Special Terms
Sale will be conducted under the following terms and conditions: In all events the sale company is acting only as agent. The sale company or any partner, individual, or any employee thereof, should not be held legally liable for any action or suit-at-law whatsoever on the part of the consignor, the person or persons for whom sale is held or the purchaser.
Each animal offered will be sold under the following conditions, to-wit
Terms: The sale is for cash or check to be paid immediately after the animal is sold or the sale may be declared void at the option of the seller. All payments of purchase must be made to the cashier of the sale. The cashier of the sale will issue an order for presentation to the superintendent of stalls for the delivery of animals so paid for. Buyers are cautioned not to lose their orders.
Warranties: Ages, heights, marks, and other matters of that character are approximated and are not guaranteed unless expressly warranted. We endeavor to verify records and have them authentically stated, but bidders should examine for themselves, as the catalog statements may be in error. In case typographical or other errors are discovered, the auctioneer takes precedence over any printed matter in the catalog. Buyers are therefor cautioned to pay attention to the auctioneer's announcement. The person or persons for whom sale is held is the responsible party for all presentation of animals. This sale company is not responsible for any unsoundness whatsoever and no animal can be rejected by the purchaser for any circumstances nor for any reason, real or unreal. When the auctioneer's gavel falls on the final bid, the animal is sold, except where a reserve bid has been placed by the consignor.
Responsibility: Immediately after the animal is sold it will be at the sole risk and responsibilities of the buyer thereof, but possession of animal cannot be obtained by him until payment in full has been made.
Bids: The highest bidder to be the buyer and if any disputes shall arise between two or more bidders the animal in dispute shall immediately be put up for advance bids. If there is no advance then the animal shall go to the person from whom the auctioneer recognized the last bid.
Liability: Buyers and spectators are cautioned to take care of themselves while horses are being sold or shown in the sale ring. We urge all in attendance to keep clear of the arena where the horses are being sold or shown, and upon failure to do so and resultant injury therefrom, the sellers disclaim all liability. Owners of farm or property where sale is being held and the sale company disclaim all liability in case of accident to visitors, or buyers, before, after, or during the sale.
This company is authorized to decline any bid by intoxicated or disorderly parties, or by those who have defaulted on former purchases, or by any person, who in their judgment, are not reliable or responsible parties. In case any purchaser fails to pay for and receive an animal struck down to him, said sale company is authorized to accept the same amount from another person, or to accept the next highest bid, or they may if in their judgment it be to the best interest of all concerned to put the animal up for sale the second time. But, in cases where an animal is not paid for fully in cash, the consignor agrees to receive it back as unsold (without attaching any liability to the sale company) and this condition includes in its obligation the stoppage of payment of check or draft or any action of that nature.
No chip
Several yearlings in this sale have not been micro-chipped due to breeder's request. These yearlings have met USTA requirements for registration and our freeze branded. Before entering to race, current owner will need to have them micro-chipped. Cost of the procedure is $35 and any certified USTA tattoo representative will provide the service.
Notice to Buyers
Please inspect horses before sale time and make your judgment then regarding soundness, conformation, eligibility, registrations, etc. There is no guarantee regarding racing or breeding soundness on any horse offered. When the hammer falls, the horse being sold becomes the property of the purchaser, and this horse cannot be turned down by the purchaser. The sale company cannot, and will not, tolerate checks being stopped on horses purchased.
Any person buying as agent for another person or entity will be fully responsible for settlement of account should named purchaser default.
Settle for purchases during or immediately after the sale to assist the cashiers.
