There is never a registration (sign-up) charge for any Simmons & Company Auctioneers Auctions. There is a 20% Internet Buyers Premium charge on all items purchased online. This charge is due to the costs associated with publication and broadcasting auctions live via Proxibid.
BUYER REGISTRATION IS REQUIRED FOR BIDDING AT THIS AUCTION. All buyers must be issued a BID NUMBER. Registration at this auction constitutes a Binding Contract between the Registered Bidder and the Seller represented by the Auction Company 1) for any purchases made on that bid number 2) the a acceptance of all related terms and conditions. All Absentee Bidders are required to register and secure payment auctions prior to the auction.

General Terms and Conditions of the Auction: By registering to bid or placing a bid at the live auction or via proxibid, buyers and bidders agree with an accept any and all terms of the live auction and any other announced terms, conditions of sale, or shipping instructions or storage instructions of the auction center. Internet bidders agree that bids placed on the internet shall have the same legal affect as if they were in attendance at the live auction.
All internet bidders agree to pay a buyers premium equal to 20% of the hammer price of each item they purchase. If the hammer price of an item is $10, then the buyers premium will be $2.00 for a total purchase price of $12.00. State sales tax if applicable, will be applied to purchases.
EVERYTHING IS SOLD " AS IS, WHERE IS" WITH NO WARRANTIES AS TO AGE, VALUE, CONDITION OR AUTHENTICITY IMPLIED OR EXPRESSED BY THE AUCTION COMPANY, AUCTIONEERS, AUCTION PERSONNEL OR OWNERS. NO GRADING OF TOOLS WILL BE MADE. Statements used as part of the "selling" chant are strictly "bidding" enhancements and do not constitute an appraisal, judgment or guarantee as to the quality or value of any said item. Potential buyers should inspect all items prior to executing any bid and then bid their own personal judgment.
Bidders who bid from off-site and are not present at the live auction or preview understand and acknowledge that they will not be able to inspect an item as well as if they examined it in person and attended the live auction or preview. It is the bidders responsibility to determine condition, age, geniuses, value, or any other descriptive factors. Simmons & Company Auctioneers, Inc, and the Simmons Auction Center shall endeavor to describe in detail each item and any pertinent information about each item. Simmons Auction Center and Simmons & Company Auctioneers, Inc, will not be responsible for any errors or omissions in the description of the merchandise unless it is immaterial or intentional misrepresentation of the item itself made by Simmons & Company Auctioneers, Inc.
THE AUCTION COMPANY IS NOT RESPONSIBLE FOR POSSIBLE ERRORS OR OMISSIONS, TYPOGRAPHICAL DISCREPANCIES, NOR INACCURACIES IN CATALOG DESCRIPTIONS, ADVERTISING MEDIA OR SIMILAR STATEMENTS BY THE AUCTIONEERS NOR RINGMEN as to Serial Numbers, Make, Model, Style or other such indicators. Buyers are to inspect the items before bidding and determine for themselves if the item is the one they want.
All items are considered sold and become the property of the bidder whose buyer's number is announced when the hammer falls and the Auctioneer says "Sold". In case of tie bids, the bid taken by the Auctioneer will stand. The bidding will be reopened between those two bidders and it is the responsibility of the alternate bidder to increase his bid in order to resume bidding on the item. If this bidder declines to bid, the item belongs to the first bidder. If a potential bid is "missed" by a ringman, bid taker or auctioneer, it is the Auctioneer's sole prerogative to reopen bidding if a question arises as to who had the bid when the hammer falls.
NOTHING IS TO BE REMOVED UNTIL PAYMENT IS RECEIVED. It is the buyer's responsibility to keep track of the items he has purchased and to check his tickets. No items will be shipped or release to Internet Buyers prior to payment unless prior arrangements have been secured with Simmons & Company Auctioneers, Inc. prior to auction start date.
FIREARMS PURCHASE * TERMS & CONDITIONS
Complete Bidder Registration will be required for any and all purchase of firearms. Includes: Photo ID (Driver’s License), current Physical Address (No P.O. Boxes); Phone Number, Birth Date, Social Security Number. Shipment of all firearms must be to a Federal Firearms License (FFL) agent in your area. It is the buyer’s responsibility to provide Simmons and Co. Auctioneers, Inc. with the Name, Address, Phone Number and copy of the FFL certificate of your agent that is willing to receive your purchase. Faxed copies of the FFL license should be sent to 858-712-1113. We must have this before any shipping will take place. Shipping costs are the buyer’s responsibility and will be charged to credit card supplied during registration.
Absentee and on-line purchasers must have their firearm shipped to a FFL certified dealer in his or her home state. If the buyer is not an FFL holder, the buyer is responsible to locate a current FFL License holder who will provide that certificate and receive shipment and provide that information to the auction company prior to shipment. If it is your intention to purchase a firearm on-line, it is best to provide that information when you register. Faxed copy to 858-712-1113. Buyers who act as agents for FFL dealers must have a letter of agency as well as a signed copy of the dealer’s current Federal Firearms License (FFL). All costs associated with this will be the responsibility of the purchaser. It is the purchaser’s responsibility to know, and abide by, his or her own state laws. All local, state and federal laws are to be complied with. Some firearms cannot be shipped to CA, NY or some other states. Please contact us with ALL questions prior to bidding.
All successful bid items won will be taken by the auction company to a local FFL certified dealer for packaging and mailing. UPS is the preferred carrier. Tracking numbers will be available. Basic shipping and handling, within the continental US, usually costs $ 45 per gun from our shipper, plus cost of insurance. All items must have shipping insurance. This insurance is mandatory. Prices are variable and can change without notice. We are an Auction Company, NOT a shipping company. We are not liable for any acts of omission in packaging or shipping. We will arrange for packing and shipping at our earliest possible convenience, and will attempt to ship as soon as possible, however, delays of seven days after full payment and receipt of FFL information is received by us, is typical. Shipping and handling costs are determined by the shipping company and UPS, not us.

On site buyers may pay by Cash, Credit Card or Approved Check. Your card will be charged within 48 hours for the initial purchase price (including Internet Buyers Premium for on-line buyers) and a second time for shipping and handling charges.
A “Bill of Sale” will be issued for every firearm. Owner, Bob Mosier will be on-site. We must have copy of your FFL license no later than ten (10) business days from date of purchase. All property is sold “As Is” without any guarantees expressed or implied and ALL SALES ARE FINAL. Credit card chargeback’s will not be accepted. Any firearm not picked up within 30 days or any Internet bidder who has not sent the proper FFL certificate and dealer address to receive shipment of their purchase within 30 days will forfeit their purchase and payment.
The Auction Company, Auctioneers, Staff nor Officers, are not responsible in any manner for personal injury, accident, theft, loss of personal property, or for items purchased or offered for sale during the Auction.
