Terms Please resolve any questions or issues with ELBERT GALLERY before bidding. 1.By placing a bid, you are entering into a legally binding contract with ELBERT GALLERY. If you are the winning bidder, you shall have a legal obligation to purchase the property bid from ELBERT GALLERY. Place the bid only if you need to buying the lots. In addition to the hammer price per lot, there is a 25% buyer's premium for each lot sold at auction. The winning bidders are the highest bidder acknowledged by our auctioneer. ELBERT GALLERY will have the final discretion in determining the winning bidders and in resolving any dispute between bidders. In case of any disputes after the auction, the sales records of ELBERT GALLERY shall prevail. The winning bidders must pay for the entire invoice before any items are removed or shipped. All items must be paid within three (3) business days from the auction date. GST is charged according to state regulations.The winning bidders can pay by credit card, wire transfer or Live-Payment. ELBERT GALLERY reserves the right to hold any purchase until confirmed receipt of all funds. 2.ELBERT GALLERY provides handling, packing and shipping services solely for the convenience of our bidders. We will ship the lots fifteen (15) business days after we received the full payment. We mainly use UPS or FedEx for shipping the lots. Special shipping and handling requests may be accommodated on a limited basis at ELBERT GALLERY's sole discretion and may incur additional handling charges. Large, heavy, fragile or otherwise unusual items will incur additional charges. All fees charged on original invoices sent to bidders are estimates and ELBERT GALLERY reserves the right to charge additional charges if the estimates are exceeded. By acknowledging this Agreement, Buyer agrees to any additional charges as may be necessary to accommodate special shipping and handling requests. Shipping and handling will be additional charges to Hawaii, Alaska, US Territories and Foreign Countries. ELBERT GALLERY will ship lots to foreign locations using the same classes of mail and additional postal services that it uses to ship to US locations, to the extent that such services are available. 3.The shipping carriers may also limit insurance coverage to foreign locations. Please be advised that insurance coverage may be limited or unavailable for those locations. To the extent foreign bidders are aware of alternative shipping arrangements, which may be desired to increase insurance coverage, we advise them to notify ELBERT GALLERY of such options. ELBERT GALLERY shall not be liable for any shortfall of insurance either on foreign shipments or on the non-coverage of additional invoice charges exceeding bid amounts. 4.All jewelry lots sold by ELBERT GALLERY are evaluated by a third-party authoritative appraisal company, where a professional gemmologist evaluates the weight, size and grade of the gemstone and/or metal to determine the lot's replacement value.All appraisals are for insurance purposes only and do not determine the actual value of the jewelry at auction. The sole purpose of the evaluation is to protect the buyer in the event of damage or loss of a jewelry item purchased from ELBERT GALLERY. ELBERT GALLERY is not responsible for the opinions and appraisals of any third party appraisals company and its experts. 5.Returns may only be made with written authorization of ELBERT GALLERY, at the sole discretion of ELBERT GALLERY. We do not accept any return or refund if there is no quality issue with the lots.To request a return, bidder must provide a written request within three (3) days of receipt of the lot, fully explaining the basis for the return. Under no circumstances will any amount in addition to the winning bid be refunded.We will charge a restocking fee of 20% of the total invoice value. All authorized returns must be received in the exact same condition as originally shipped to bidder, otherwise they will be returned to Buyer at Buyer's expense. Any unauthorized returns will be rejected.Refusal to accept merchandise offered by ELBERT GALLERY to bidders constitutes an unauthorized return in direct breach of these general terms and conditions. 6.ELBERT GALLERY and its consignors disclaim all warranties, express or implied, including, but not limited to, the implied warranties of merchantability or fitness for any particular purpose. There is no guarantee that the property sold is as described by the auctioneer or catalogue. Neither ELBERT GALLERY nor its clients are responsible for any description of the rarity, quality, condition, size, importance or provenance of the property. While ELBERT GALLERY representatives do their best to describe the item for sale, any oral or written representations made by the auctioneer or any ELBERT GALLERY representative are opinions only and should not be considered a warranty or representation of the sale of the property. 7.Bidders are responsible for determining the age, size, condition and value of the lots before place the bid. By bidding, you are indicating that you have inspected the lots to your satisfaction or choose not to inspect it. If ELBERT GALLERY is unable to deliver any lots to the purchaser due to fire, theft or any other reason, its liability shall be limited to the purchase price paid by the bidder for the property.
