Online Auction terms and Conditions / Registration: 1.a) To be accepted to bid, a $100 deposit is required via PayPal. The deposit will go toward the invoice balance at closing along with you will need the rest of the 10% down if you are the winning bid for any Real Estate or personal property as the successful bidder. Please pay the 10% down after the auction closes via PayPal. However, if you are not the winning bidder the $100 deposit will be refunded via PayPal within 24 hours after the auction closes. Please send your PayPal deposit to phil@hometownerealtyandauction.com . If you use wire transfer to pay the balance of funds the bidder is responsible for all wire transfer fund Bank Fees. This Online Auction is on The Real Estate building lots at West Cherry Drive Lot 44 which is 0.34 acre lot West Cherry Drive lot 45 which is 0.34 acre lot, West Cherry Drive Lot 46 which is 0.34 acre lot, West cherry Drive lot 49 which is 0.34 acre lot East Cherry drive lot 52 which is 0.34 acre lot all in Losey Landing Section 3 in Science Hill Kentucky and the Jeep Grand Cherokee personal property all to be sold at Online Auction. These terms and conditions apply to the Real Estate and personal property that is to be sold at Online Auction. Do not bid until you have read the following terms and Conditions. Bidders who agree to the terms and conditions must be registered to bid online. In order to be registered to bid the bidder must obtain a bidding number to bid; however, there is no requirement to bid. All bidder’s identities will be verified. A Credit card is required to register; however, No charges will be made to your credit card. Once registered the bidder has acknowledged they understand and agree to the terms and conditions of the auction. The winning bidder on any Real Estate or more than one building lot or Real Estate must sign a purchase contract after the ending of the Auction on November 11th 2017 at 10:00 AM. The contract will be e-mailed or faxed then the contract must be sent back by the same method. The original sales contract(s) will be followed up through overnight mail. 3. The winning bidder must wire transfer a 10% down payment at the end of the Auction which is November 11th, 2017 at 10:00 AM these funds will be wired to Home Towne Realty and Auction Online account through Bank to Bank wire transfer. 10% down wired transfer is non-refundable. Each Building lot and the personal property Jeep Grand Cherokee is sold as-is no warranties expressed or implied, and in the event the purchaser does not go through with the contract the earnest money shall not be refunded. 4. The final sales price on any Real Estate is the price plus 6% buyer’s premium on any lots sold and 10% buyer’s premium on the Jeep Grand Cherokee to determine the final sales price. 10% down wired transfer is non-refundable. Buyer at closing must pay Title Opinion and deed recording fee. On each lot Sold purchased at time of closing. Possession at closing with deed transfer. Buyer to pay 10% buyer’s premium any 6% Sales tax and 9 dollar transfer fee on the Vehicle at closing. 5. There then must be a Real Estate Closing within 30 days for the balance of funds to be paid at closing. This will be on or before December 11, 2017. Possession with deed. Real Estate taxes to be prorated. 6.Buyer at closing must pay Title Opinion and deed recording fee. On each house purchased at time of closing. 8. Possession at closing with deed transfer on the Real Estate. Possession of the Jeep Grand Cherokee will be on or before 15 days or upon receipt of the balance of the funds and title transfer. 7. The real estate properties and the personal property are selling in its As-IS-Where-Is condition with no warranties expressed or implied. 9. Buyer to Assume insurance at closing. 10.Bidding increments are controlled by Proxibid and cannot be changed. Please check with Proxibid for minimum bidding increments. 11. The Contract Sales Price is the contract sales price combination of the high bid price and a 6% buyers premium together on each house lot sold. On the Personal property the contract sales price is combination of the high bid price and 10% buyers premium together on the Jeep Grand Cherokee. Both the Real Estate and the Personal Property will not sell unless The Real Estate and Personal Property makes the Reserve Price or exceeds the Reserve Price in this online Auction is a Reserve Auction on both the Real Estate and Personal property. 12. The information contained herein is believed to be correct to the best of the Auctioneer's knowledge. It is the bidder’s responsibility to determine if this information is correct, accurate and complete, this information is described for the benefit of the potential bidders. The real estate property is selling in its As-IS-Where-Is condition with no warranties expressed or implied. Each bidder should view the property before the end of the auction. The failure of any bidder to inspect, or to be fully informed as to the condition of the property, will not constitute grounds for any claim or demand for adjustment or withdrawal of bid, offer or earnest money after its opening tender.
