Special Terms
We'll take payment for this auction at the pickup location in Columbus on May 12 from 2 pm to 5 pm.
If the description says you must bring adequate helpers or pay a loading help fee, and you do not bring adequate helpers, we will charge the loading help fee upon pickup and payment. This fee is not optional if you do not bring adequate help to move select items. If the fee is paid then we will help load. If you do not wish to pay the fee we will not allow you to try to move an item yourself or with inadequate help if we don't feel it can be done safely. This policy will not be up for debate upon pickup.
You must pick up during the set pickup hours or you may, at our discretion, either forfeit your items (you will be charged for them) or pick up late with a fee of $30 per furniture lot or $15 per other type of lot charged to your card on file. This is not an invitation to come late. More often than not you will forfeit your items. If shipping is available you can also have your items shipped! If you buy a lot, bring enough helpers to get everything loaded out on time. If shipping is not available and you don't pick up you agree to forfeit your items, and they will be disposed of at our discretion, meaning we will either throw them in the dumpster or take ownership of them after billing your card. Please leave yourself enough time to get all your items before the cutoff time. By bidding in this auction you authorize us to bill your card if you do not pick up, even if we dispose of your items. At the cutoff time we will close and we will ask bidders to leave, regardless of whether they have finished removing items.
You can pay by CASH or by CREDIT CARD. Because of mounting card fraud, we will not take card payments on invoices exceeding $1500 from out of town buyers paying over the phone or through the proxi system unless you receive approval from us prior to the conclusion of the auction. To receive approval email adrian@burnsbid.com and we will verify you and your card. If you spend more than $1500 please mail us a money order or certified check. Local buyers picking up can use credit cards for transactions up to $5,000. Government issued ID must match the credit card and invoice upon pickup unless prior arrangements are made.
Bring people to help you. If you buy a lot, bring a crew so you can get everything out of the home on time.
By bidding in this auction the buyer agrees to follow safe and proper moving, loading and securing procedures when handling all lots purchased in this auction, and when handling any other items at the pickup site. By bidding the buyer also agrees that he/she and any helpers have the experience, training and proper equipment needed to safely move and load the items purchased in this auction, or, if not, that he/she will employ movers that do. The bidder further holds Burns Auction & Appraisal LLC harmless for death, injury or damage to property incurred during the auction pickup. Children are prohibited at all Burns Auction pickups.
Buyers agree that any items left behind within the property after the pickup hours will be treated as abandoned and disposed of at the discretion of Burns Auction unless other arrangements are made in writing with Burns Auction during the pickup hours and that refunds will not be given. Bidders agree that they are solely responsible for confirming that all of their purchases have been removed and loaded prior to departing the sale site for the day. Bidders also agree that items left behind after pickup hours because of confusion, a mix up, oversight or any other reason will be considered abandoned and disposed of by Burns Auction without any refund to the buyer. Please check over your invoice one last time before leaving to ensure you have everything. We often clean out immediately following a sale's pickup hours and will dispose of what is left behind at our discretion.
By bidding and not picking up, bidder gives Burns Auction & Appraisal permission to transfer won lots to our shipper for shipping. IF THE DESCRIPTION SAYS SHIPPING NOT AVAILABLE WE WON'T TAKE TO OUR SHIPPER
CONTENTS of furniture lots are NEVER included in the lot unless explicitly stated.
Bring packing materials and boxes. Bring loading help. We will help as much as we are able to keep things moving quickly. But we may not be able to help with all pieces. We will not help move extremely large or bulky items. Bring help.
WE DO OUR BEST TO DESCRIBE ITEMS COMPLETELY. DO NOT BID IF YOU ARE NOT SURE, REFUNDS ARE NOT GIVEN. ALL SALES ARE FINAL! IF YOU DON"T SEE IT, IT'S NOT IN THE LOT. IF A CRUCIAL PART, ITEM OR ACCESSORY APPEARS TO BE MISSING IN THE PHOTOS, ASSUME IT IS NOT IN THE LOT. IF WE HAVE IT WE WILL SHOOT IT. WE WILL NOT REFUND YOU IF YOU ASSUME THAT SOMETHING IS PRESENT IN A LOT BUT IS NOT VISIBLE IN ANY OF THE PHOTOS. REMEMBER, IF WE HAVE IT, WE WILL PHOTOGRAPH IT. IF WE DON'T, YOU WON'T SEE IT.
DO NOT ASSUME ANY MECHANICAL OR ELECTRONIC ITEM INCLUDING WATCHES, CLOCKS, ELECTRONICS OF ANY TYPE, MOTORIZED ITEMS SUCH AS VEHICLES AND EQUIPMENT, TOOLS OR ANY OTHER ITEM FUNCTION PERFECTLY OR AT ALL. IF WE KNOW SOMETHING WORKS, WE WILL SAY SO IN THE DESCRIPTION AND TO WHAT DEGREE. IF WE KNOW OF DEFECTS WE WILL ALSO DESCRIBE THEM. WE ALSO DO NOT GUARANTEE THAT ANY OF THE ABOVE TYPES OF ELECTRONIC, MECHANICAL OR MOTORIZED ITEMS WILL WORK WHEN YOU RECEIVE THEM SHIPPED TO YOU AS THEY DID WHEN WE WERE WITH THEM. WE SELL AN ENORMOUS QUANTITY OF USED, OLD ESTATE ITEMS EACH DAY, WEEK MONTH AND YEAR AND THESE POLICIES ARE IN PLACE BECAUSE WE SIMPLY CAN NOT KNOW THE EXACT CONDITION AND DISPOSITION OF EVERYTHING WE SELL, HOWEVER WE WILL TRY OUR BEST TO DETERMINE IMPORTANT DETAILS ABOUT THE CONDITION OF ITEMS WE SELL. Diamond weights for stones in setting are approximate and are given based on measurements. Loose diamonds are weighed on a diamond scale. Statements of diamond clarity and color are also approximate, and are given to the best of our ability. Burns Auction & Appraisal is not certified as a GIA gemologist. When GIA or other reports are available on diamonds, they are given in item descriptions.
We do our best to help bidders gather and move lots. But lately we have had a surge of buyers purchasing very large items, and then showing up either alone or with completely inadequate help to move their purchases. Thus, for some large or heavy lots, we have added to the item description an added fee that we will charged to your credit card on file if you don't have adequate help to move your item. If you pay for your item, and don't have help and want that item, we're charging the fee to help. If you don't want the item you still have to pay for it, but you won't be required to pay the help fee if you abandon it. We will decide if you have adequate help. For example, if you buy a chest freezer in the basement and bring your 85-year-old father as your only helper, we're charging you for the help. That is, we define inadequate help as not enough able-bodied helpers to complete the job safely. Our number one priority is safety, our number two priority is not causing damage to the home. Inadequate help leads to accidents. If you can't get helpers for one of these items, don't bid, or pay the fee without complaint. For some items we have stated that help is not available. This means that if you don't bring help, we aren't helping and you won't be able to get your item, although you will still have to pay for it. This will apply to extremely large and/or heavy items.
You don't have to take the entire lot contents when you buy. Just take what you want. However, any dumping on or near (or anywhere else for that matter) the auction property is strictly prohibited. If you take items and then dispose of them illegally or or near the auction grounds we will charge your card a disposal fee of $200 and file a police report if necessary.
