PLEASE READ THESE TERMS CAREFULLY, AS THE TERMS ARE A LEGALLY BINDING CONTRACT BETWEEN ALL BIDDERS (WITH MIDWESTERN LAND & AUCTION, INC.), FOR The LARRY OLSON ESTATE ONLINE ONLY AUCTION, #5, conducted by Midwestern Land and Auction, a.k.a MWLA.
MWLA has put forth every effort in preparing the catalog(s) & information to accurately describe each item. Printed or verbal statements made by staff are matters of opinion and are made in good faith. All items are sold "As Is, where is,? and no return of items will be allowed. Buyers are responsible for conducting their own inspections during the open house and inspection periods. No allowances will be made for inadvertent errors in cataloging, authenticity, or imperfections not specifically noted.
All sales are final. A bid is a legally binding contract between purchaser and MWLA. MWLA reserves the right to reject any bids for any reason.
MWLA will not be held responsible in the event of any type of internet/computer malfunction while an auction is in progress.
Buyer?s Premium: The buyer?s premium of 10% will apply to all winning online bidders.
All accounts must be settled by the end of the pick-up day. Payment must be made with cash, valid check, Visa or MasterCard, cashier's check, money order, or wired funds. A 3.5% facilitation fee will be assessed to credit card purchases. Please note: chargebacks on credit cards are not allowed.
Buyers of guns will be charged a $25.00 FFL transfer fee per gun. FFL dealers will be charged $20.00 FFL transfer fee per gun. FFL dealers, you must bring in a copy of your FFL to transfer guns. If you have a permit, we ask that you please bring that on the pickup date. If you do not, please bring your driver?s license with you to the pickup site.
If payment is not received by the end of pick-up day, accounts due will be charged to your credit card, subject to a 3.5% facilitation fee. Purchases not settled by this time are considered in default. Any merchandise in default, and/or remaining at auction site after pick-up date, are considered forfeited, and will become the property of MWLA. The purchaser will be charged a $20.00(+) per item restock fee. No refunds will be given.
SHIPPING: There is a $25.00 per gun fee for handling & packaging in addition to the shipping fee. If your purchases need to be shipped, please use discretion in size and weight. All sales are final, and your purchase is NOT subject to shipping costs. We encourage buyers to pick up items purchased at the specified pick-up times. All packaging and shipping costs are the expense of the buyer. All "out-of-state" gun purchases that require shipment will be sent directly to the buyer?s FFL dealer of choice. Please have your FFL dealer?s email and dealer information to our auction company office at: midwestern.landauction@gmail.com
All bidders must provide their names, addresses, daytime phone numbers, and email addresses at which they can be contacted, to insure adequate communication between MWLA and the purchasers throughout any transaction.
General Information: The sales manager has the sole discretion to advance and/or reject any bids, for any reason. The sales manager shall be the final judge in any bidding disputes and has final authority to name a bidder as the final purchaser. The sales manager and MWLA shall not be held responsible for any 'missed' or unseen bids. MWLA reserves the right to alter this agreement at any time. This will take place by updating this site. Please check back and review auction terms often, as every time you use this site you are agreeing to the terms as they are written at that time.
Midwestern Land & Auction reserves the right to refuse service to any person, or to cancel any auction at any time for any reason.
THE AUCTION COMPANY WILL NOT SHIP ANY GUNS TO CALIFORNIA.
The purchaser agrees to pay all reasonable attorney fees and costs incurred by MWLA in the collection of funds owed. The purchaser also agrees that a fee of 2% per month be added to any unpaid balance due the Midwestern Land & Auction, as well as any other costs or losses incurred due to the purchaser?s failure to adhere to these terms. Any debt collection or dispute proceedings will be settled by arbitration in Monona County, Iowa.

Final payment of firearm and fees noted in the terms and agreement of the auction will be expected to be paid at the time of pickup for the firearm or prior to shipping of the firearm. Final invoices will reflect the hammer price, internet premium, $25 FFL transfer fee per gun, if shipping the firearm there will be a $25 handling fee per gun and shipping fee as determined by SHIPSTATION.
Proxibid invoices reflect the hammer price and internet premium of the firearm. Proxibid invoices do not reflect an additional FFL transfer fee of $25 or $20 FFL dealer transfer fee per firearm purchased as stated in the Terms & Agreement of the Gun Auction No. 05.
