auction event ends. SALES TAX --- Sales tax will be automatically determined and calculated at the time of invoicing based on a variety of factors including: State, City & County jurisdiction requirements, ship to/from addresses and category of item purchased. --- Bidders with a resale tax number must register that number with the auction platform (Proxibid or LiveAuctioneeers) in order to have sales tax removed from the invoice. 9. AUCTION CHECKOUT --- Winning bidder will receive a detailed and itemized invoice by email soon after the auction closes. --- Unless prior authorization for another payment method has already been approved by Harris Estate Services, a bank wire transfer is required and accepted for payments over $2,000. We will contact you by phone and by email to arrange for wire transfer. --- Winning bidder paying with card should use the checkout feature associated with the invoice to make payment. Bidder is responsible for paying any card processing fees charged by the auction platform. Card payment MUST be made 24 hours prior to being picked up. We do not accept card payments at pickup. --- Winning bidder desiring to make a cash payment must provide name and paddle number to Harris Estate Services by text message at 864-238-2942 (preferred) or by email message to harrisestateservices@gmail.com by the end of auction bidding (auction close). --- If notification from winning bidder of bidder's intention to make cash payment is not received by midnight after the auction ends and if card payment has not already been made, then Harris Estate Services will charge the card on file. --- See sections 11 (Paid Property Pickup) and 12 (Shipping) for information on those subjects. 10. NEED FOR TIMELY PAYMENT --- Winning bidder paying by card should make the payment 24 hours before the pickup time. Card payments will NOT be accepted at the PAID PROPERTY PICKUP. --- Property being shipped will not be released to the shipper until card payment funds have settled in the auctioneer's account (usually within 24 hours after card payment is initiated). The UPS store will reach out to you once they receive the property and will help you determine the most economical shipping option by UPS or US Postal Service options.. Winning bidder will pay shipping and insurance costs directly to UPS store 3018 --- Complete payment is required within 48 hours after the auction closes (property sold). Property not paid for within 48 hours of auction close shall be deemed “unpaid property” and, in that case, winning bidder forfeits the unpaid property. 11. PAID PROPERTY PICKUP --- Information about PAID PROPERTY PICKUP dates and times is given in the “Checkout Date & Times” section below tab and on your invoice. --- Your PAID PROPERTY should be picked up at the address, date(s) and time(s) indicated on your invoice. --- Winning bidder is responsible for packing supplies and for packing and loading all property won. --- Winning bidder is responsible for providing suitable help to move and load heavy, bulky items of property won. --- Harris Estate Services LLC is not responsible for damage that may occur to property at pick up. --- Paid property that is not picked up during the PAID PROPERTY PICKUP period, if not too large such as furniture, will automatically be transferred to the UPS store (third-party shipper) and property can be picked up at third-party shipper's location or shipped at bidder's discretion. The UPS store may charge a fee of $10 for pick up at their location. UPS store information is given under "12. Shipping" below. 12. SHIPPING ---Property identified as "LOCAL PICKUP ONLY" in the description will not be shipped. ---Paid property to be shipped will be transferred to our third party shipper (UPS Store 3018) following the PAID PROPERTY PICKUP period. ---The UPS store will reach out to you once they receive the property and will help you determine the most economical shipping option by UPS or US Postal Service options.. Winning bidder will pay shipping and insurance costs directly to UPS store 3018. ---UPS store 3018 can be reached at (864) 268-6068 or by email at store3018@outlook.com. They are generally available 9 am – 6 pm, Monday – Friday. Their physical address is UPS Store #3018, Hampton Village Shopping Center, 2801 Wade Hampton Blvd., Taylors, SC 29687. ---LARGE ITEMS: For shipping of large items of property (furniture, etc.) the winning bidder must arrange for a shipper to pick up the property by the end of the PAID PROPERTY PICKUP period given in the auction description. Measurements are provided in the lot description and we can provide an estimate of weight upon request. --- The winning bidder may also arrange shipping for any lot(s) by another shipper other than our third-party shipper (UPS store 3018). In that case, the bidder must arrange to have their shipper pick the property up during the PAID PROPERTY PICKUP period given for the auction event. There will be an additional charge of $100 for Harris Estate Services to meet another shipper other than our third-party shipper for pickup AFTER the PAID PROPERTY PICKUP period is concluded. 13. REMOVAL of PROPERTY ---Unless other arrangements are made with Harris Estate Services beforehand, paid property must be removed from the sale premises no later than two (2) business days following the close of auction date. Property not removed shall be deemed abandoned by winning bidder and winning bidder forfeits any right to the property. ---Harris Estate Services, LLC shall have no liability for any damage or loss to property left on the sale premises for more than two (2) days following the close of auction date. 14. AGREEMENT TO TERMS and CONDITIONS --- Your bidding at this Auction event indicates that you have read and accept these Terms of Sale.
