Special Terms
Thank you for participating in this online-only auction conducted by The Ligon Company. By placing a bid, you acknowledge and agree to be legally bound to the following terms and conditions:
AS-IS, WHERE IS: All items are sold strictly AS-IS and WHERE IS, with no warranties or guarantees expressed or implied. Details and descriptions are provided to the best of our knowledge and represent our opinion. The bidder is responsible for inspecting all items to their satisfaction before placing a bid. Inspection is encouraged, and if you are unsure about an item, do not bid. Once an item is called sold, it becomes the property of the winning bidder, and no refunds, exchanges, or adjustments will be made.
Final Sale: All sales are final. The highest bidder for each lot is the buyer, and in the event of any dispute, the Auctioneer has the sole discretion to either settle the dispute or re-offer the lot for resale. The Auctioneer may reject any bid that is deemed not in the best interests of the seller. Bidders are personally liable for any bids placed with their bidder number. Buyer will be responsible for the removal, insurance, breakdown, arranging, shifting, loading, and securing of load for any items purchased.
Registration: To participate in this auction, bidders must register and obtain an online bidder number. Anyone bidding for another person must register separately. This bidder contract is between the individual who registered to bid through this online platform (the 'bidder') and The Ligon Company.
The bidder acknowledges and agrees that the terms outlined in this registration, as well as those detailed in the auction catalog, establish the specific and complete rules of the auction. The bidder further agrees that it is their responsibility to obtain and review these rules prior to placing any bids. By participating in the auction, the bidder agrees to be legally bound by these rules.
The Ligon Company reserves the right to revoke the bidder number and bidding privileges from any registered bidder and require that the individual and their parties leave the auction site. The bidder will remain responsible for the payment of any bids placed prior to the revocation. Photography, video, and audio recording are used on the premises and may be utilized for security and/or promotional purposes.
Additional terms may be posted or announced from the auction block, and these shall also be binding on the bidder. It is the bidder’s responsibility to request the complete auction rules from The Ligon Company. Any announcements made by the auctioneer will take precedence over any printed materials.
Buyer's Premium & Fee Schedule: A 10% Buyer’s Premium will be added to the high bid price on each item. An additional 3% Internet Purchase Fee will be charged for online purchases.
Local state, city, and county sales tax applies to all purchases unless the bidder provides a valid, approved tax exemption certificate before the close of the auction. The bidder understands that it is a criminal offense to give an exemption certificate to the seller for taxable items that the bidder knows, at the time of purchase, will be used in a manner other than that expressed.
Documentation fee $150.00 for each titled item.
Credit card surcharge 3%.
Storage fees may apply for items not removed from auction site by removal deadline. If special arrangements must be made to accommodate a customer pickup after the removal deadline a $250 call out fee may be charged in addition to storage fees.
Payment: Payment in full must be made by Friday, January 24th, 2025 at 4pm. and no items may be removed until full payment is made. Accepted payment methods include Credit Card (up to $5,000), Wire Transfer, Cashier’s Check, or Company Check with a bank letter of guarantee. Credit cards may require a credit card authorization form to be completed by the buyer, along with verification of identity. Failure to arrange payment by the specified date will result in a $100 Late Fee. After 3 business days, if payment is not made, the purchase will be considered a breach of contract, and legal action will be taken. A recovery fee may also apply. NO ITEMS can be removed until full payment is received.
Unpaid Balances: The buyer agrees to pay all reasonable attorney fees and costs incurred by The Ligon Company in collecting unpaid balances. The Ligon Company will contact the district attorney for any checks that are returned for insufficient funds or a closed account and will proceed with all necessary legal action as needed for collection and/or prosecution. The bidder agrees not to reverse or dispute charges for purchases paid for by credit card. By agreeing to the terms of the auction, the bidder authorizes The Ligon Company to capture the balance due on the invoice and charge the credit card used for the auction deposit if the invoice is not paid in full within 48 hours of the auction's completion. A 15% fee per month will be added to any unpaid balance, along with any other costs or losses incurred due to the failure to meet payment terms. Legal proceedings will be conducted in the county specified by The Ligon Company.
Removal: ALL ITEMS MUST BE REMOVED from the premises by Friday, January 24th, 2025 at 4pm. Loading will be available only until Friday, January 24th, 2025 at 4pm. If you cannot pick up your items by the deadline, please make arrangements at least one week in advance.
Items left after the removal deadline will be considered abandoned property and become the property of The Ligon Company unless other arrangements are made. Abandoned property may be resold for storage fees. The Buyer is responsible for providing the necessary equipment and manpower for item removal. Assistance may be available for an additional fee. A valid driver’s license will be required to pick up your purchases.
If special arrangements must be made to accommodate a customer pickup after the removal deadline a $250 call out fee may be charged in addition to storage fees.
Titles: IMPORTANT NOTICE:
• Title processing will be $150 per transaction plus any other fee’s required by the DMV.
• Bill of Sale, Drivers License, and other documents may be required at time of purchase. Bidder grants The Ligon Company power of attorney to sign as owner/buyer on title documentation as necessary to facilitate the transfer of ownership of titled purchases.
• Titles are processed in accordance with the South Carolina Department of Motor Vehicles. DMV laws in other states may vary and may require further processing by the Buyer. Units that do not require titles in South Carolina may have such requirements in other states. Some states may have different requirements for branding and salvaging titles. The Auctioneer/Owner is NOT responsible, and in some cases, may not be able to provide documentation required by other states.
• The Buyer may be required to go into the DMV to complete the process, in this case we will specify.
• Tax will be calculated and collected based on the state of purchase not sale. In the United States, the sales tax on vehicles varies by state, and whether or not it's capped depends on the specific state's laws. Many states impose sales tax on vehicle purchases based on the purchase price or the fair market value of the vehicle, but some states have caps or limits on the maximum amount of sales tax that can be charged for a vehicle. Any balance due will be the responsibility of the Buyer.
• No titles will be given to the winning bidder on auction day.
• If The Ligon Company cannot provide clear title within 120 days of purchase The Ligon Company will refund the purchase price including buyers premium only. The Ligon Company will not refund cost of freight, cost of any repairs or alterations made to item while in possession of the Buyer.
Auctioneer’s Discretion: The Auctioneer reserves the right to refuse any bid that is not in the best interest of the seller. All auctions are with reserve unless specifically stated otherwise. Reserves, if any, are not disclosed. Additionally, bids may be placed at some auctions by the seller, an employee of the seller, or an agent on the seller’s behalf up to the reserve. In the event of a dispute, the Auctioneer has the absolute discretion to settle the dispute or re-offer the lot for resale.
The Auctioneer reserves the right to remove items from auction or skip items once auction has begun. In the event an item is removed from auction or skipped any Prebid’s/absentee bids will be void.
Liability: The Ligon Company is not responsible for any injury, damage, or loss incurred in connection with the auction or the removal of purchased items. Injury and Damage: The bidder acknowledges responsibility for any personal injury or property damage caused by the bidder, the bidder’s guests, or agents. The bidder agrees to hold The Ligon Company harmless from any personal injury to themselves or their agents and any property damage incurred on the auction premises. The bidder releases The Ligon Company and the seller from all liability related to the removal and transportation of purchases, as well as any future use of the goods purchased.
Inspection: It is the bidder's responsibility to inspect items prior to bidding. All items are sold as-is, and no representations regarding the condition, quality, or authenticity of any item are made. If you are uncertain about an item, please do not bid. It is the buyer’s responsibility to have inspected the item and determined the condition, year, model, serial number, and mileage of the item from your inspection. The Ligon Company does not guarantee any item descriptions as accurate. By agreeing to the terms of the auction you agree to the complete rules of auction.
BUYER BEWARE. Please run Carfax reports, NMVTIS reports, Recall checks, or other checks PRIOR to bidding on a vehicle.
The Auctioneer has described the Lot(s) in the catalog to the best of their ability and belief from information furnished by the Vendor(s) who shall be alone responsible for any error or misstatement, which there may be. The Auctioneer undertakes no liability whatever in respect of any faults, deficiencies and errors of any description, oral or printed, nor do they accept responsibility for the authenticity, genuineness, origin, age, condition or quality of any Lot(s) and all statements as to these matters whether contained in the catalog or made orally are statements of opinion only and not to be taken as being or implying a statement or representation of fact.
Collusion: It is an offence against the Property, Stock and Business Agents Act 2002 to collude with other bidders to influence the bidding process is strictly prohibited and will result in immediate removal from the auction. Violators will be reported to the authorities.
Acceptance of Terms: By participating in this auction, you agree to abide by all terms and conditions outlined in this agreement. All sales are final, and the buyer assumes full responsibility for their winning bids.
