Winning bidder will be responsible for all costs for storage, removal and disposal of purchased items not picked up or left behind, no exceptions. Nothing is to be removed from the premises until it has been paid for. In the event that a dispute arises over the bidding, purchase, terms, conditions, or events of the auction, Rose Auction Group shall be entitled to recover, any and all cost, expenses, and attorneys fees incurred, not limited to all appellate proceedings or fees for the enforcement of terms of this contract. FOR INTERNET BIDDING-A 15% Buyers Premium is in effect for this auction for all Proxibid participants. State sales tax must be collected by State Law; where applicable, you will be required to pay such taxes. If exempt valid, current tax exempt form and licensing is required. If the buyer fails to fulfill their obligations herein, all deposits and payments made hereunder by the buyer shall be retained by Rose Auction Group/Beth Rose Auction Co, LLC as liquidated damages. Buyer remains responsible for full purchase price, fees, taxes and any other fees incurred in the process of enforcing this contract. All sales that are subject to 6.0% FL state sales tax where applicable, must be paid at time of transaction closing. The decision of the Auctioneer is final and absolute. The record of sale kept by the Auctioneer will be taken as final in the event of a dispute. REMOVAL: All items must be removed from the auction site no later than the date specified in our terms. Removal shall be at the risk, expense and liability of the purchaser. No items can be removed without presenting proper evidence of paid bills of sale. Your credit card on file with Proxibid will be immediately charged for your purchases, plus 15% Buyer's premium, and any applicable taxes. No items shall be removed until payment is received in FULL. All sales are final. BUYERS PREMIUM: 15% Buyers Premium added to the final hammer price. This covers the premium charge by Proxibid. DAMAGE LIMITATIONS: If Beth Rose Real Estate and Auctions is unable to make available or deliver any winning items, or a portion thereof, the sole liability of Beth Rose Real Estate and Auctions, if any, shall return the monies paid in respect of such winning items upon its return by the purchaser. EXPLANATION OF STAGGERED CLOSING & EXTENDED BIDDING TIME: Staggered Close: If you'll notice in the Title of our Auction, it states when bidding BEGINS to close in EST (Ohio Time). However, ALL items do not close together at that time. Items will close in the order listed on the site, (unless affected by the Soft Close as explained below) and typically close at the rate of 6 items per minute (every 10 seconds). Our Auction was set up this way intentionally so that bidders can have time to evaluate their overall progress in a sale as individual items close. You may also click on "Live Catalog" to view, in real time format, the lots that have current activity. Extended Bidding Time: If an item receives a bid within the last 2 minutes, then the close time will be extended 2 minutes from the time the bid is placed. The time will continue to be extended for 2 minutes with each newly placed bid and the item will not close until 2 minutes have elapsed with no additional bid activity. This does eliminate "snipers" from our Online Auctions.
