Special Terms
This is a live auction with online bidding
SERVCORP INTERNATIONAL, INC.
GENERAL AUCTION TERMS & CONDITIONS
By registering for, participating in, or placing a bid, whether in person or online, at an auction conducted by ServCorp International, Inc. ("Auction Company"), each bidder acknowledges that they have read, understand, and agree to be bound by these Terms and Conditions, any auction-specific terms, and the applicable auction catalog terms and conditions.
AUCTION FORMAT, REGISTRATION & BIDDING
Auction Company conducts: Onsite-only auctions; Live onsite auctions with online bidding; and Timed online-only auctions. Anyone wishing to bid in person at an onsite-only auction or a live onsite auction with online bidding must register at the auction site with valid identification on inspection day or auction day. Anyone wishing to bid online must register through the designated online bidding platform using a valid credit card and provide all information required to complete registration. Registration and bidding requirements may vary by auction.
By registering or bidding, the bidder agrees to these Terms and Conditions and any applicable auction-specific or online platform terms. Bidding is a privilege, not a right, and Auction Company may refuse or revoke bidding privileges at their discretion. A bidder is responsible for knowing the lot being bid on and for reviewing the applicable lot description and auction terms before bidding. Once a bid is accepted or a winning bidder is determined under the applicable auction format, the bid and purchase are binding, subject to applicable law.
ALL SALES ARE FINAL, EXCEPT AS OTHERWISE REQUIRED BY LAW.
Reserves, Withdrawal & Auctioneer Authority: Some lots may be sold subject to a reserve. If the reserve is not met, the Seller may accept or reject the high bid. Auction Company and/or the Seller may withdraw, cancel, re-catalog, or remove a lot before the sale is finalized. The Auctioneer has authority to conduct the auction and make reasonable decisions concerning bids and lots. The Auctioneer may correct errors, clarify descriptions, withdraw or re-catalog lots, and reject bids reasonably believed to be invalid, improper, fraudulent, or otherwise unacceptable.
For live auctions with or without online bidding, the Auctioneer determines the high bid and winning bidder. The Auctioneer's announcements or determinations made during the auction control over information displayed by a clerk, computer, or online bidding platform and may add to, clarify, or change information concerning a lot, including information contained in earlier printed descriptions or advertisements, subject to applicable law.
BIDDER RESPONSIBILITY, PAYMENT, FEES & DOCUMENTATION
Bidders must provide accurate legal and contact information. The name provided at registration must be the correct legal name for title, bill of sale, or other required paperwork. Dealers must provide the correct business information and any required dealer documentation. A $25 administrative fee may apply when a bidder requests corrections after title or other paperwork has been completed.
Bids are not contingent upon financing. Bidders should not bid unless they have sufficient funds available to complete the purchase within the required payment period. Failure to pay may result in the bidder being prohibited from participating in future auctions, subject to applicable law.
Government employees are responsible for determining whether their participation in an auction is permitted under applicable laws, agency policies, employment requirements, or ethics rules, when government-owned assets are offered for auction.
Unless stated otherwise, full payment is due on Friday or Monday following the auction, as specified for the applicable auction. The payment deadline stated in the applicable auction information controls. Please check payment deadline section for each specific auction.
Payment must be made in U.S. dollars payable to ServCorp International, Inc. Accepted payment methods include:
* Cash;
* Money order;
* Cashier's check;
* Wire transfer;
* Personal or business checks up to $5,000;
* Checks over $5,000 accompanied by an acceptable Bank Letter of Guarantee; and
* Visa, Mastercard, Discover, or American Express.
Bank drafts, ACH payments, and bank counter checks are not accepted.
Effective October 1, 2026, a 3% credit-card surcharge will apply. The surcharge will not exceed the Auction Company's cost of acceptance. No surcharge applies to PIN debit, prepaid debit, or signature debit transactions.
The Buyer's Premium is 10% for onsite purchases or 16% for online purchases. For example, a $1,000 winning bid would result in a $1,100 purchase price onsite or $1,160 online, before applicable taxes, notary fees, and other charges. The Buyer's Premium is based on the winning bid and will be included on the buyer's invoice. The applicable Buyer's Premium will be disclosed in auction advertising, posted conspicuously at registration, and announced by the Auctioneer at the opening of the auction as required by Louisiana law.
Sales tax will be charged as required by state and local law. Sales tax will be calculated on the taxable amount, including the Buyer's Premium. Louisiana resale buyers must provide a valid Louisiana Resale Certificate (Form R-1064) before payment and are responsible for maintaining a valid certificate and complying with all applicable tax requirements. Non-Louisiana Buyers must provide a valid tax exemption certificate from their state and a completed Louisiana Out of State Form (R-1079). If sales tax later becomes due because a claimed resale exemption is invalid or unavailable, the buyer is responsible for the tax. Titled vehicles may also be subject to applicable Office of Motor Vehicles taxes and fees at the time you transfer.
Bankruptcy Asset Administrative Fee: Any asset from a US Bankruptcy estate that requires a bill of sale and/or title will be subject to an administrative fee of $15 to $30. Other Fees: Any other applicable fees will be identified in the auction information or lot description.
Notary, Title & Vehicle Documentation: A $25 notary fee will apply to vehicles, boats, trailers, titled property, or property requiring a bill of sale or notarized documentation, as applicable. A government-issued photo ID is required for notary transactions. Special circumstances relating to title documentation will be identified in the lot description when known. When available, titles may be picked up locally or mailed according to Auction Company's procedures. Auction Company will make every reasonable effort to provide titles within 20 business days after the auction. Auction Company is not responsible for title processing or delivery delays caused by circumstances outside its control.
Bank Letter of Guarantee: Checks over $5,000 require an acceptable Bank Letter of Guarantee before payment. The Bank Letter of Guarantee must be on bank letterhead and signed by an authorized bank official. Auction Company may reject a Bank Letter of Guarantee that is incomplete, unacceptable, cannot be verified, or does not provide sufficient funds. A sample Bank Letter of Guarantee is provided on our website for reference and is intended to illustrate the information generally required. Website: https://slidellauction.com
AS-IS CONDITION, INSPECTION, DESCRIPTIONS & PHOTOGRAPHS
All property is sold AS IS, WHERE IS, WITHOUT WARRANTY AND WITH ALL FAULTS AND DEFECTS. Descriptions, photographs, and statements made available by Auction Company are not a substitute for inspection. Auction Company strongly encourages bidders to inspect equipment, vehicles, and other property to their satisfaction before purchasing. Each bidder is responsible for conducting their own inspection and determining the condition, value, completeness, and suitability of an item for its intended use. The AS-IS provisions are intended to apply to the fullest extent permitted by Louisiana law. Nothing in these Terms is intended to exclude liability for a knowingly false statement concerning the quality or condition of property or to waive any right or remedy that cannot legally be waived.
Property may be used, damaged, wrecked, incomplete, defective, or missing parts. Property may have dents, scratches, flat tires, torn interiors, mechanical or electrical problems, missing catalytic converters or other parts, and other conditions that may not be specifically listed. An unlisted defect does not mean the property is free of defects.
"Runs" Definition: For a vehicle, "Runs" means the vehicle was started, placed into gear, and moved forward under its own power or with the use of a jump box. For other equipment, "Runs" means the item was started and observed to be running. "Runs" is not a guarantee that the item is roadworthy, fully operational, suitable for a particular use, or that it will start, remain running, go into gear, or move forward or backward at the time of sale or afterward.
Descriptions, Photographs & Display Materials: Catalogs, advertisements, websites, online bidding platforms, lot descriptions, photographs, and other information are provided for informational purposes. Auction Company makes reasonable efforts to provide accurate information but does not guarantee that descriptions, counts, measurements, photographs, or other information are complete or free from errors. If a bidder finds an error or omission in a catalog, lot description, photograph, or online platform, the bidder should notify Auction Company as soon as possible. Auction Company will make reasonable efforts to review and, when appropriate, correct or update the information before the auction or sale. Counts and measurements are approximate unless specifically stated otherwise. Photographs are general representations and may not show every item included in a lot or every condition affecting an item. There may be items shown in photographs that are not part of the lot as well.
Plastic pallets, basket crates, folding tables, display materials, and similar items used to display merchandise are not included unless specifically stated. These items remain the property of Auction Company and/or the Seller.
REMOVAL, PICKUP, SHIPPING, UNPAID & ABANDONED PROPERTY
No property may be removed until it has been paid for in full. Property is LOCAL PICKUP ONLY. Auction Company does not provide packaging or shipping. Removal is conducted on a first-come, first-served basis. Purchasers arranging third-party transportation must provide the Auction Company with a valid bill of lading before removal, listing the Purchaser as the shipper, C/O ServCorp International, Inc and Auction Company must have advance notice of pickup day & time. The purchaser is responsible for all removal, dismantling, disassembly, loading, transportation, shipping, and related costs. The purchaser must provide all necessary labor, tools, vehicles, trailers, and handling equipment. Auction Company may assist with loading when available, but any assistance does not transfer responsibility for the loading, transportation, or condition of the property to Auction Company. Auction Company is not liable for any damage occurring from loading any property.
Removal dates and times will be provided in the auction catalog, posted at the auction site, and/or in the checkout section on the online platform. Purchasers must comply with all removal requirements and deadlines. A $50-$100 late-removal fee may also apply when property remains after the final removal date if auction personnel are required to return to the site. Purchasers should inspect property and raise questions or concerns before removal. Removal of property means the purchaser has had an opportunity to inspect and has accepted possession, subject to any rights or remedies that cannot legally be waived.
Unpaid Lots: Any lot that has not been paid for within the required payment period will be considered unpaid. Subject to applicable law and the Seller's agreement, Auction Company and/or Seller may cancel the sale and recover the property. An unpaid lot may be resold or otherwise disposed of without further notice to the bidder. Any proceeds from the resale or disposal of an unpaid lot will be paid to the Seller as required by contract. The bidder/purchaser has no right or claim to the proceeds from the resale or disposal of an unpaid lot. Paid but Unclaimed Property: A paid lot that has not been removed or picked up within the posted removal days may be considered abandoned or forfeited. Unless special permission has been given, any unclaimed paid property that remains after the last removal date will be forfeited. Paid but unclaimed vehicles may be removed from the auction site at the purchaser's expense. The purchaser is responsible for reasonable removal, transportation, towing, storage, disposal, and all related costs. To the extent permitted by law, once property is abandoned or forfeited, the purchaser gives up any remaining rights, title, or interest in the property. Auction Company and/or Seller may resell or otherwise dispose of the property without further notice. Any proceeds will be paid to the Seller as required by contract.
LIVE & ONLINE AUCTION PROCEDURES, RISK, INDEMNIFICATION & LIABILITY
The high bid and winning bidder is determined by the Auctioneer conducting and calling for live auctions with or without online bidding. The determination is not controlled solely by the clerk or online bidding platform. The winning bidder for online-only timed auctions is determined by the last bid received at the time the lot closes (bidding ends) on the online platform.
Live Auctions without Online Bidding: All bids are made in person at the auction site. The Auctioneer conducts the auction and determines the high bid and winning bidder in accordance with the applicable auction terms and Louisiana law. Live Auctions with Online Bidding: Bids may be received from onsite bidders and through the online bidding platform. The Auctioneer, at their discretion, may accept a floor bid over an online bid or an online bid over a floor bid. Timed Online-Only Auctions: Bids are submitted through the online bidding platform and are subject to the auction's stated closing time, bidding procedures, extensions, and other applicable rules. Online Bidding Disclaimer: For auctions offering online bidding, Auction Company is not responsible for internet interruptions, technical difficulties, delays, missed bids, transmission errors, platform problems, or other circumstances outside its reasonable control, except to the extent liability cannot be excluded under applicable law. Online bidders who wish to ensure that their bids are submitted in advance should utilize the proxy-bidding feature and enter their maximum bid at least 24 hours before the live auction begins or timed auction is scheduled to close. Bidders should verify their bids through their account dashboard to confirm that the bid has been successfully placed. Online bidders are also subject to the terms and conditions of the online bidding platform. Online bidding is conducted subject to applicable Louisiana law and the terms governing the online bidding platform.
Risk, Indemnification & Custody: Bidders and purchasers are responsible for their own acts and omissions while entering the premises, inspecting property, purchasing property, removing property, loading property, transporting property, or otherwise handling purchased items. Bidder/purchaser agrees to protect, defend, and reimburse Auction Company and Seller from claims, damages, losses, liabilities, and reasonable expenses arising from the bidder's or purchaser's acts or omissions in connection with those activities. Entry, inspection, removal, loading, and transportation are at the bidder's or purchaser's own risk.
Once property is sold, the purchaser is responsible for arranging prompt payment and removal. Auction Company and Seller will use reasonable care while property remains in their custody. Auction Company and Seller are not responsible for loss, theft, damage, deterioration, or casualty occurring after the applicable removal period, except to the extent caused by negligence, intentional misconduct, or other liability that cannot legally be excluded.
Liability: Auction Company and Seller are not responsible for non-delivery, loss, damage, or other problems except where liability is required by applicable law or cannot legally be excluded. Nothing in these Terms is intended to exclude liability for fraud, intentional misconduct, knowingly false statements concerning the quality or condition of property, or any other liability that cannot legally be excluded or limited. If Auction Company is responsible for failing to deliver purchased property to the purchaser, its liability will be limited to the amount actually paid for the affected lot. These Terms are intended to be applied and enforced consistently with Louisiana law. Nothing in these Terms is intended to waive or limit any right, remedy, obligation, or liability that cannot legally be waived or limited.
GOVERNING LAW, VENUE, & GENERAL TERMS
These Terms and the transactions covered by them are governed by the laws of the State of Louisiana. To the extent permitted by law, any dispute, claim, or legal action relating to these Terms, an auction, or a purchase transaction must be brought in an appropriate court in St. Tammany Parish, Louisiana, including the 22nd Judicial District Court, to the extent that court has jurisdiction. If any provision of these Terms is determined to be invalid, unenforceable, or contrary to law, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will continue in effect.
These Terms and Conditions, together with the applicable auction catalog, lot descriptions, auction-specific terms, posted registration or payment terms, and Auctioneer announcements, constitute the terms governing the applicable auction and purchase transaction. If an auction-specific term conflicts with these general Terms and Conditions, the auction-specific term will control for that auction or lot, subject to applicable law.
