• Should Purchaser fail to pay in full for all Auction Item(s) within 2 business days following the date of Sale, LATE FEES OF 5% of total invoiced value PER DAY will accrue following the 2nd business day! In no event shall Ziggy Brothers Auction Group LLC be held responsible for having made or implied any warranty of merchant-ability. Bidder shall be the sole judge of value. Buyer acknowledges there is no covenant of warranty, expressed or implied, arising by law or otherwise with regard to liability, merchantability, or operational condition of any asset purchased. In the event that litigation is filed to enforce the terms of this agreement, the losing party in such litigation is responsible to pay the litigation costs and reasonable attorney’s fees incurred by the prevailing party.
The Bidder is responsible for knowing which item he/she is bidding on. If he/she is unsure, he/she should inquire or not bid. When you become the winning bidder at auction you have effected a contract and will be expected to pay for items in which you were evidenced to be the successful bidder. Auctioneer will not honor “mistakes”.
Ziggy Brothers Auction Group LLC reserves the right to withdraw or re-catalog items in this auction. Announcements made day of Auction take precedence over printed material. This is listed as a reserve auction, and some items may or may not be listed with reserves. The auction house reserves the right to pass on any items at any point before the hammer falls.
Ziggy Brothers Auction Group LLC is providing internet live bidding as a service to the Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the Auction. Under no circumstances shall the Bidder have any kind of claim against Ziggy Brothers Auction Group LLC or anyone else if the Internet service fails to work correctly before or during the live auction.
