The School Board of Broward County, Florida Timed Auction of Surplus School Buses & Vehicles February 2021 Terms & Conditions of Sale 1. SCOPE: The School Board of Broward County will conduct a public auction of District Owned School Buses and Vehicles that have been declared to be surplus. 2. AUCTION DATE: • This auction will be a Timed On-Line Auction. The auction is open to the public and all bidders must register with the National Auction Company page on Proxibid.com. The auction will open at 3:00 PM, February 19, 2021, and lots will begin closing at 3:00 P.M. on February 23, 2021. The auction website will use staggered closing times but all bids will end on February 23, 2021. All bids will be reported to The School Board of Broward County including the top bid price and next highest bid. Any bids that are received after published closing times will not be accepted except those that fall under the conditions of Extensions of Bid described in the following bullet. • Extensions of Bid: In the event, a bid or bids are made during the last five minutes of an auction, the end time for the auction will be extended for an additional five minutes. Extensions will continue until no further bids are received within the last five minutes of the auction. • The School Buses and other assets included in this Time-Bid Auction are offered and sold Subject to the Confirmation of the Seller, The School Board of Broward County. In the event top bid prices are not confirmed by The School Board of Broward County, items may be withdrawn from the auction and placed in an event to be conducted at a future time. It is expected Top Bidders will be notified their bid has either been accepted or rejected within 48 hours from the time the auction closes. It is expected all top bid prices will be accepted. • The Auctioneer reserves the right to establish minimum amounts for bid increases. In the event bidders do not comply with the minimum amounts stated, bids received that are less than those set forth will not be accepted. 3. PLACE: The Auction will be conducted by the National Auction Company through the Proxibid.com auction site. 4. INSPECTION OF VEHICLES: • The School Buses and other assets included in this auction are not available for Preview because of pending requirements brought about by the COVID 19 Pandemic. • The Auctioneer will provide information pertaining to each item included in the auction which describes its current condition to the best of the ability of the Auctioneer and his staff. Photographs and descriptions will be published on the Nation Auction page of the Proxibid website. Odometer readings may not be accurate but are provided for information. Every effort will be made to provide accurate information. • Each item included in this auction is specifically offered and sold in As-Is condition without guaranty or warranty either expressed or implied. • Specific information not included on the website can be obtained by contacting George Richards at (954) 658-5033. Every effort will be made to provide requested information but some may not be available. 5. CONDITIONS OF SALE AND DELIVERY-TERMS AND INDEMNIFICATION: • The School Board of Broward County, as a casual seller, is selling surplus School Buses and other assets at Public Auction, for cash, to the highest bidders. Announcements made by the Auctioneer will be made via the website and e-mailed to all registered bidders. Despite our efforts to avoid the withdrawal of items from the published auction list after being mailed or advertised, it may sometimes be necessary. The School Board of Broward County Board of County Commissioners reserves the right to do so and further reserves the right to accept or reject any/all bids. • All Buses and other assets are being offered and sold “as is” and “where-is”. The School Board of Broward County and National Auction Company makes no warranties or guarantees either expressed or implied relative to the operation or condition of any item included in this auction. Even though a great effort is made to assure the accuracy of the information, it is possible information provided might not be correct. • Once top bid prices have been received and communicated to The School Board of Broward County, all sales are final and there will be no refunds or exchanges made. • Those participating in this auction including all top bidders agree to comply with all terms and provisions as listed above. 6. BUYER’S PREMIUM: A 7% Buyer’s Premium will be added to all top bid prices and included in the final purchase price. An example is provided as follows: • Top Bid Price: $10,000.00 + 7% Buyer’s Premium: $700.00 = $10,700.00 • Top Bid Price: $ 1,000.00 + 7% Buyer’s Premium: $ 70.00 = $ 1,070.00 7. NOTIFICATION TO TOP BIDDERS AND PAYMENTS: • All Top Bidders will be notified their bid has been accepted through the E-Mail address supplied at the time of Bidder Registration. • Payments can be made by Cash, Money Order, Certified Check, Cashier’s Check, or Bank to Bank wire transfers. All checks should be made payable to National Auction Company, Auctioneer’s Escrow Account. Personal and Corporate Checks will only be accepted when accompanied by a current bank letter which guarantees payment for purchases made at this auction. • Payments will be accepted Wednesday, February 24, and Thursday, February 25, 2021, between the hours of 10:00 A.M. and 3:00 P.M. a. Payments must be made at 2600 NW 18 Avenue, Pompano Beach, Florida 33064. b. Payments can be made between the hours of 10:00 AM and 3:00 P.M. ONLY. c. In the event a Top Bidder has purchased more than one item, payment in full must be received before anything can be removed from County property. • Purchasers arriving at the payment office will be expected to wear a face covering and observe social distancing. • Signs will be posted at School Board property directing purchasers to the area designated for use by National Auction Company. 8. MOTOR VEHICLE TITLES & FLORIDA SALES TAX • All sales are subject to the rules of the Florida Department of Revenue and will be collected for non-titled assets included in this auction. Bidders with Resale Certificates issued by the Florida Department of Revenue must provide a copy of their Certificate to the National Auction Company. • Upon final payments, Motor Vehicle Certificates of Title will be provided to Licensed Motor Vehicle Dealers only. Those registering as Motor Vehicle Dealers must provide a copy of their current license to National Auction Company. This can be emailed to lori@natlauction.com • Purchasers who are not Licensed Motor Vehicle Dealers will be required to transfer the Certificate of Title from the name of The School Board of Broward County into their own name. The Motor Vehicle Certificate of Title will be provided to all top bidders who have paid in full. Certificates of Title must be taken to an authorized Title Agency. A receipt from the Tag/Title Agency must be brought back to the National Auction Company which shows that the Certificate of Title has been transferred out of the name of The School Board of Broward County. Once a receipt is provided that indicates the title has been transferred, the keys and vehicle will be provided to the Purchaser. 9. DEFAULT: • If a buyer fails to complete the sale under the conditions set forth hereon, or agreed to by The School Board of Broward County, any deposits and/or payments made will be forfeited and vehicles will remain the property of the School Board of Broward County. • If a Top Bidder fails to make payment in full after being notified their bid has been accepted, at the discretion of The School Board of Broward County and/or the Auctioneer, the bidder’s name may be subject to removal from the mailing list and may not be permitted to participate in future auctions. 10. REMOVAL: • All buses and other assets purchased must be removed no later than Friday, February 26, 2021. Neither The School Board of Broward County nor National Auction Company are responsible for equipment, machinery, or other items that remain at the auction site after completion of the auction. • It is understood buses that are included in this auction are not all located at one facility. The location of each bus will be included in the information provided for the auction. Appointments will be made with Purchasers at each location. Purchasers will not be permitted to enter bus storage yards unless accompanied by staff from the National Auction Company. • It will be the responsibility of Top Bidders (Purchasers) to arrange for their own transportation and removal of Non-Running Buses Broward County School Board storage yards. Bidders (Purchasers) should bring their own jump-boxes or battery cables for any item that will not start on its own. • Top Bidders (Purchasers) using Towing Services or Transporters will be required to be present when vehicles are being removed. • Top Bidders (Purchases) will be required to sign a receipt that shows delivery of purchased vehicles or equipment. 11. REGISTRATION: All bidders must register with the National Auction page on Proxibid.com. Each Bidder will be assigned a Bidder’s Number on the Proxibid auction site. The Bidder’s Number will be used and that number will be recorded for that sale. 12. DIRECTIONS: From I-95 (Broward County) • Exit at Copans Road West and continue NW 18 Terrace and turn right. Continue to entrance which will be marked with an Auction Sign. • The site can also be accessed from Powerline Road. At Copans Road, turn north and continue for one block. Turn right at the first street and continue to NW 18 Terrace and turn left. FROM the Turnpike (Broward County) • Exit at Coconut Creek Parkway (Dr. Martin Luther King, Jr. Blvd), Exit #67. After paying toll, continue to the traffic signal and turn left onto Coconut Creek Parkway (MLK Blvd.). At Powerline Road, turn left at the traffic signal and continue to Copans Road. Pass Copans Road and turn right at the first street.
