Bidding in this auction is a binding contract to pay for all purchases and fees. Because of the type of sale, we are required to charge sales tax. All payments are due at the fall of the hammer unless otherwise specified. Unless other arrangements are made within 1 day of the auction, the creidt card used during auction registration will be charged for purchases, buyer premium and any other applicable fees. Late payments are subject to fees and penalties at the discretion of the Auction House. Be aware that invoice delinquency WILL lead to disabling of a bidder account and making all bidding unavailable on Proxibid. Payments unpaid or late will result in the account being sent to a collections agency. This can affect your overall credit scores for up to 7 years. Your bidder registration has been researched before approval for bidding at auction. The card provided on file was verified for identity purposes prior to approval. Lastly, chargeback's will be not accepted for any reason or on any purchase through Proxibid. No exceptions. All property is sold "AS IS", and ALL SALES ARE FINAL. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Mockingbird may attempt to describe the merchandise in advertising, on the internet and at the auction but makes no representations. In no event shall Mockingbird be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Mockingbird shall endeavor to describe in detail each item and any pertinent information about it. Mockingbird will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase. Mockingbird is providing internet bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly. Under no circumstances shall Bidder have any kind of claim against Mockingbird or anyone else if the Internet service fails to work correctly before or during the auction. Mockingbird will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid before the auction begins. Mockingbird reserves the right to withdraw or re-catalog items in this auction. Be aware that any display items - Jewelry necks or trays, baskets, boxes, etc. are used for display only and are the property of Mockingbird. If a display item is included in the lot, it will be noted in the description. If buyer wishes to pick up an item, arrangements must be made within 1 day of the auction. Otherwise, the items will be picked up by our packer/shipper. SOME ITEMS NOTED IN THE CATALOG WILL NOT BE SHIPPED AND ARE LOCAL PICKUP ONLY. Local pickup must be by Friday, December 14th. HYSTER AND POWER TOOLS ARE STILL IN USE AND CAN ONLY BE PICKED UP ON FRIDAY, DECEMBER 14. Any item left after that will be considered abandoned and Mockingbird has the right to resell the item to recoup fees. Bidding Increments - Mockingbird uses standard bidding increments. Bids not conforming to these increments will effectively be rounded down to the lower qualifying amount. For example, a bid of $140 would be treated as a bid of $125. These increments are: Opening Bid Increment $25 - $45 $5 $50 - $90 $10 $100 - $175 $25 $200 - $350 $50 $400 - $900 $100 $1000 & up $250 Mockingbird sets the opening bids for every lot. If no bids are received for that amount, the item will be passed. It may or may not be offered in another auction.
