AGREEMENT TO TERMS: By bidding in this auction, you agree to all terms and conditions set forth below. Peffers, North of 50th & Dodge t Preview is strongly recommended. Seeing items in person is the best way to assess condition, size, weight, and location on the property. Photos don't tell the whole story. --- ITEM CONDITION & DESCRIPTIONS --- All items are sold AS IS, WHERE IS with all faults. Descriptions are believed accurate but are not warranted. Measurements are approximate. Any mention of condition is not a formal grading — it is an observation only. Many items are used and may show wear, flaws, or imperfections. When you are unsure about an item's condition, bid accordingly. By placing a bid, you confirm that you have either inspected the items to your satisfaction or have chosen not to do so and accept it AS IS. All sales are final. Buyers must rely on their own inspection, not on any representation or warranty by The Auction Mill, who in NO WAY is responsible for any discrepancies, damage, or loss once the Auction closes on an item. ---BIDDING PROCESS/CLOSING/LOTS---: Soft-close bidding (where auction is automatically extended at closing time) creates a live-auction atmosphere. Any bid placed within the last 3 minutes resets that item's clock to 3 minutes, continuing until no bids are placed inside the last 3 minutes. Lots are spaced 20 seconds apart, so items close over a period of time. Similar items may close at the same time and extend if any of those lots receive a bid. The chain-link symbol in the lower-left of the grey screen denotes a grouped lot. By bidding, Buyer agrees to NOT stop payment on any check and, under no circumstances, shall a Buyer initiate a chargeback on a credit card. Breach of this term shall result in Bidder incurring all costs, damages and liability associated therewith and they shall not be allowed to participate in future auctions. ---NONPAYING BIDDERS--- If you bid and do not pay, The Auction Mill reserves the right to ban you from all online & live auctions indefinitely. IF YOU DON'T INTEND TO FOLLOW THROUGH, DO NOT BID. If we must resell an item where you were the winning bidder, you are liable for any difference if it sells for less. If we pursue legal action for your nonpayment, all legal expenses are paid by the buyer. ---TITLE--- Title transfers only when payment and pickup are honored in accordance with the payment and pickup terms set forth in these terms and conditions. --- ** PICKUP POLICY — READ BEFORE BIDDING ** --- Pickup is by SCHEDULED APPOINTMENT ONLY. You must book your time slot using the link below before arriving. Walk-ins cannot be accommodated. ITEMS NOT PICKED UP WITHIN 10 DAYS of the final scheduled pickup date WILL BE FORFEITED AND/OR RESOLD WITHOUT A REFUND. If you cannot pickup in person, please arrange for someone to pickup on your behalf. We cannot meet buyers at alternate times or locations outside of scheduled pickup windows. We do recognize that life happens — flat tires, mean bosses, traffic jams, sudden illness. If something comes up, contact us BEFORE your pickup window closes and we will do our best to work with you. Your invoice must be paid in full to qualify for any storage or special arrangements. Silence is not an extension. The Auction Mill reserves the right to ban you from bidding on future auctions if you do not pick up items or make arrangements with us prior to your scheduled pick up. --- SCHEDULE YOUR PICKUP --- Available Pickup Dates & Times: Thursday & Friday, July 16th & 17th by Appointment Click Here to Book Your Pickup Slot: --- COME PREPARED --- Please bring everything you need to load and transport your items: appropriate vehicle, tools, boxes, packing materials, tie downs, and enough help to load safely. Some items may be located in different areas throughout the property. Wear comfortable shoes — some walking may be required. A forklift operator will be on-site during published pickup hours to assist with heavy items. Any issues with items must be raised before the item leaves the pickup site. No claims will be accepted after an item has been loaded and/or departed the pickup site. --- PAYMENT --- Payment may be made online after the auction closes or in person at pickup. A 3% convenience fee applies to all credit card payments. If you fail to pick up, your card on file will be charged for your purchases. Accepted Forms of Payment: Cash | Certified or Cashier's Check | Bank Wire | Venmo | Credit Card ---FEES/DISPUTES--- FIREARMS TRANSFER FEE: Please note we have implemented a firearms transfer fee for all firearms excluding black powder. An additional fee of $15.00 for one gun transfer and a $25.00/max for two or more firearms. Fee can be paid in cash or by credit card and will be added to your total at pick up. While The Auction Mill generally does not accept checks, if it does and one is returned for nonpayment, The Auction Mill may re-present it and collect the full amount plus a $35 charge; unpaid amounts accrue interest at the highest rate allowed under Nebraska law. Any dispute between Buyer and The Auction Mill shall take place in Douglas County, Nebraska court systems, in Omaha, Nebraska. Moreover, Buyer agrees that if they bring suit and lose, they are responsible for all of The Auction Mill's lawyer and court costs. The Auction Mill may refuse registration/bidding for nonpayment, no valid card, or any other reason, may share nonpayment info, and may pursue collection by any legal means. Bidder agrees to provide ID on request and to comply with any item-specific terms. --- BUYER'S PREMIUM & FEES --- This auction carries an 18% buyer's premium w/ a 3% discount for cash payment. Example: A winning bid of $100.00 + [ 18% ] buyer's premium = a total purchase price of $118.00. --- SALES TAX --- Sales taxes are included in the buyer's premium fee. If you have a sales tax exemption certificate, such as a Form 13 for the state of Nebraska, please provide it to The Auction Mill email below. ---MISCELLANEOUS--- By registering for an auction, you agree to be added to The Auction Mill's email and text marketing lists (easy unsubscribe / reply STOP). Photo, video, and audio recording occur at all exhibitions and removal events. Notices sent to the email you provide on registration shall serve as official notice to you. Please add The Auction Mill emails listed below to your safe list so that our emails do not end up on your spam folder. There is a $35.00 title fee per titled item. Titles mailed via certified mail within 21 days of items being paid for and picked up. NO EXCEPTIONS. ---PLATFORM/INTERNET DISCLAIMER---: The Auction Mill provides internet-only bidding and is not responsible if the service failures of the internet or the bidding platform before or during closing; no claims shall be valid against The Auction Mill for missed/failed bids or platform issues. Bidders wanting certainty should place max bids at least two hours before close. The Auction Mill reserves the right to withdraw or re-catalog items, and in the event of any software problem may extend, change, stop, restart, or cancel the auction at its sole discretion. By bidding on any firearm lot, you certify that you are legally eligible to purchase and possess firearms and are not a prohibited person under federal or state law. All firearm buyers must complete an ATF Form 4473 at the time of transfer. FIREARM TRANSFER FEE: A firearm transfer fee applies to all firearm purchases — $15.00 for the first firearm and $10.00 for each additional firearm, not to exceed $25.00 total. Any buyer purchasing two (2) or more firearms is charged the maximum $25.00 transfer fee. This fee is in addition to the buyer’s premium and any applicable shipping costs. NEBRASKA RESIDENTS — IN-PERSON PICKUP: To take in-person possession of any firearm, a Nebraska-resident buyer must present at least one of the following, valid and current: (1) a Nebraska handgun purchase permit/certificate (issued by the Douglas County Sheriff’s Office or another Nebraska county sheriff); (2) a Concealed Handgun Permit / concealed carry permit (CHP/CCW); or (3) a Federal Firearms License (FFL). This is The Auction Mill’s minimum requirement and applies in addition to the ATF Form 4473 and any background check completed at transfer. Black powder and antique firearms, as defined under federal law, are exempt from this requirement. OUT-OF-STATE BUYERS: Out-of-state buyers may purchase and take in-person possession of long guns (rifles and shotguns), provided the transaction complies with the laws of both states and the buyer passes the required background check. ALL HANDGUNS must be shipped to a licensed FFL in the buyer’s state of residence and may not be transferred in person. FIREARM SHIPPING: Firearms are available for shipping but must ship to a licensed FFL. Primers and powder will NOT be shipped under any circumstances.
