TERMS AND CONDITIONS OF THE AUCTION By registering to bid or placing a bid you agree to be bound by all of these terms & conditions and any other announced terms and conditions of the sale. 1. All persons participating in the auction specifically release, indemnify and save harmless Heart G Auction Service and their employees, agents, successors or assigns, against any and all claims, loss, liabilities, damages, demands, action or cause of action whatsoever in any manner arising from this action. 2. All property is sold "AS IS", and ALL SALES ARE FINAL. Property is open to thorough inspection in La Junta, Colorado by appointment only. It is the bidder's reponsibility to determine condition, age, genuineness, value or any other determinative factor including the correctness of any and all grading of coins. Heart G Auction may attempt to describe the merchandise in advertising and on the Internet with information provided to them by sources deemed reliable, but not guaranteed. Heart G Auction makes no representation and shall not be held reponsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. 3. All internet bidders agree to pay a Buyers Premium equal to fifteen percent (17%) of the hammered price of each item they purchase. If the hammer price of an item is $10,000 the buyers premium will be $1700 for a total purchase price of $11,700. Colorado State and County sales tax laws If applicable will be applied. 4. Bidders who bid understand and ackowledge that they may not be able to inspect an item as well as if they had examined it in person. It is the bidders responsibility to determine condition, age, genuiness, value or any other determinative factor. Heart G Auction shall endevor to describe in detail each item and any pertinate information about said item. Heart G Auction shall not be responsible for any errors or omissions in the description of merchandise unless it is a material or intentional missrepresentation of the item itself. Bidder agrees that everything is sold "AS IS" and they may not return any item they have purchased for any reason. If Heart G Auction agrees that an item was materially and intentionally missrepresented Heart G Auction will refund the purchase price to the bidder. Bidder agrees that under no circumstances shall Heart G Auction ever be liable to bidder for any amount greater then the purchase price of an item they purchased. 5. Heart G Auction is providing internet pre-auction and live bidding as a service to the bidder. Bidder acknowledges that this service may or may not function correctly the day of the auction. Under no circumstances shall bidder have any kind of claim against Heart G Auction or anyone else if internet service fails to work correctly before or during the auction. Heart G Auction will not be responsible for any missed bids from any source. Internet bidder who desire to make certain their bid is acknowledged should use the proxi bidding feature and leave their maximum bid 24 hours before the auction begins. Heart G Auction reserves the right to withdraw or re-catalog items in this auction. 6. The auctioneer shall advance the bidding at his own discretion. Heart G Auction may withdraw any item before or during the auction. The record of the auction made by Heart G Auction Service shall be conclusive. 7. When the auctioneer indicates sold, the bidder assumes full responsibility for the merchandise. All merchandise must be paid for by cash, Visa or MasterCard or bank wire transfer. If for any reason Heart G Auction Service does not receive payment within 5 days following the auction the bidder agrees that Heart G Auction service shall add an administrative collection fee of $1000 to the balance due. Any amount left unpaid shall accrue interest at the highest rate allowed under Colorado State law. Unless exempted by law the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Heart G Auction Service against all claims if sales tax is not collected on bidders purchases. Bidder agrees that under no circumstances he/she will initiate a charge back to his/her credit card. Title to the merchandise transfers to the bidder only when the bidders payment has been honored. 8. Internet bidders that need or desire to pick up items shall make arrangements to pick up said items within 48 hours after the close of the auction and make these arrangements know to Heart G Auction Service, or bidders may convey their pick up arrangements to the auctioneer prior to bidding. The auction company cannot arrange for packing and shipping. Packing, insurance and shipping costs are the responsibility of the bidder. All items will be insured for their purchase price. Our first priority is to deliver your new purchase in excellant condition. Merchandise not removed by bidder shall be stored at bidders expense. 9. Bidder agrees that this agreement shall be governed by the laws of the State of Colorado and hereby grant sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in Colorado. Bidder agrees and grants that service a process on them may be obtained by mailing a certified letter, containing a summons, postage pre-paid, to them at the address that they provided to register. Should a dispute arise between Heart G Auction Service and bidder, bidder waives any right to a trial or hearing in a court of law and agrees to settle any dispute through binding arbitration in Colorado. 10. Heart G Auction Service may refuse a buyers number to anyone for any reason. Bidder agrees to provide any identification Heart G Auction may request including but not limited to: drivers license, photo copies of credit cards (front and back), social security card or US passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 11. We want you to be happy with your purchases. If you have questions about the merchandise the time to ask is well in advance of the auction. All sales are FINAL and NO RETURNS are allowed. Thank you for your patronage.
