International bidders are not able to bid on ivory items as required by law and CITES. 1. All property is sold 'AS IS', and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinating factor. In no event shall Masterson Brabander Auctions, LLC be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value. ALL ITEMS SELL AS IS. ALL SALES ARE FINAL. 2. All Internet Bidders agree to pay a buyer's premium equal to Fifteen Percent (15%) of the hammer price of each item they purchase. If the hammer price of an item is $100.00 the buyer's premium will be $15.00 for a total purchase price of $115.00. State sales tax law, (Applies to residents in state of Ohio) if applicable, will be applied. We accept Visa, Mastercard and Discover for payments. A credit card is required to register to bid for this auction. We will call you to retrieve your credit card information as we have our own credit card processor and therefore do not use APN. You will be charged for all items won plus the 15% Buyer's Premium and all shipping costs. Please refer to 'Shipping Instructions' and 'Payment Instructions' above for more information. 3. Bidders who bid from off site and are not present at the live auction or preview understand and acknowledge that they may not be able to inspect an item as well as if they examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or any other determinative factor. Masterson Brabander Auctions, LLC shall endeavor to describe in detail each item and any pertinent information about it. However, all items sell AS IS, without warranties nor guarantees either written, expressed or implied. All descriptions, written or oral, are provided in good faith and are matters of opinion. While all damage seen will be identified, Bidder acknowledges that all items at the auction are in used condition and may not be perfect with normal wear, scratches, common worn areas, etc. and that Masterson Brabander Auctions, LLC shall not attempt to describe such normal conditions of used items. All sales are final. 4. Masterson Brabander Auctions, LLC will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself. Bidder agrees that everything is sold as is and that they may not return any item they purchase for any reason except an intentional and material misrepresentation of the item itself made by Masterson Brabander Auctions, LLC. Bidder's sole remedy in the event of an intentional and material misrepresentation of an item shall be to return the item, at their expense and in the same condition it was shipped to them. Masterson Brabander Auctions, LLC takes many photographs of each item for identification purposes. If Masterson Brabander Auctions, LLC agrees that the item was materially and intentionally misrepresented, Masterson Brabander Auctions, LLC may refund the Bidder's purchase price to him/her. Bidder agrees that under no circumstances whatsoever will Masterson Brabander Auctions, LLC ever be liable to any bidder for an amount greater than the purchase price of the item they purchased. 5. Masterson Brabander Auctions, LLC is providing Internet pre-auction and live bidding as a service to Bidder. Bidder acknowledges and understands that this service may or may not function correctly the day of the auction. Under no circumstances shall Bidder have any kind of claim against Masterson Brabander Auctions, LLC or anyone else if the Internet service fails to work correctly before or during the live auction. Masterson Brabander Auctions, LLC will not be responsible for any missed bids from any source. Internet bidders who desire to make certain their bid is acknowledged should use the proxy-bidding feature and leave their maximum bid 24 hours before the auction begins. Masterson Brabander Auctions, LLC reserves the right to withdraw or re-catalog items in this auction. 6. The auctioneer shall advance the bidding at her own discretion and may reject a nominal advance should it in her estimation prove injurious to the auction. Masterson Brabander Auctions, LLC may withdraw any item before or during the auction. Should a tie or a dispute arise between two bidders, the auctioneer has final say and the item will be SOLD. Auctioneer WILL NOT re-open an item because of a tie bid. The record of the auction made by Masterson Brabander Auctions, LLC shall be conclusive. 7. When the auctioneer says 'sold' Bidder assumes full responsibility for the merchandise. Everything MUST be paid for in full at the conclusion of the auction. Bidder agrees to indemnify Masterson Brabander Auctions, LLC against any claim if sales tax is not collected on Bidder's purchases. Bidder agrees that under no circumstances will he/she initiate a charge back on his/her credit card. Title to the merchandise transfers to Bidder only when Bidder's payment has been honored. 8. Great care and many hours of research have been taken to list and label auction items using our best judgement however, neither Masterson Brabander Auctions, LLC, the consignors, the help, nor any of its agents make any warranties, guarantees or representations of any kind in regard to the merchandise. No statements made at the sale, in any advertising, labels, tags, sales tickets or elsewhere shall be deemed such a representation or warranty or be subject to liability. All items sold as is, where is and all sales are final. Buyers are encouraged and advised to inspect and satisfy themselves of the merchandise prior to the sale. 9. Masterson Brabander Auctions, LLC, the consignors, the help do not warranty the fitness of any item for a particular purpose. Buyer assumes responsibility for having all items including but not limited to electrical items checked by a professional. 10. Antique & vintage toys may not meet today's requirements for lead based paints, small pieces removable and/ or otherwise and age recommendations. Therefore, all toys are sold as collectible items for adult use only. 11. Antique & vintage linens, clothing, textiles are sold for collectible and display purposes only. 12. If someone in attendance is acting as an agent for a Proxibid buyer, you assume all risks of damage to person or property and specifically release and indemnify Masterson Brabander Auctions, LLC from any liability. 13. Masterson Brabander Auctions, LLC can arrange for packing and shipping. Packing and shipping costs are the responsibility of the buyer. Some items as stated in the individual descriptions will be shipped by a professional packer and may result in higher shipping costs. All items will be insured for the purchase price. Our first priority is to deliver your purchase in excellent condition. 14. Bidder agrees that this agreement shall be governed by the laws of the state of OHIO and hereby grants sole jurisdiction and agrees to submit to the personal jurisdiction and venue of a court of subject matter jurisdiction located in OHIO. Bidder agrees and grants that service of process on them may be obtained by mailing a certified letter, containing a summons, postage prepaid, to them at the address they provided to register. Should a dispute arise between Masterson Brabander Auctions, LLC and Bidder, Bidder waives any right to a trial or hearing in a court of law and agrees to settle the dispute through binding arbitration in MEDINA COUNTY, OHIO. 15. Masterson Brabander Auctions, LLC may refuse a buyer's number to anyone for any reason. Bidder agrees to provide any identification Masterson Brabander Auctions, LLC may request including but not limited to: drivers license, photocopies of credit cards or US Passport. Bidder agrees to comply with any stated additional terms or conditions associated with particular items. 16. We want you to be happy with your purchases. If you have questions about the merchandise the time to ask questions is well in advance of the live auction. No returns are allowed. Thank you for your patronage.
