Terms & Conditions These are the complete and only terms and conditions on which all property is offered for sale. By bidding in this auction, prospective bidders agree to be bound by the following: Registration All bidders must register their name, permanent street address (no P.O. Boxes please), and phone number prior to the auction. Terms of Sale The highest bidder for each lot shall be the buyer, and if any dispute arises as to any bidding, or between two or more bidders, at the sole discretion of the auctioneer, the disputed lot shall be put up again at the last undisputed bid and resold. All property is sold “AS IS”, “WHERE IS,” and ALL SALES ARE FINAL. We are not responsible if you bid on the wrong item or decide an item is not suited for your intended use. Once bidding ends, the item is contractually sold to the highest bidder and that item is the buyer's property. When in doubt about condition, completeness, or suitability for intended use, please bid accordingly. By bidding on any item, the bidder shows acceptance of the terms of the auction. If a Bidder does not want to pay for shipping - that is fine with us. However, bidder is still responsible to pay the full hammer price and buyer’s premiums that they agreed to pay when they registered for the auction. Bidder may pay their invoice minus the shipping costs. However, if this is the case and no shipping is paid - NOTHING will be shipped. Buyer's Premium LIQUID ASSET PARTNERS LLC will charge and retain a non-negotiable 15% buyer's commission from the proceeds of any sale on the final bid of each lot sold ('Buyer's Premium'). Taxes Where required by law, Buyer shall pay to LIQUID ASSET PARTNERS LLC sales tax. Tax will be added to the purchase price of all purchased items, as well as the Buyer's Premium. At the time of payment, dealers who purchase for resale must supply LIQUID ASSET PARTNERS LLC with completed copy of the tax exempt form, call our office if you need such a form 616-719-5917. Payment Only credit cards and wire transfers are acceptable methods of payment. Bidders credit cards on file will be charged immediately after the conclusion of the auction. Lot Descriptions LIQUID ASSET PARTNERS LLC does not warrant the condition of any lot sold. ALL PROPERTY IS SOLD AS IS, and neither LIQUID ASSET PARTNERS LLC nor the consignor makes any warranties or representations of any kind or nature with respect to the property or it's value, and in no event shall they be responsible for correctness of description, genuineness, attribution, provenance, authenticity, authorship, completeness, condition of the property or estimate of it's value. No statement (oral or written) in lot descriptions, at the auction, or elsewhere shall be deemed such a warranty or representation, or any assumption of responsibility. Prospective bidders are urged to contact LIQUID ASSET PARTNERS LLC directly for detailed information regarding any lot. THERE SHALL BE NO RETURNS FOR ANY REASON. Shipping It is the buyer's responsibility to arrange packing and shipping of any and all lots purchased. It is the responsibility of the buyer to pay for all shipping and handling charges. LIQUID ASSET PARTNERS LLC will need to see a paid invoice before removing any and all purchases. PICKUP: If picking up items in person, buyer is responsible for ensuring that all items on invoice have been accounted for and picked up by buyer or his responsible party. Items left behind will either be disposed of or resold. LARGE ITEMS, LARGE LOTS, MACHINERY or EQUIPMENT: Large items, large lots, machinery and equipment will need to be picked up or arranged for shipment by the buyer. Liquid Asset Partners is not responsible and does not guarantee rigging or shipping services. SMALLER ITEMS: Smaller items, parts, and accessories can be shipped through UPS for a minimum $20 packaging and handling fee PER ITEM + actual UPS shipping costs. Unless noted otherwise by the buyer, items will be shipped via UPS Ground, AS-IS, and NOT insured. IF YOU PLAN TO COORDINATE SHIPPING THROUGH LIQUID ASSET PARTNERS, PLEASE CONTACT Marissa@liquidap.com, or 616-719-5917 TO FILL OUT A SHIPPING LIABILITY RELEASE FORM. Buyers using packaging and shipping coordinated through Liquid Asset Partners will be charged to the credit card on file with Proxibid a second time for packaging/handling fees and shipping expenses. If a Bidder does not want to pay for shipping - that is fine with us. After payment is received in full by Liquid Asset Partners. Buyer will be given until close of business at 5:00pm(central) on May 19, 2016, to remove any items purchased, if additional time is needed buyer MUST get approval from Liquid Asset Partners prior to bidding. IF ITEMS ARE NOT REMOVED WITHIN THIS TIME FRAME, BUYER FORFEITS ITEMS AND ANY PAYMENTS RECEIVED BY LIQUID ASSET PARTNERS. Store managers will need to see release form for each item prior to removal. Removal Procedures 1. NO MERCHANDISE WILL BE RELEASED DURING THE AUCTION SALE. 2. Pay your invoice in full. After payment is received in full by Liquid Asset Partners, a release form will be given to the buyer. This form MUST be shown to the store manager before any items will be released to the buyer. NO EXCEPTIONS. 3. Buyer is responsible for all removal, and needs to contact Liquid Asset Partners about removal procedures. 4. If there is any issues buyer MUST contact Liquid Asset Partners prior to removal of any items, so we can try to resolve any such issues. Additional Check-Out Procedures 1. Buyer is responsible for providing his own forklifts and material handling equipment to be used in the removal of Buyer's lots. 2. Small Lot Removal: LIQUID ASSET PARTNERS LLC is not responsible for any missing or lost small lots if they have not been removed within 24 hours of the conclusion of the sale. There will be NO removal of any lots until the auction is complete. 3. It is solely the Buyer's responsibility to properly remove all fluids, oils, hazardous chemicals, etc., from machinery purchased at this auction. All oils should be properly stored in the appropriate containers (sealed drums). 4. Failure to remove all lots by the removal date results in Buyer's violation of the terms of the auction sale, providing LIQUID ASSET PARTNERS LLC with the right to exercise any options. Buyer will be solely responsible for all costs of these options.
