GENERAL: ALL SALES ARE FINAL and all property is sold as shown and 'AS IS,' with all faults, imperfections, and errors of description. While Harris Estate Services, LLC, its employees and representatives, make every effort to accurately describe all property offered for sale, it is incumbent upon the bidder to satisfy themselves in all areas of authenticity, originality, condition and imperfections. We strongly encourage bidders to preview items. Harris Estate Services, LLC, their employees and/or agents are not responsible for errors or omissions in description, genuineness or authenticity, and fault or defect in any property. By bidding bidder acknowledgese that condition descriptions are often subjective and any property offered at auction may be subject to normal wear consistent with age that may not be specified in a condition description. ---No warranties or representations whatsoever are given by Harris Estate Services, LLC, its employees and/or agents, to any buyer in respect to any property. ---It is the buyer's responsibility to know how much shipping costs are before bidding. ---Harris Estate Services reserves the right to add or delete property lots throughout the auction. ---Property sold at timed auctions must be picked-up at the assigned time--No Exceptions. 2. BUYER'S PREMIUM: Unless otherwise noted in the items description, a buyer's premium of 15% shall be added to each sold lot's winning bid hammer price to reach the total sales price. 4. SALES TAX: ---Purchases are subject to the collection of state and local sales taxes. UNLESS property purchased is exempt by state law (e.g., US coin & currency) or UNLESS the winning bidder has a reseller sales tax number for bidder's state, then sales tax for bidder's state will be charged for total purchases. ---NOTE WELL: It is the bidder's responsibility to make sure PROXIBID has your reseller sales tax number on record. If sales tax is not removed from your invoice, please notify PROXIBID of the error on your invoice. Proxibid will refund sales tax charged in error. ---For IN-PERSON PAYMENTS to have SC sales tax exemption the bidder must provide Harris Estate Services, LLC with a valid South Carolina Retail License Number and properly completed ST-8A Certificate of Exemption. 5. FORMS of PAYMENT: Visa, MasterCard, Discover, American Express and cash money. Cash money payments at pickup are accepted. Checks, money orders, Paypal or other forms of payment will NOT be accepted UNLESS previous arrangements have been made with Harris Estate Services LLC three (3) days before the auction event ends. 6. INVOICING and PAYMENT COLLECTION: CASH PAYMENTS: Winning bidder that has notified us that you will be making a CASH PAYMENT should bring cash for payment at PAID PROPERTY PICKUP (see below). The NOTIFICATION must be made by text message to 864-238-2942 or by email to harrisestateservices@gmail.com BEFORE OR BY MIDNIGHT THE SUNDAY NIGHT the auction closes. Please provide your name in the message. PAYING WITH CARD: If you want to PAY USING YOUR CARD ON FILE OR ANOTHER CARD, you may use the CHECKOUT NOW feature in Proxibid. Harris Estate Services will be notified by Proxibid when the payment is made using this method. Bidder is responsible for paying any credit card processing fees charged by Proxibid. If the name on the card is different from the name on the invoice, please provide us with that information. NEED FOR TIMELY PAYMENT: If we have not received the CASH PAYMENT NOTICE from the winning bidder or the CARD PAYMENT NOTICE from Proxibid by 9 AM on the MONDAY following auction close, then we will attempt to charge the card on file for your purchases. If we are not able to collect payment by charging your card by 9 am the day after the auction closes, then you will need to pay in cash for your item(s). We need to follow this procedure in order for the funds to clear before we release inventory to you at the PAID PROPERTY PICKUP (See below.). Bidder is responsible for paying any credit card processing fees charged by Proxibid. PAID PROPERTY PICKUP: Your PAID PROPERTY can be picked up at 12 Lexus Lane, Greenville, SC 29687 on Monday, March 24 from 10 am to 5 pm. COMPLETE PAYMENT: Complete payment is required within 48 hours after the auction closes (property sold). Property not paid for within 48 hours of auction close shall be deemed noncollectable and, in that case, winning bidder forfeits the unpaid property. 7. Property PICK UP: Property paid for may be picked up at the date, time and place noted above under the heading “Checkout Date & Times”. ---PLEASE NOTE WELL THAT BUYER IS RESPONSIBLE FOR LOADING ALL BUYER'S PROPERTY AT PICK UP. PLEASE ALLOW TIME TO LOAD LARGE ITEMS AND BRING HELP FOR LOADING HEAVY ITEMS. LOADING IS FROM GROUND LEVEL. THERE ARE NO STEPS. We suggest using local contractors that provide moving services for furniture if you are unable to move items yourself. Harris Estate Services LLC is not responsible for damage that may occur to buyer's property when property is loaded. ---Buyer is also responsible for packing breakable items such as glass, etc and for providing boxes and packing materials. ---PROPERTY THAT THE UPS STORE WILL SHIP AND THAT IS NOT PICKED UP WILL AUTOMATICALLY GO TO THE UPS STORE IN TAYLORS, SC WITHIN 24-48 HOURS AFTER THE SCHEDULED PICKUP TIME IS OVER. You may pick up your property at the UPS store at your convenience or request the UPS store to ship your property. PLEASE NOTE THAT THERE IS A SMALL FEE CHARGED BY THE UPS STORE FOR STORAGE/HANDLING SERVICE. ---PLEASE NOTE THAT LARGE ITEMS THAT CAN NOT BE SHIPPED BY UPS MUST BE PICKED UP WITHIN TWO (2) DAYS OF THE CLOSE OF AUCTION DATE. SEE SECTION 9 “REMOVAL OF PROPERTY” BELOW. 8. SHIPPING: ---If you are paying by card and want your property shipped, your SHIPPING ADDRESS MUST MATCH the BILLING ADDRESS of the card you use to make payment. Any exception will require approval from Harris Estate Services before payment is made. ---Paid property will automatically be transferred to our third party shipper UPS Store 3018 on WEDNESDAY morning following auction close. The UPS STORE WILL CONTACT YOU once they receive the paid property. If you are not able to pick your large items up, you will need to specify a freight shipper to pick up your property for you. Please make your own arrangements with a freight shipper. Measurements are provided in the item description and we can estimate item weight for you. Please also see sections 7 and 9 of these Terms of Sale for other instructions pertaining to freight shipments. You may also need to reference the “Archived Events” section of Proxibid after the auction closes for closed lot information. ---Please note that property identified as "LOCAL PICKUP ONLY" in the description will not be shipped. 9. REMOVAL of PROPERTY: All property must be removed from the sale premises by the purchaser at their expense no later than two (2) business days following its sale at the close of auction date. ---Harris Estate Services LLC shall have no liability for any damage to property left on its premises or on the sale premises for more than two (2) days following the close of auction date. ---Unless arrangements have been made with Harris Estate Services LLC, property not removed after two (2) calendar days from the close of auction date shall be deemed abandoned by winning bidder and winning bidder forfeits any right to the property. --For property where arrangements have been made for Harris to store longer than two (2) days after the close of auction date, Harris Estate Services will charge $20 per auction lot per day for large items and $5 per auction lot for small items. ---Harris Estate Services LLC reserves the right to charge additional fees to meet a buyer for property pickup on a date earlier or later than the scheduled pick up date. 10. WINNING BIDDER: The bidder submitting the highest bid as determined by the auctioneer shall be the winning bidder / buyer. The record of sale, as kept by the auctioneer, will be taken as absolute and final in all disputes between two or more bidders. The auctioneer will determine the winning bidder and the auctioneer's decision will be binding and final. 11. RESERVES: A reserve price is a minimum price below which a lot will not be sold. ALL LOTS are offered with reserve and auctioneer may withdraw any lot at any time until the lot is SOLD. If the auctioneer withdraws a lot from bidding and does not drop the hammer on that lot, then that lot is NOT SOLD. 12. BIDDING: All property is sold by online timed auction method ONLY. Harris Estate Services LLC is not responsible for internet connection problems or website (AUCTION PLATFORM such as PROXIBID) issues that cause missed bids. ---Timed auction bidders who desire to make certain their bid is accepted should use the maximum bid (automatic bid) feature of the timed auction system and leave their maximum bid at least 12 hours before the auction ends. ---The auction end time for a specific lot will be extended if that lot receives bids right before the auction lot closes. ---We reserve the right to decline bidding registration to any person. 13. AGREEMENT TO TERMS and CONDITIONS: Your bidding at this Auction event indicates that you have read and accept these Terms of Sale.
