Terms and Conditions: 1. All persons attending the exhibition, sale or removal of merchandise assume all risks of damage to person or property and specifically release and indemnify Wilson Auction Service from any liability. 2. WILSON AUCTION SERVICE AND SELLER FURNISH ALL AUCTION ASSETS TO BUYERS "AS IS", UNSUPPORTED, WITHOUT WARRANTY OF ANY KIND. WILSON AUCTION SERVICE AND SELLER DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Assets are sold in their actual current condition, with all faults and defects, and with all errors of description. Wilson Auction Service's liability to a purchaser will never exceed the purchase price actually paid for an asset. 3. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Buyers can go to soldbywilson.com and preview more detailed pictures Wilson Auction Service shall endeavor to describe in detail each item and any pertinent information about it. Wilson Auction Service will not be responsible for any error or omissions in the description of the merchandise. Bidder agrees that everything is sold "AS IS" and that they may not return any item they purchase for any reason. Bidders accept all auction assets "with all faults" whether or not immediately apparent Bidders are responsible for ascertaining actual current condition through personal inspection and/or careful review of the description, pictures, video and/or support documentation. Every bidder agrees that his or her decision to bid and the amount he or she bids have been based solely on his or her own independent inspection and evaluation of the auction assets. Bidders are strongly advised by Wilson Auction Service to take care to satisfy all questions or concerns about the auction process, bidding process or auction assets before placing a bid. 4. Wilson Auction Service is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly on the day of the Auction. Under no circumstances shall Bidder have any kind of claim against Wilson Auction Service or anyone else if the Internet service fails to work correctly before or during the live auction. Wilson Auction Service will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged are encouraged to use the proxy bidding feature and leave their maximum bid 24 hours before the Auction begins. Wilson Auction Service reserves the right to withdraw or re-catalog items in this Auction, and reserves the right to rescind or reject any and all bids.. If the pictures displayed with descriptions do not appear to match, contact denise@soldbywilson.com or call 785-827-5563 to report the auction date and item number. 5. The Auctioneer shall advance the bidding at his own discretion. Wilson Auction Service may withdraw any item before or during the Auction. The record of the Auction by Wilson Auction Service shall be conclusive. 6. When the Auctioneer says "sold", Bidder assumes full responsibility for the merchandise. Everything MUST be paid for in full on the following business day. Payment shall be made by MasterCard, Visa, Discover or American Express. For Tax Exempt Buyers: Email Kansas Tax Exemption Certificate with paddle number and sale name to denise@soldbywilson.com prior to bidding. Otherwise tax will be added to the sale if applicable. Unless exempted by law, the purchaser shall pay any and all applicable taxes. Bidder agrees to indemnify Wilson Auction Service against any claim if sales tax is not collected on Bidder's purchases. BIDDER AGREES THAT UNDER NO CIRCUMSTANCE WILL HE/SHE INITIATE A CHARGE-BACK ON HIS/HER CREDIT CARD. 7. Firearms will be shipped to your local FFL dealer. Please have your dealer email a copy of his/her license to guns@soldbywilson.com Packing, shipping and insurance costs are the responsibility of the buyer. Your shipping costs will be charged separately on your credit card. THERE ARE NO EXCEPTIONS TO THIS RULE!! Any questions, please call the auctioneer. California residents must be aware of state regulations before purchasing firearms. Purchasers may incur fees to resell the firearm. Residents of Kansas may call to make arrangements to pick up firearms. 8. Wilson Auction Service may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification that Wilson Auction Service may request, including but not limited to: driver's license, photocopies of credit cards, Social Security card, or Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 9.WILSON AUCTION SERVICE MAY DECLARE AN ASSET ABANDONED WHEN A BUYER FAILS TO MAKE FULL PAYMENT BY THE STATED PAYMENT DEADLINE OR WHEN A BUYER FAILS TO REMOVE AN ASSET FROM THE AUCTION SITE BY THE STATED DEADLINE. When Wilson Auction Service declares an asset abandoned, it may take the following steps in its sole discretion: Wilson Auction Service may resell the asset in an upcoming auction on the buyer's behalf for an additional administrative fee of 20% of the original invoice price (minimum $1,000 fee) and account for the resale as follows: Net proceeds, if any, will be released to the buyer, calculated as the resale bid price collected plus any amounts paid by the buyer against the original invoice, less all administrative and storage fees accrued; If the resale bid price collected plus amounts paid by the buyer against the original invoice are insufficient to cover the buyer's administrative and storage fees accrued, the deficiency will continue to be owed by the buyer, and Wilson Auction Service and the seller will retain all legal remedies to obtain that deficiency; Net proceeds may be retained and used by Wilson Auction Service to offset any amounts owed by the buyer related to other past or pending purchases or sales of assets by the buyer or a related party. Where the original invoice price is less than $2000, Wilson Auction Service may allow the seller to retain or dispose of the asset, declare the buyer's rights to the asset immediately terminated, and retain all payments by buyer as liquidated damages. Where an asset is declared abandoned under this policy after the buyer as been issued a certificate of title, the buyer agrees Wilson Auction Service and its administrative personnel are appointed as buyer's true and lawful attorney-in-fact to apply for a Certificate of Title and/or Registration upon and/or endorse and transfer title for the asset(s) in issue and, by acknowledging these terms and conditions, the buyer swears or affirms that this appointment is true and correct. 10. In any matters in which Wilson Auction Service and/or any of its employees, officers, directors, shareholders, agents or assigns is made a party, the law of the State of Kansas shall apply, without regard to its law pertaining to conflict of laws, and any dispute shall be decided inthe courts of Saline County, Kansas. All claimants consent to the personal jurisdiction of those courts. Auctioneer may waive any provision to these Terms and Conditions, but only in writing. No such waiver shall affect any other provisions of these Terms and Conditions, nor shall it amount to a permanent waiver of that particular provision. 11. We want you to be happy with your purchases! If you have any questions about merchandise, the time to ask questions is well in advance of the live auction. No returns are allowed.
